USO and Distinguished Citizen Joyce Schellhorn (Mayor Glasser) Mayor Glasser recognized Ms. Joyce Schellhorn for receiving the National Defense Distinguished Citizen metal awarded by the Daughters of the American Revolution. Mayor Glasser read and presented her with the nomination letter. 2C. National Safe Boating Week Proclamation (Mayor Glasser) Mayor Glasser read the Proclamation and presented it to Dr. Mark Vitry, U.S. Coast Guard Auxiliary 14-4 Jacksonville Beach, FL. PUBLIC COMMENT Mayor Glasser explained the process for public comments and opened the Courtesy of the Floor to Visitors. City Clerk Bartle called each speaker to the podium. He spoke in support of tree and land conservation within the City and the possible purchase of 0 Lily Street. City Clerk Bartle read the names and comments from the citizens who did not wish to speak as follows: Adam Bauernfeind and Katherine Borello - opposed to agenda item 8C Resolution No. 21- 30 Naaman R. Harrell Jr. - opposed to agenda item 8C, Section 4. Katherine Borello wished to clarify her opinion of Resolution No. 21 -30. She stated she is in support of the conservation of the property. However, she does not support Section 4 regarding future use of the property. Mayor Glasser closed Courtesy of the Floor. 3 CITY MANAGER REPORTS 3A. Beach Avenue and Seminole Road Crash Data As a request from residents, CM Corbin invited Chief Gualillo to report crash data for Beach Avenue and Seminole Road. Chief Gualillo provided an overview of the crash data on pages 29-36 of the agenda packet. A conversation ensued regarding additional tactics to gain drivers’ attention to alert them of their speed. 3B. Lifeguard Station CM Corbin reported a request was sent to the City of Jacksonville to assist with the funding of this project. Chief Gualillo addressed issues about the existing building's space, roof, and window challenges and provided an overview of pages 37-44 of the agenda packet. John Phillips, Atlantic Beach Lifeguard Captain, added additional comments and recommendations for the new building plan. Discussion ensued regarding restoring the existing building and parking for lifeguards. Chief Gualillo spoke on the challenges of restoring and possible lifeguard parking with the new plan. CM Corbin requested to re-use the building in a park or at City Hall and not be demolished. 3C. 90-Day Calendar CM Corbin led a discussion regarding dates for another parking workshop. New Atlantic Beach Farmers Market - Julie Olsson CM Corbin gave a brief overview of the Farmer’s Market and their relocation to Jacksonville Beach. He reported that Julie Olsson approached the City about organizing a Sunday Farmer's Market to help avoid scheduling conflicts with other events. Julie Olsson spoke regarding her work history and connection to Farmer's Markets. CM Corbin invited feedback from the Commission and stated he is excited to move forward with Ms. Olsson on opening a market. Mayor Glasser requested CM Corbin to ensure we have a contract in place and adequate parking and looks forward to hearing more about this. 3E. Waste Hauling Contract RFP Submittals CM Corbin reported on the RFP submittals and his plan to have a contract for review by the next City Commission meeting. 4 REPORTS AND/OR REQUESTS FROM CITY COMMISSIONERS 4A. Tobacco Free Florida Week Proclamation (Mayor Glasser) Mayor Glasser reported that the Proclamation had been provided to the requesting parties. 4B. Florida Police "Paint The Town Blue" Week (Mayor Glasser) Mayor Glasser read the Proclamation and presented it to Chief Gualillo. Chief Gualillo thanked the Commission and spoke about two fallen officers, Lance Whitaker and Josh Calverley. 4C. National Public Works Week (Mayor Glasser) Mayor Glasser referred to the Proclamation in the agenda packet and thanked the Public Works Department for their hard work to keep the City beautiful and everything operational. Commissioner Norris • Thanked Public Works and Planning Departments for their excellent work regarding a community event and trying different traffic calming ideas. Page 3 of 12 Agenda Item #1.A. 25 Oct 2021 Page 7 of 131 Regular City Commission May 10, 2021 Commissioner Waters • Reported citizen’s request to look at the possibility of certain areas of the beach being zoned specifically for fishing. Mayor Glasser • Reported she responded to an annual letter from mosquito control not allowing aerial spraying. She advised that if the Commission wishes to discuss this issue further, an additional workshop could be scheduled. • Reported on a matter pending before the Planning Commission and the City of Jacksonville (COJ) to do a land and zoning change near the Atlantic Beach Country Club. She reached out to COJ expressing her concerns regarding the proposed change. The matter has been deferred, and she would keep the Commission updated. CA Durden explained requirements for land and zoning changes and comp plan amendments. Mayor Glasser advised the Commission to reach out to CM Corbin if they have any interest. Mayor Glasser read the Resolution by title. CM Corbin explained the Resolution. Finance Director (FD) Burns reported the change in the amount noted in the Resolution. Commissioner Kelly pointed out that this is not a new debt to the City and it saves the City money. FD Burns reported the total savings would be $393,000 and answered questions from the Commission. FD Burns explained the ordinance authorizes the issuance of the bond and the Resolution actually issues the bond to Key Government Finance, Inc. Mayor Glasser read the Resolution by title. CM Corbin reviewed the background of this item and reported there have been nine (9) public meetings on this topic. CA Durden spoke on the requested changes to the Resolution, which resulted in the addition of Section 4. Discussion ensued regarding the strength of the language in Section 4 regarding future development, the possibility of a conservation easement, and an option to rezone the property as a conservation. CA Durden clarified the steps of the process of acquiring the property. She explained the Resolution would allow COAB to purchase the property. Once the property is purchased, a further conversation could be had about zoning. CM Corbin concurred with CA Durden that we would need to own the property first. Discussion ensued regarding changes to the Resolution. MOTION: To adopt Resolution No. 21-30. Motion: Brittany Norris Second: Bruce Bole Commissioner Norris spoke in support of the additional section (Section 4). She indicated she would not be in favor of rezoning the property at this time and believes neighbors should be included in the discussion if rezoning is proposed. Commissioner Waters expressed concerns about surrounding citizens, drainage, and fiscal responsibility. Commissioner Bole thanked staff for clarification regarding the new section. He spoke in factor of the purchase, noting it is a good investment and could serve as a small insurance plan for the City. Commissioner Kelly spoke in favor of the purchase to protect from sea level rise. Mayor Glasser read the Ordinance by title. CM Corbin requested this item be deferred to the next meeting in order to work out some details. He explained the need for these changes which were largely driven by a new business coming in on Sailfish Drive. PCDD Askew reported on the proposed Ordinance as detailed in the agenda packet. Operation of Committees (Mayor Glasser) Mayor Glasser explained there are issues related to size, quorum, and standardization. Mayor Glasser requested CC Bartle to report. CC Bartle explained the Environmental Stewardship Committee (ESC) was not discussed during the Board Member Review Committee’s initial standardization movement. She reported on quorum issues with CARAC and ESC, which resulted in meetings being cancelled and/or changed to workshops. She also reported on the challenges of scheduling meetings, obtaining a quorum, and establishing an appropriate agenda. Discussion ensued about the advantages of having less meetings, clear agendas and outcomes, regularly-scheduled meeting dates, and standardizing ESC. Mayor Glasser explained that modifications to ESC can be considered during our review and revision of Chapter 23. 11 CITY ATTORNEY/CITY CLERK REPORTS AND/OR REQUESTS CC Bartle reported the BMRC will interview for CARAC at tomorrow night’s meeting. Board/Committee member and staff liaison training was held last week. There were 47 people to be trained and each were given three options to obtain training (in person, attending via Zoom, or watch recorded video). CC Bartle advised she would not be here for the next Commission meeting and upcoming workshop. CA Durden explained the requirement in Section 81 of the Charter for the Commission to appoint a Charter Review Committee in January 2022. She explained it involves a tremendous amount of work and many meetings. She suggested providing a separate budget for her legal services in connection with the Charter review. CC Bartle added, it is time to start thinking of those areas in the Charter that need revisions. 12 CLOSING COMMENTS BY CITY COMMISSIONERS AND CITY MANAGER Commissioner Bole suggested when considering the vendor for the Farmer's Market, consider the fact she is a for-profit organization. He also stated Orange Crush could be one of the biggest events at the Beaches this year. There are two more meetings before the event. Any preparations or suggestions should be discussed before the event. Commissioner Kelly congratulated Mayor Glasser and the Youth Council for the Florida League of Cities award. CM Corbin reminded people the Governor suspended the order for mask mandates. He stated masks are optional for employees and guests in all City buildings and facilities. He stated he would be off for a couple of days in the upcoming week. CM thanked Commissioner Norris for her work on the traffic calming project and the work of the Planning, Engineering, and Public Works staff. Mayor Glasser thanked Commissioner Norris for the traffic calming project. She stated her visit to Fleet Landing was great. PUBLIC COMMENT Mayor Glasser explained the process for public comments and opened the Courtesy of the Floor to Visitors. Deputy City Clerk Diaz called each speaker to the podium. Jeff Berichon discussed problem of aggressive geese in and around the Atlantic Beach County Club (ABCC). He reported on the dangers and health concerns the geese pose to the residents and guests of ABCC. He proposed the City prepare an ordinance to prohibit the feeding of geese. Susan Snead spoke regarding parking, increased traffic and safety concerns regarding Beach Avenue. She suggested enhancing pedestrian traffic and proposed safer travel utilizing landscape boxes. City Manager’s Report CM Corbin reported on the following items: •The City’s new waste hauling contract is being reviewed by CA Durden •Recreation rentals would re-open to the public on June 1, 2021. •The City Budget process has begun •Parking Workshop on Thursday •CM Corbin would be attending an upcoming Florida City-County Management Association conference in Orlando next week. Commissioner Waters asked if the new waste hauling contract would cover trash, yard waste, and recycling because he has been inundated with calls about the waste hauling issues. CM Corbin confirmed the new contract would include all services. 3B. Accept the 90-Day Calendar There was a CONSENSUS to accept the 90-Day Calendar. 4 REPORTS AND/OR REQUESTS FROM CITY COMMISSIONERS Commissioner Bole thanked the City for a nice picnic and enjoyed socializing with everyone. Commissioner Kelly stated she noticed 12 incidents in the news for mass shootings this past weekend. She asked CM Corbin for a status request on ransomware attacks. Commissioner Norris thanked Ms. Barbara and staff for taking time to invest time wi th the children and teach pickleball. She suggested bringing in a traffic engineer to look at additional traffic calming solutions on Beach Avenue and other hot spot areas. Commissioner Waters commented on the geese concerns and how they may impact city waterways. He spoke about adding a bathroom to the lifeguard station. He suggested limiting the hours of accessibility hours would help deal with the homeless people wanting to use it after hours. He stated it could be helpful to the local merchants because the stores tend to be frequented by people only wanting to use the restroom facility. He stated many oceanfront homeowners had built fences in front of the dunes, and the dunes have grown because of it. He stated this might be an additional way to assist with beach re-nourishment. Mayor Glasser updated on Capital Improvement Projects (CIP) and the Jacksonville budget by stating adding additional lifeguard stands could possibly be paid for by the City of Jacksonville (COJ). She stated she had not received any feedback or reaction from the submitted Resolution for Hanna Park initiatives. She informed the Commission she placed copies of letters at their chairs for review regarding the recently passed Bill regarding home-based businesses and stated COAB has over 160 registered home-based businesses. She shared information about Virgilio Rosario, a long-time employee of Atlantic Beach, who passed away recently. He worked for the City for almost 20 years. His co-worker stated he had a heart of gold. She wanted to recognize him and thank him for his service to the City. 5 UNFINISHED BUSINESS FROM PREVIOUS MEETINGS None. 6 CONSENT AGENDA 6A. Commissioner Kelly said she supports the effort of modifying a street the City is not responsible for to slow and calm traffic. Mayor Glasser discussed two North Florida Transportation Planning Organization (NFTPO) projects. One is the safety improvements on Mayport Road, and the second being the engineering of the road diet and where the engineering money would go. She stated these projects would take time and may not be started until 2024 – 2025. She hopes the engineering project would include a crossing near the cultural arts corridor for public safety. Mayor Glasser read the Ordinance by title. Planning and Community Development Director (PCDD) Amanda Askew spoke regarding the Ordinance as detailed in the agenda packet. Commissioner Norris asked if business owners would be able to build additional surface areas (patio) for chairs and tables. PCDD Askew answered yes, additional outdoor surfaces would be permitted depending on drainage and other factors and stated it would cost the business to remove the installed area if they move. Commissioner Bole questioned who would approve the impervious concrete installation to the edge of the right-a-way. PCDD Askew stated staff would review on a case by case basis as described on page 81 in the agenda packet or page 3 of Ordinance No. 65-21- 43. Mayor Glasser asked if specifying decking instead of concrete was permitted. Commissioner Norris supported the idea of having decking or permeable surfaces instead of concrete. PCDD Askew stated a change in the Ordinance requiring some kind of permeable surface could to be added. Mayor Gasser stated this option is already in effect in the Central Business District. She asked where this would be allowed according to the amended Ordinance. PCDD Askew stated it would not be permitted in the DOT right -of-ways but permitted in the Atlantic Boulevard corridor and Mayport Road and some side streets. PCDD Askew stated the language in the Ordinance could be strengthened to include specific requirements to allow for that. Commissioner Kelly asked if a business is approved and installs a deck and then goes out of business, what happens to the deck. PCDD Askew stated the deck belongs to the previous business, and it would be their responsibility to remove it. If not, staff would contact the landlord or property owner to remove the deck. Commissioner Norris asked if the landlord would need to be a part of the application process. CA Durden stated yes, the application needs to be signed by the landlord and lessee of the property. MOTION: Adopt Ordinance No. 65-21-43 along with updates according to comments made tonight to require any surface creation be impermeable and strengthen language to restore the area to its original condition (on first reading). PCDD Askew stated Chapter 24 of the Land Development Regulations has a section dealing with the Central Business District. Staff did not f eel this Ordinance belong in the same section, so it would be including in Chapter 19. CA Durden clarified the difference between the two Ordinances, Chapters, and Sections. Commissioner Kelly stated the Central Business District uses sidewalks (non-permeable surfaces) for outdoor seating. CA Durden stated additional language could be added to state that if additional hard surfaces are installed, then permeable surfaces must be used. Commissioner Bole stated he prefers grass and moveable structures instead of hard surfaces. Mayor Glasser stated the motion covers everything discussed. Preliminary Adaptation Plan CM Corbin reviewed the history of the first Vulnerability Analysis for sea-level rise for the City. During the assessment, long-range issues were discovered, and the Adaptation Plan was created. Page 7 of 9 Agenda Item #1.B. 25 Oct 2021 Page 23 of 131 Regular City Commission May 24, 2021 PCDD Askew and City Engineer (CE) Swann spoke regarding the details of the preliminary Adaptation Plan as detailed in the agenda packet and referenced additional information on the Projects Page on the City's website. CM Corbin asked if raising the finished floor elevation would make a difference with sea-level rise and require changes to City's codes. CE Swann stated further research would be needed to determine what (if any) changes to Codes/Ordinances may be required. Commissioner Kelly asked if it is possible to retrofit a house to raise without the use of heavy equipment. CE Swann stated houses could be raised as a last resort. Some cities have cost-sharing programs, which would be looked at in the future development of the plan. Mayor Glasser asked if any outside consultants were used with preparing this grant. CE Swann stated Jones Edmonds and ATM were used for assistance. She commended staff on a job well done. She also suggested the link to all the information be more visible instead of being embedded in a document to allow better access to the information. PCDD Askew and CE Swann explained the review process and additional requirements for the grant and reviewed the interactive maps. 11 CITY ATTORNEY/CITY CLERK REPORTS AND/OR REQUESTS DCC Diaz spoke regarding a recently-discovered time capsule from 1991. She stated the Commission would be receiving an email invitation to attend a small ceremony to open the time capsule. CA Durden stated she would be working with staff regarding the waste hauler contract. She said she is aware of the citizens' concerns but reviewing the contract is going to take some time. CA Durden stated there was a huge number of bills passed by the legislature this year and she will provide a summary of passed bill pending the Governor's signature. She stated the Florida League of Cities has produced a summary for the bills and would share the information with the Commission. CA Durden stated she would not be able to attend the parking workshop this Thursday. 12 CLOSING COMMENTS BY CITY COMMISSIONERS AND CITY MANAGER Commissioner Bole advised waste pick-up companies are having trouble hiring employees. He stated he thinks right-of-ways are sacred to the City and is going to really look at the ramifications of taking away green space and grass from the citizens. He stated from previous experience, geese can cause health issues and are a very predatory animal. Commissioner Kelly stated she has had negative goose experiences and sympathized with residents. Commissioner Norris suggested reaching out to UNF regarding the Border Collie dog service used there to find out if it helped with the geese situation. She stated concerns about legislating Page 8 of 9 Agenda Item #1.B. 25 Oct 2021 Page 24 of 131 Regular City Commission May 24, 2021 people to or not to feed the geese. The problem is the conditions have become favorable for the geese, and they stay. If the conditions become unfavorable, they should leave. Commissioner Waters stated he feels the duck population is diminishing and the geese population is growing. He stated he would be willing to help in any way. He expressed his concerns about the safety of the beach because he was at the beach for eight hours and did not see any Police Officers patrolling the beach. He expressed his concerns about the upcoming Orange Crush event. Police Chief (PC) Victor Gualillo stated COAB officers would be on the beach for Orange Crush. Additional officers from Jacksonville Sherriff Office (JSO) would be on patrol as well. PC Gualillo stated officers have the option and are encouraged to patrol the beach. However, the officers go where the calls for service are. CM Corbin expressed his concern regarding the passed Bill regarding home businesses and how awful it would be. He stated the Bill referenced allowing welding auto repair or auto body shop in residential areas. He said the current businesses are mostly quiet professional businesses with people just working inside their homes. Mayor Glasser requested CM Corbin to have PC Gualillo brief the Commission about Orange Crush at the next Commission Meeting. She stated she would like to know if there are templates of Ordinances from other Cities regarding prohibiting feeding geese. She said Beach Avenue is a great reason to budget for a Traffic Engineer to conduct a traffic study and offer improvements. She mentioned if COAB gets the money from COJ for a new Lifeguard Station, adding a restroom would be a good asset and could be time-locked to help control the misuse by the homeless population. Duties and Authority As outlined in the Charter Hours of Work Remain the same,including ?exible schedule and work from home options on occasion. WITNESSETH: WHEREAS,Bartle has been employed by the City of Atlantic Beach since August 19, 1991;and WHEREAS,Bartle was appointed as the City Clerk on September 27,2004 with an effective date of October 11,2004;and WHEREAS,the last pay study for the city clerk’s position was done in 2005;and WHEREAS,Bartle achieved the professional designation of Certi?ed Municipal Clerk from the International Institute of Municipal Clerks in 2006;and WHEREAS,the City desires to continue to employ Bartle as City Clerk of the City of Atlantic Beach,Florida,with the responsibilitiesand duties as provided for in the City Charter of the City of Atlantic Beach,as may be amended;and WHEREAS,the City,through its City Commission,desires to provide for certain bene?ts and compensation for the City Clerk and to establish conditions of employment applicable to the City Clerk through this Agreement;and WHEREAS,the City Commission intends to,and by way of approving this Agreement does,provide precedence to this Agreement should any provision herein be found to be contrary to any provisions of the City’s Personnel Policies and Procedures Manual. WHEREAS,Donna Bartle desires to accept continued employment as City Clerk of the City of Atlantic Beach under the terms and conditions set forth herein. NOW,THEREFORE,in consideration of the mutual promises as set forth in this Agreement,the parties agree as follows: This Agreement shall be effective October 1,2021 and shall remain in full force untilterminatedbytheCityorbytheCityClerkasprovidedherein.Section 2.Duties and AuthorityA.The City of Atlantic Beach agrees to continue to employ Bartle as its executiveof?cer with the title of City Clerk to perform the duties and functions speci?ed in the City’sPage1ofll Agenda Item #8.A.25 Oct 2021Page 51 of 131 Charter and Code and to perform other legally permissible and proper duties and functions as the City Commission shall from time to time assign.The terms in this Agreement supersede those in the July 2004 position description,where they con?ict. B.The City Clerk is the executive of?cer appointed by the City Commission to assure that all its enactments are effectively carried out.As such,the City Clerk shall be under the direction of and compensatedat a rate set by the Commission. C.The City Clerk shall faithfully perform the duties as prescribed in the job description as set forth in the City’s charter and/or ordinances and as may be lawfully assigned by the City Commission and shall comply with all lawful Commission directives,state and federal law,City policies,rules and ordinances as they exist or may hereafter be amended.Any future changes to the City’s Employee Handbook that impact the City Clerk’s bene?ts,duties or responsibilities shall go to the Commission for approval. D.Speci?cally,it shall be the duty of the City Clerk to establish and maintain a line of communicationwith the City Manager,to prepare an agenda for every commissionmeeting and a permanent record of each meeting and disseminate information as necessary about activities, ?ndings or decisions by the city commission. E.It shall also be the duty of the City Clerk to maintain a State of Florida Notary Public Commission and shall supervise the activities of the Clerk’s Of?ce staff. F.It shall also be the duty of the City Clerk to provide the City Commission with information as requested about programs of the city government and to serve as supervisor of election for city elections. G.It shall also be the duty of the City Clerk to serve as custodian of all city records including access,and the seal of the city,to administer oaths and to conduct such other activities as may be speci?ed by the City Charter,the city code or the City Commission. H.The City Clerk shall perform the duties of City Clerk of Atlantic Beach with reasonable care,diligence,skill and expertise. I.All duties assigned to the City Clerk by the Commission shall be appropriateto and consistent with the professional role and responsibility of the City Clerk. J.The City Clerk cannot be reassigned from the position to another position without the City Clerk’s express,written consent. participate in all meetings of the Commission.Section 3.Hours of WorkCityClerkunderstands that it may not be possible to complete her duties andresponsibilitieswithina40-hour work week and that she is not eligible for overtime.It is expectedthattheCityClerkwilltypicallyworkduringnormalCityHallof?ce hours,however,it isrecognizedthatshemustdevotetimeoutsideofthosenorinalof?ce hours to accomplish her duties.Page 2 ofll Agenda Item #8.A.25 Oct 2021Page 52 of 131 Therefore,City Clerk will establish her own work schedule and will be allowed to work ?om home on occasion,providedthat such does not result in an adverse effect on the operation of the City. Section 4.Compensation A.Effective,10/01/2021,the City agrees to pay the City Clerk an annual salary of $97,359.15,payable in installments at the same time as other City employees are paid.This includes a 3%increase as of 10/01/2021,as well as a 5%increase due to a decrease in leave accrual. B.The City Clerk shall receive a 5%salary increase upon successful completion of the Master Municipal Clerk Program. C.Effective October 1,2022,the City Clerk’s salary shall automatically increase by the same percentage or amount as the increase for general employees approved by the Commission.In addition to this,the City may increase said salary and/or other bene?ts of the City Clerk in such amounts and to such an extent as the City Commission may determine desirable. This Agreement shall be automatically amendedto re?ect any salary adjustments that are provided to the City Clerk by the Commission. D.Annually,and in compliance with the provisions of applicable law,the City Commission and City Clerk may meet and de?ne such goals and perfoimance objectives that they deteimine necessary for the proper operation of the City Clerk’s Of?ce and in the attainment of the City Commission’s policy objectives.Said goals and objectives shall be generally attainable within the time limitations as speci?ed and the annual operating and capital budgets and appropriationsprovided. E.The City Clerk may make a request to any member of the Commission for a review of any of the terms and conditions of this Agreement including the request for a salary survey.The Commissioner has discretion as to whether to bring these matters to the full Commission for consideration. Section 5.Health,Vision,Dental,Disability,and Life Insurance Benefits. A.The City agrees to continue to provide and to pay the premiums for health, hospitalization,surgical,vision,dental and comprehensive medical insurance for the City Clerk and her spouse,at the minimum plan offered to other full—ti1neCity employees.Beginning January 1,2022,the City will provide and pay the premiums for the buy—upHMO plan for the City Clerk B.The City agrees to make required premium payments for short teim and long teimdisabilitycoveragefortheCityClerk.C.The City shall pay the amount of premium for term life insurance coverage in theamountof$50,000 and supplementalterm life insurance coverage in the amount of $70,000.TheCityClerkshallnamethebene?ciary of the life insurance policy.Page 3 of11 Agenda Item #8.A.25 Oct 2021Page 53 of 131 Section 6.Personal Leave &Flex Time Benefits. A.Upon commencement of this agreement,the City agrees to allow the City Clerk to “cash-in”300 hours of personal leave to be paid by the end of 2021.Clerk shall keep the balance of her personal leave accrual. B.In lieu of continuing the +15 year accrual rate of 10.04 hours per pay period,the City Clerk shall begin accruing personal leave at a reduced rate of 6 hours per pay period and the remaining 4.04 hours be converted into pay by providing a 5%pay increase,which is re?ected in Section 4,Compensation. C.The City Clerk shall keep the balance of her accrued ?ex time and continue to accrue and participate in the ?ex time program for exempt employees,submitting her ?ex time slips directly to Human Resources.Flex time may be earned by the City Clerk for meetings attended after hours. D.The City Clerk is entitled to accrue all unused leave;however,personal leave accrual cannot exceed 680 hours at the end of each ?scal year.The City Clerk shall submit her Leave Request Forms directly to Human Resources.In the event her employment is terminated,either voluntarily or involuntarily,the City Clerk shall be compensated for all accrued personal leave. The City Clerk may request the Commission to consider allowing her to “cash in”an additional amount of accrued leave. Section 7.Cell Phone Allowance The City shall provide the City Clerk a city-issued phone and pay the monthly service charges or provide the City Clerk with a cell phone allowance of $50 per month to compensate her for the business use of her personal cell phone. Section 8.Retirement The City agrees to continue the City Clerk’s participationin the City’s de?ned contribution pension plan under the same terms and conditions. A.The City agrees to pay the City Clerk’s professional dues for membership in theFloridaAssociationofCityClerks,International Institute of Municipal Clerks,and FloridaRecordsManagementAssociation,as well as the costs and fees associated with her Notary PublicCommission.The City may pay other professional dues and subscriptions on behalf of the CityClerk,as are approved in the City’s annual budget (on a line item basis)or as authorizedseparatelybytheCityCommission.B.The City agrees to pay registration fees,and reasonable and customary travel andsubsistenceexpensesfortheCityClerk’s travel to and attendance at professional and officialPage4ofll Agenda Item #8.A.25 Oct 2021Page 54 of 131 travel,meetings and occasions to adequately continue the professional development of the City Clerk,including but not limited to FACC Summer Conference and Academy,FACC Fall Academy,IIMC Region 111 Conference,FRMA Conference,or other similar professional development training opportunities,providedthe associated expenses do not exceed the allocated appropriationin the City Clerk’s annual budget. Section 10.Holidays and Other Standard Bene?ts. The City Clerk is entitled to the same paid holidays and any other standard bene?ts available to the general City employees as may now exist or be made available during the term of this contract. Section 11.Termination by the City and Severance Pay A.The City Clerk shall serve at the pleasure of the City Commission,and the City Commission may terminate this Agreement and the City Clerk’s employment with the City at any time,for any reason or for no reason. B.Should a majority of the entire Commission (three members)vote to teiminate the services of the City Clerk “without cause”,then within ten (10)business days following such vote, the Commission shall cause the City Clerk to be paid any accrued and unpaid salary and bene?ts eamed as of the date of the vote to terminate (including personal leave but excluding such items and allowances as are used in conducting City business such as,but not limited to,cell phone allowance.).Within forty—?ve(45)calendar days following the vote to terminate the City Clerk’s employment “without cause”,the Commission shall cause the City Clerk to be paid a lump sum severance pay equal to 20 weeks of her salary as full and complete payment and satisfaction of any claims of the City Clerk of whatsoever nature arising out of this Agreement or otherwise.As considerationfor such payment,the City Clerk shall,prior to receipt thereof,execute and deliver to the City a general release of the City and its Commission members and its of?cers,agents,and employees for all acts and actions from the beginning of time until the date of release,in substantially the form which is attached hereto and made a pait hereof as Appendix 1.Any severance pay paid under this Section shall be in accordance with,and subject to the limits of, Section 215.425,Florida Statutes.If the City Clerk becomes permanently disabled or is otherwise unable to perform her duties because of sickness,accident,injury,mental incapacity or health,for a period of 12 consecutiveweeks or her accruedleave,whichever is longer,the City shall terminate this agreement,subject to the severance pay provision contained in this subsection. of this Agreement,“for cause”is de?ned and limited for purposes of this Agreement to any of thefollowing:1.Conviction or a plea of guilty or no contest to a felony crime,or a misdemeanorcrimeinvolvingabreachofpublictrust,whether or not adjudication is withheld;2.Violation of any substantive City policy,rule,or regulation,which would subjectanyotherCityemployeetotermination;Page 5 ofll Agenda Item #8.A.25 Oct 2021Page 55 of 131 3.Any intentional act involving moral turpitude causing substantial disrepute to the City;or 4.“Misconduct,”as de?ned in Section 443.036(3 0),Florida Statutes. Section 12.Termination by the City Clerk A.The City Clerk may terminate this Agreement or voluntarily resign at any time by delivering to the City Commission a written notice of termination or voluntary resignation a minimum of fo1ty—?ve(45)days prior to the effective date of the termination or resignation.In its sole discretion,the City may waive,or shorten,the forty-?ve (45)day notice period by a majority vote of the entire Commission (three members). B.If the City Clerk terminates this Agreement or voluntarily resigns after providing the written notice required in Section l2(A),then the provisions of Section l1(B)above,shall not apply.If the City Clerk terminates this Agreement or voluntarily resigns after providing the written notice required in Section l2(A),the City shall pay to the City Clerk any accrued personal leave. Other than paying the City Clerk any accrued compensation that she has earned as of the date of her termination,the City shall have no further ?nancial obligation to City Clerk pursuant to this Agreement,unless the City Commission by a majority vote of the entire Commission (three members)agrees to provide any other consideration.In such event,and as consideration of said approval,the City Clerk shall execute and deliver to the City the general release as referenced in Section 11(B)hereof. C.If the City Clerk terminates this Agreement or voluntarily resigns without providing the notice required in Section l2(A)herein,the City shall not pay to the City Clerk any accrued personal leave.Other than paying the City Clerk any accrued compensation that she has earned as of the date of his termination,the City shall have no further ?nancial obligation to City Clerk pursuant to this Agreement. Section 13.Performance Evaluation The City Commission shall perform an annual performance review of the City Clerk. Section 14.Indemnification. the City Clerk against any action for any injury or damage suffered as a result of any act,event,oromissionofactioncommittedbytheCityClerkwithinthescopeofheremploymenthereunder,provided that the City Clerk timely reports the same to the City Commission and cooperates fullyandhonestlyintheCity’s defense thereof.The City may compromise and settle any such claimorsuitandpaytheamountofanysettlementorjudgmentrenderedthereon.The provisions of thisSectionshallnotapplytoanyclaim,demand,suit or cause brought or asserted against the CityClerkforheractsoromissionscommittedwhileactingoutsidethecourseandscopeofheremploymentunderthisAgreement,committed in bad faith or with malicious purpose or in amannerexhibitingwantonandwillfuldisregardofhumanrights,safety,property or civil rights.Page6of1l Agenda Item #8.A.25 Oct 2021Page 56 of 131 In such instance,the City shall be under no af?nnative obligation to indemnify or defend the City Clerk and the City Clerk shall be solely responsible for all costs associated with her legal defense and any settlement(s)or judgment(s)rendered in connection with the charged conduct. B.Said indemni?cation shall extend beyond the termination of employment and the expiration of this Agreement to provide protection for any such acts undertaken or committed in her capacity with the City as City Clerk,regardless of whether the notice of claim or ?ling of a lawsuit occurs during or following employment with the City. Section 15.Bonding The City agrees to bear the full cost of any ?delity or other bonds required of the City Clerk under any policy,regulation,ordinance or law. Section 16.Code of Ethics The Code of Ethics promulgatedby the Florida Association of City Clerks (FACC),as may from time to time be amended,is incorporated herein,and by this reference made a part hereof. Said Code of Ethics shall furnish principles to govem the City Clerk’s conduct and actions as City Clerk of the City. Section 17.General Terms and Conditions A.This Agreement sets forth and establishes the entire understanding between the City and the City Clerk relating to the employment of the City Clerk by the City.Any prior discussions or representationsby or between the City and the City Clerk are merged into and rendered null and void by this Agreement.The City and the City Clerk by mutual written agreement may amend any provision of this agreement during the life of the agreement.Such amendments shall be incorporated and made a part of this Agreement. B.This Agreement shall be binding on the City and the City Clerk as well as their heirs,assigns,executors,personal representatives and successors in interest. C.This Agreement shall become effective on October 1,2021. D.The invalidity or partial invalidity of any portion of this Agreement will not affect executed by both the City and City Clerk subsequent to the expungement or judicial modi?cationoftheinvalidprovision.E.The parties acknowledge that each has shared equally in the drafting andpreparationofthisAgreementand,accordingly,no court construing this Agreement shall construeitmorestrictlyagainstonepartythantheotherandeverycovenant,term and provision of thisAgreementshallbeconstruedsimplyaccordingtoitsfairmeaning.Page 7 ofll Agenda Item #8.A.25 Oct 2021Page 57 of 131 F.A default shall consist of the breach or anticipatory breach of any covenant, agreement,representation,provision or warranty contained within this Agreement.If a default, breach or anticipatory breach occurs,the party not in default may,at any time or from time to time, pursue to enforce its remedies under this Agreement by suit in equity,action at law or by any other appropriate proceeding,for damages or other relief,or proceed to take any action authorized or permitted under applicable laws or regulations;provided,however,the parties shall,prior to initiating any court proceedings,initiate and complete mediation with a Florida Supreme Court certified mediator in accordancewith the procedures set forth in Section 44.102,Florida Statutes, with costs to be equally shared. G.This Agreement and the rights,obligations and remedies hereunder shall be interpreted and governed in all respects by the laws of the State of Florida.Any suit,action or other legal proceeding arising out of or relating to this Agreement shall be brought in courts of competent jurisdiction in and for Duval County,Florida. WHEREAS,City has employed City Clerk;however the parties wish to enter into a voluntary agreement to terminate their employment relationship and to resolve any actual or potential claims that either party may have against the other by reason of City Clerk’s employment or termination thereof. WHEREAS,the parties desire to set forth the terms and conditions governing City Clerk’s separation of employment and to provide for the settlement and release of any and all disputes or controversies that have arisen,or which may hereafter arise,between City and City Clerk, including without limitation,any and all claims arising out of or in any way related to City Clerk’s employment with or separation from the City. NOW THEREFORE,in consideration of the mutual covenants herein contained and the mutual bene?ts to be derived therefrom,the suf?ciency of which consideration is hereby acknowledged by the undersigned,City and City Clerk agree and state: 1.TERMINATION OF EMPLOYMENT Upon their mutual agreement,City Clerk’s employment with City shall terminate on ,20_,which shall be (was)City Clerk’s ?nal date of employment. 2.NO ADMISSION OF LIABILITY This Agreement is not an admission by City Clerk or City of any wrongful conduct whatsoever. City hereby irrevocably and unconditionally releases,acquits and discharges City Clerk from any and all charges,complaints,claims,liabilities,obligations,promises,agreements,controversies, damages,actions,causes of action,suits,rights,demands,costs,losses,debts and expenses (including attorneys’fees and costs actually incurred),of any nature whatsoever,whether known or unknown,arising out of any act,omission,or event from the beginning of time up to the execution of this Agreement. 6.REFERENCES AND NON—DISPARAGEMENT If it is necessary for City to provide a reference to a prospective employer,City Clerk agrees that he will direct the prospective employer to contact the Director of Human Resources at the City of Atlantic Beach.Additionally,City Clerk and the elected officials agree that they shall not disparage or make untrue statements about each other;provided that this Section shall not apply to comments made to any other governmental entity or as required by law. 7.REPRESENTATIONS AND WARRANTIES The undersigned parties hereby represent and warrant the following to the other: a.City Clerk represents and warrants that:he/she is legally and mentally competent to sign this Agreement;he/she is the sole owner of any claims against the City;he/she has the requisite capacity and authority to make this Agreement,and no portion of any existing or potential claims has been sold,assigned or pledged to any third pa1ty;and he/she presently possesses the exclusive right to receive all of the considerationpaid in exchange for this Agreement. b.City Clerk represents and warrants that he/she has not and will not file any complaints, charges or lawsuits against City or any of its past,present and future elected of?cials, department heads,officers,employees,agents,representatives or attorneys with any governmental agency or any couit,including without limitation,any claim or matter of any nature whatsoever related to or arising out of her employment with or separation of his/her employment,except City Clerk expressly reserves the right to file a claim for unemployment benefits.City Clerk further agrees to indemnify and hold City harmless from any and all loss,costs,damages or expenses,including reasonable attorney fees incurred by City,arising out of any claim that may hereafter be made by City Clerk or any other party. lawsuits against City Clerk with any governmental agency or any court,includingwithoutlimitation,any claim or matter of any nature whatsoever related to or arising outofCityClerk’s employment with or separation of his/her employment with City.d.Each paity is fully aware of the contents of this Agreement and of its legal effect andunderstandsthatitshouldobtainlegaladviceregardingthisAgreementastheydeemappropriate.The paities hereto and each of them,have carefully read this Agreement andknowthecontentsthereof,and they signed the same freely and voluntarily.Page 10 ofll Agenda Item #8.A.25 Oct 2021Page 60 of 131 e.This Agreement sets forth the entire agreement between the parties and supersedes any and all prior agreements or understandings between the parties pertaining to the subject matter herein.No waiver of a breach of any provision of this Agreement shall be construed to be a waiver of any breach of any other provision of this Agreement or of any succeeding breach of the same provision.No delay in acting with regard to any breach of any provision of this Agreement shall be construed to be a waiver of such breach.If any provision in this Agreement is found to be unenforceable,all other provisions will remain fully enforceable. f.No promise or inducement has been made or offered,except as herein expressly set forth, and this Agreement is executed without reliance upon any statement or representationby any of the released parties or their representatives. g.The language of all parts of this Agreement shall,in all cases,be construed as a whole, according to its fair meaning,and not strictly for or against either party. h.This Agreement and any amendments hereto may be executed in multiple counterparts by the parties,or copied.Each counterpart or copy shall be deemed an original,but all counterparts together shall constitute one and the same instrument. 8.JURISDICTION This Agreement shall be governed by the laws of the State of Florida,and venue shall be in Duval County,Florida. 9.BINDING EFFECT This Agreement shall be binding upon and shall accrue to the benefit of the parties hereto,their respective heirs,personal representatives,successors in interest and assigns. Section 2:Term It is the intent of the City Commission,as the governing body of Atlantic Beach,to appointthe City Clerk for an inde?nite term and in furtherancethereof,Employee is hereby appointedas City Clerk of Atlantic Beach effective October 11,2004,and continuing for an inde?nite term thereafter;provided,however,that the indefinite term shall be for a term of one (1)year which shall be automatically renewed from year to year thereafter upon the anniversary date of such appointmentunless either party shall,prior to such anniversary date or at anytime,terminate or cancel this agreement as hereinafter provided. Nothing in this agreement shall prevent,limit or otherwise interfere with the right of the City Commissionto terminate the servicesof Employee at any time,subject only to the provisionsset forth in Section 8 of this agreement. Nothing in this agreement shall prevent,limit or otherwiseinterfere with the right of the set Section 3:Hours of WorkItisrecognizedthatEmployeemustdevoteagreatdealoftime outside the normal office hourstobusinessoftheEmployer,and to that end,Employee will be allowed to take compensatorytimeoffassheshalldeemappropiiateduringsaidnormalofficehoursprovidedthatsuchdoesnotresultinanadverseeffectontheoperationsoftheCity.Agenda Item #8.A.25 Oct 2021Page 62 of 131 Section 4:Compensation The City Clerk is an appointed exempt employee and shall be paid an annual base salary of $47,798.40,payable in installments at the same time as other management employees of the Employer are paid. In addition,Employer agrees to increase said base salary and/or bene?ts of Employee in such amounts and to such extent as the City Commission may determine that it is desirable to do so on the basis of an annual salary review of said Employee made at the same time as similar consideration is given other City employees generally. Section 5:Bene?ts As separate aspects of the City Clerk's employment hereunder,the City shall provide the Employee with the same bene?ts as provided to other full time City employees beginning at the level for an employee with her current City service.Employee shall receive no reduction in bene?ts as a result of this action.Changes to such bene?ts,as applied to all City employees, shall apply to Employee as they would to other employees of the City.These bene?ts include, but are not limited to:personal leave,health and life insurance,longevity pay,holidays with pay,continued pension plan participation,leave cash~in,and reimbursement for of?cial use of personal automobile.In addition,Employee shall receive: (a)Dues and subscriptions.Employer agrees to pay for professional dues and subscriptions necessary for her full participation in national,regional,state,and local associations and organizations necessary and desirable for her professional participation,growth,and advancement,and for the good of the Employer up to an amount not to exceed the amount budgeted. (b)Professional Development.Employer hereby agrees to pay for travel and subsistence expenses of Employee,up to the amount budgeted,for professional and of?cial travel,meetings, and occasions adequate to continue the professional development of Employee and to adequately pursue necessary of?cial functions for Employer,including but not limited to City Clerk's annual conferences. (c)Reimbursement of General Expenses.Employer recognizes that certain expenses of a non- personal and generally job-af?liated nature may be incurred by the Employee,and hereby agree to reimburse or to pay said general expenses,up to an amount not to exceed the amount budgeted,and the Director of Finance is hereby authorized to disburse such monies upon receipt of duly executed expense or petty cash vouchers,receipts,statements or personal af?davits. training in order to promote the development of the employee,improve the quality of personalservicesrenderedtotheCity,equip the employee for career service,and provide a reservoir ofoccupationalskillsnecessarytomeetcurrentandfutureemploymentneeds.(e)Other.The City Clerk shall be entitled to enroll within other optional bene?ts as providedtoothergeneralemployeesoftheCitysuchas:Flexible Spending Accounts,EAP services,vision and dental insurance,and ICMA 457 Plan.Agenda Item #8.A.25 Oct 2021Page 63 of 131 Section 6:Reduction ofBenei"1ts Employer shall not at any time reduce the salary,compensation,or other ?nancial bene?ts of Employee,except to the degree of such a reduction across~the-boardfor all City employees. Section 7:Suspension Employer may suspend the Employee with full pay and bene?ts at any time during the term of their employment;but,only if the majority of the City Commissionagrees. Section 8:Termination and/or Cancellation Either party shall have the right to terminate or cancel this agreement and the employment contemplatedhereby without cause at any time.If the Agreement shall be canceled or terminated by Employer,such cancellationshall be effective immediately upon the delivery by Employer of its notice of desire to terminate or cancel to employee.Employee shall likewise have the right to cancel or terminate this agreement without cause by the delivery of a notice of cancellation to the Employer,at least thirty (30)days prior to the effective date of such ‘ cancellationor terminationunless such written notice shall be waived by the Employer.In the event of the termination or cancellation of employment by the Employer and duringsuch time that Employee is willing and able to perform duties under this agreement,then in that event, Employer agrees to continueto pay salary and bene?ts for at least one hundred eight (180) consecutive days from any preliminary written notice of termination.Employee shall also be compensated for all earned personal leave,holidays and other accrued bene?ts to date.In the event Employee is terminatedbecause of convictionby a competent tribunal of any illegal act constituting a misdemeanor involving a breach of public trust or a felony then,in that event, Employer shall have no obligation to pay the aggregate severance sum designated above. -Inthe event Employer,at any time during the term of this agreement,reduces the salary orother ?nancial bene?ts of Employee in a greater percentage than an applicable across—the—board reduction for all employees of the City,or in the event Employer refuses,following written notice,to comply with any other provision bene?ting Employee,or the Employee resigns following a suggestion,whether formal or informal,by the City Commissionthat she resign, then,in that event,Employee may,at her option,be deemed to be "terminated"at the date of such reduction or such refusal to comply within the meaning and context of the herein severance pay provision. The City may terminate the employment of the City Clerk hereunder without cause provided that any termination or removal of the City Clerk shall be in accordance with the provision of the City Charter.In such event,the City Clerk shall continueto be paid her salary and bene?ts for at least one hundred eight (180)consecutive days from any preliminary written notice of termination without cause. Section 9:DisabilityIfEmployeeispermanentlydisabledorisotherwiseunable to perform her duties because ofsickness,accident,injury,mental incapacity or health for a period of four successive weeksbeyondanyaccruedleave,Employer shall have the option to terminate employment of theEmployee,subject to the severance pay requirements of Section 8 and the Family Medical LeaveAct. Section 11:Bonding Employer shall bear the full cost of any ?delity or other bonds required of the Employee under any law or ordinance. Section 12:General Provisions If any provision,or any portion thereof,contained within this resolution is held unconstitutional, invalid or unenforceable,the remainder of the resolution,or portions thereof,shall be deemed severable,shall not be affected,and shall remain in full force and effect. For the purpose of ef?cient management of Police Department resources and to provide a high level of service to the citizens of Atlantic Beach,the best practice of setting parameters for the replacement of Police Fleet vehicles has been used with success for many years. Steve Swann,City Engineer October 14,2021 October 25,2021 The Governor of the State of Florida signed in to law Senate Bill 64 which requires that domestic wastewater utilities that dispose of treated ef?uent to surface waters submit a plan to the Florida Department of Environmental Protection by November 1,2021 to eliminate the surface water discharge by January 1,2032.The purpose of this law is to reduce ground water withdrawals for drinking water by encouraging utilities to utilize treated ef?uent as a source of potable water. The City is permitted to discharge up to 3.5 million gallons per day of treated ef?uent to the St.Johns River from the wastewater treatment facility.Currently,the City discharges approximately 1.5 million gallons per day of treated ef?uent to the St.Johns River and reuses an average of 200,000 gallons per day for irrigation at the Atlantic Beach Country Club. WITNESSETH: Whereas,ABPD and DCPSPD are so located in relation to each other that it is to the advantage of each to receive and extend mutual aid in the form of law enforcement services and resources to adequately respond to continuing,multi-jurisdictional law enforcement problems,so as to protect the public peace and safety,and preserve the lives and property of the citizens; Whereas,the DCPSPD and the ABPD have the authority under the Mutual Aid Act,Chapter 23, Part I,Florida Statutes,and section 1006.12(2)(c),Florida Statutes,to enter into a mutual aid agreement for law enforcement services which permits voluntary cooperation and operational assistance of routine law enforcement nature across jurisdictional lines; Whereas,the DCPSPD and the ABPD did enter into that certain Voluntary Cooperation Law Enforcement Mutual Aid Agreement dated as of July 1,2019 and now desire to amend and restate that agreement in its entirety so that it is fully superseded and replaced by the terms and conditions set forth in this Agreement;and Whereas,the aforesaid law enforcement agencies,City and School Board may individually be referenced as “the agency”and collectively be referred to as “the parties"or “agencies”; and, Whereas,the "Amended and Restated Voluntary Cooperation and Operational Assistance Law Enforcement Mutual Aid Agreement"will be herein referred to as "this Agreement”. The Agreement is notto be interpreted or construed,in anyway,for either party to transferto,or for either party to assume,the law enforcement services provided by the other agency that is a party to this Agreement. SECTION II.PROCEDURES FOR REQUESTlNG ASSISTANCE In the event that a party to this Agreement is in need of law enforcement assistance as set forth above,an authorized representative of the agency requesting assistance shall notify the agency head or his/her designee from whom such assistance is requested.The agency head or authorized agency representative whose assistance is sought shall evaluate the situation and the agency's available resources,consult with his/her supervisors if necessary and will respond in a manner he/she deems appropriate. The agency head in whose jurisdiction assistance is being rendered may determine who is authorized to lend assistance in his/her jurisdiction,for how long such assistance is authorized,when such assistance in whole or part may terminate,and for what purpose such authority is granted.This authority may be granted either verbally or in writing as the particular situation dictates. Should a sworn law enforcement officer be in another subscribed agency’s jurisdiction for matters of a routine nature,such as traveling through the jurisdiction on routine business, attending a meeting or going to or from work,or transporting a prisoner,and a violation of Florida Statutes occurs in the presence of said party,representing his/her respective agency, he/she only shall be empowered to render enforcement assistance and act in accordance with Florida law.Should enforcement action be taken,said party shall notify agency having normal jurisdiction and upon the latter’s arrival,turn the situation over to them and offer any assistance requested including,but not limited to,a follow-up written report documenting the event and the actions taken.This provision so prescribed in this paragraph is not intended to grant general authority to conduct investigations,serve warrants and/or subpoenas or to respond without request to emergencies already being addressed by the agency or normal jurisdiction,but is intended to address critical,life-threatening or public safety situations, prevent bodily injury to citizens,or secure apprehension of criminals whom the law enforcement officer may encounter. Officers assigned to task force operations pursuant to this Agreement who observe a violation of Florida Statutes in their presence shall be empowered to render enforcement assistance No officer shall be empowered under this agreement to operate in the other agency’sjurisdictionwithoutpriorapprovaloftheagencyheadhavingnormaljurisdiction.TheDCPSPDwillnotifytheABPDpriortosuchactionifpriornoticeisreasonablypossibleunderthecircumstances.This includes investigating statutory violations and rendering enforcementactions,as necessary.The agency head‘s decision in these matters shall be final.015573874 Page 2 of 10DuvalCountySchoolPoliceDepartmentandAtlantic Beach Police Department Agenda Item #8.D.25 Oct 2021Page 94 of 131 SECTION III.REPORTING ACTS THAT POSE A THREAT TO SCHOOL SAFETY A.The DCPSPD and the ABPD are parties to that certain “lnteragency Agreement Regarding Sharing information about Juvenile Offenders”dated effective July 22, 2019.This lnteragency Agreement provides for a coordinated effort among agencies and staff to implement the provisions of sections 985.04(1)(c),F.S.,and provides for the release of personally identi?able information without the consent of the student or the student’s parents pursuant to section 1002.221(2)(c),F.S.This Section Ill is governed by those provisions of the lnteragency Agreement that provide for the DCPSPD and the ABPD to cooperate in the dissemination of information relating to students,and the requirement that the parties comply with all state and/or federal laws related to confidentiality,records use,security,dissemination,and retention/destruction,including consequences for violation of law. B.In order to report acts that pose a threat to school safety pursuant to section 1006.13, F.S.,the DCPSPD shall obtain written reports from Duval County Public Schools (the “School District”)and provide such reports to the ABPD.The School District annually adopts its code of student conduct (elementary and secondary)for students within the jurisdiction of the School District,and such annually adopted codes of student conduct identify acts of students required to be reported to law enforcement.in addition to the foregoing,the DCPSPD shall report to ABPD any similar conduct of acts that pose a threat to school safety if committed by adults who are not otherwise subject to the jurisdiction of the School District’s codes of student conduct. C.The School District has adopted Board Policy 5.28 (“Zero Tolerance for School-Related Crimes"),which requires School District principals to inform all school personnel of their responsibilities regarding the reporting of a threat to school safety and the required consultation with law enforcement (whether the DCPSPD or the ABPD,whomever receives the initial report).in order to ensure communication between each law enforcement agency of acts that pose a threat to school safety,the DCPSPD shall provide its reports to the ABPD no less frequently than weekly,and the ABPD shall provide its report to the DCPSPD no less frequently than weekly.Each agency shall designate a person responsible for receiving each weekly report and implement written directives within each agency as necessary to accomplish the reporting required by section 1006.13, F.S. SECTION IV.Command and Supervisory Responsibility The personnel and equipment that are assigned by the assisting agency head shall be under the immediate command of a supervising officer designated by the assisting agency head. Such supervising officer shall be under the direct supervision and command of the agency SECTION V.CONFLICTSWheneveranofficerofan agency is rendering assistance pursuant to this Agreement,theofficerorappointeeshallabidebyandbesubjecttotherulesandregulations,personnelpolicies,general orders and standard operating procedures of his/her agency that he/she isemployedby.If anyrule,regulation,personnel policy,general order or standard operatingprocedureiscontradicted,contravened or otherwise in conflict with a direct order of a superior015573874Page3of10DuvalCountySchoolPoliceDepartmentandAtlanticBeachPoliceDepartment Agenda Item #8.D.25 Oct 2021Page 95 of 131 officerof the requesting agency,that is a party to this Agreement,the rule,regulation, personnel policy,general order or procedure forthe assisting law enforcement of?cer's agency, that employs him or her,shall control and supersede the direct order ofthe requesting agency. SECTION VI.HANDLINGCOMPLAINTS Whenever there is cause to believe that a complaint has arisen relating to the cooperative effort of an officer providing assistance pursuant to this Agreement,the agency head or his/her designee of the agency receiving the complaint shall be responsible for the documentation of the complaint to ascertain,at a minimum: A.The identity ofthe complainant, B.Contact information for the complaining party, C.The specific allegation(s),and D.The identity of the employees accused without regard as to agency affiliation. If it is determined that the accused is an employee of the assisting agency,the above referenced information,with all documentation concerning the complaint,shall be forwarded,without delay,to the agency head or his/her designee of the assisting agencyfor administrative review.The requesting agency may conduct a review of the complaint to determine if a factual basis for the complaint exists and/or whether any of the employees of the requesting agency violated any of their agency's policies procedures. SECTION VII.POWERS,PRIVILEGES,IMMUNITIES AND COSTS A.Employees of the DCPSPD and the ABPD when actually engaging in mutual cooperation and assistance outside of their respective jurisdictional limits oftheir agencies but inside this state,pursuant to the terms of the Agreement,shall,pursuant to the provisions of section 23.127(1),F.S.,have the same powers,duties,rights,privileges and immunities as if the officer was performing duties inside the officer's jurisdiction in which he/she is normally employed. B.The parties agree to furnish necessary personnel,equipment,resources and facilities and to render services to the other party to this Agreement as set forth above; provided,however,that no party shall be required to deplete its own personnel, equipment,resources,facilities,and services in furnishing such aid. C.A party herein that furnishes equipment pursuant to this Agreement must bear the cost of or damage to that equipment and must pay any expense incurred in the operation D.Except as set forth in Section lX.B:a.The agency furnishing aid,pursuant to this Agreement,shall compensate itsofficersandappointees/employees during the time such aid is rendered and shalldefraytheactualtravelandmaintenanceexpensesofitsemployeeswhiletheyarerenderingsuchaid,including any amounts paid for compensation due to personalinjuryordeathwhiletheofficerisengagedinprovidingaid.015573874 Page 4 of 10DuvalCountySchoolPoliceDepartmentandAtlantic Beach Police Department Agenda Item #8.D.25 Oct 2021Page 96 of 131 G. b.However,the requesting agency may compensate the assisting agency during the time of the rendering of such aid and may defray the actual travel and maintenance expenses of such employees while they are rendering such aid,including any amounts paid or due for compensation as a result of personal injury or death while such employees are rendering aid pursuant to this Agreement. The privileges and immunities from liability,exemption from laws,ordinances andrules and all pension,insurance,relief,disability,worker's compensation,salary,death and other benefits that apply to the activity of an officer of the agency when performing the officer's duties within the jurisdictional boundaries of the officer's agency shall apply to the officer to the same extent while engaged in the performance of the officer's duties pursuant to this Agreement.The provisions of this Subsection shall apply with equal effect to paid,volunteer,and auxiliary employees. Nothing in this Agreement shall prevent the assisting agency that has provided law enforcement services from requesting appropriations from the governing authority having budgeting jurisdiction to reimburse the assisting agency for the actual costs or expenses incurred by the assisting agency performing hereunder. Nothing in this Agreement is intended or is to be construed as any transfer or contracting away of the powers or functions of one party to the other. SECTION VIII.FORFEITURE PROVISIONS A.In the event an agency seizes any real property,vessel,motor vehicle,aircraft, currency or other property pursuant to the Florida Contraband Forfeiture Act during the performance of this Agreement,the seizing agency in the case of voluntary cooperation shall be responsible for maintaining any forfeiture action and shall have the exclusive right to control and the responsibility to maintain the property in accordance with Chapter 932,F.S.,to include,but not be limited to,the complete discretion to bring the action or dismiss the action or settle the action. All proceeds from forfeited property seized as a result of or in accordance with this Agreement shall be divided equally between the parties,less the costs associated with the forfeiture action. SECTION IX.OUTSIDE EMPLOYMENT AND RESPONSIBILITIES OF THE PARTIES A. 01557387-1 DCPSPD and ABPD authorize ABPD sworn law enforcement officers to voluntarily work outside employment as aid for DCPSPD at the Atlantic Beach Elementary School (“ABES")(#65,298 Sherry Drive,Atlantic Beach,FL 32233)when off-duty from their is specifically designated for in Section 1006.12,F.S.and the “Marjory StonemanDouglasHighSchoolPublicSafetyAct"until a time when the DCPSP has sufficientemployedlawenforcementofficerstoserveatschoolsiteswithinDuvalCountyandsubjecttotheprovisionsofthisAgreement.The parties agree:Page 5 of 10DuvalCountySchoolPoliceDepartmentandAtlantic Beach Police Department Agenda Item #8.D.25 Oct 2021Page 97 of 131 a.That neither party shall be responsible for investigating non-criminal violations of student conduct. b.To comply with all state and federal laws,directives,practices,orders,and the written policies of the parties raised at the pertinent time. c.To be responsible for the handling of all complaints against their own employees,to include conducting use of force investigations. B.Responsibilities of DCPSPD/the School Board. DCPSPD agrees: a.To respond to calls for service which occur on the ABES school grounds.if a DCPSPD unit is not available via dispatch,DCPSPD will assign ABPD to the call. b.To conduct investigative follow-up for all criminal violations except homicide,sexual battery,and bomb threat investigations that occur on the ABES school grounds. The School Board agrees: a.For the School Board’s Fiscal Years 2021-2023 (July 1,2021 —June 30,2022 and July 1,2022 —June 30,2023).To completely compensate assigned ABPD officers for their outside employment hours assigned and worked for the DCPSPD, including but not limited to,salary and fringe benefits for both on—duty and overtime assignment by DCPSPD at the rate of fifty—fivedollars per hour ($55.00/hour)during any regular school day,which shall include pre—employment training.For purposes of this Agreement,a “regular school day”is defined as a weekday in which school is in regular session,and not include:afterschool activities,recess days,legal holidays,teacher planning days,or summer days.The School Board shall directly compensate the assigned ABPD of?cers such compensation every two weeks following the ABPD submission to the DCPSPD of the associated hours worked. b.The facilities in need of assistance of no more than one (1)ABPD officer assigned as a DCPSPD officer in school fiscal year 2021-22 are no more than:Atlantic Beach Elementary School (#65,298 Sherry Drive,32233).This determination is subject to amendment on proximately August 1,2022 based upon the personnel needs of DCPSPD and the written approval by the City Manager of Atlantic Beach and Chief of the ABPD. C.Responsibilities of ABPD. SECTION XV.ENTIRE AGREEMENT Theis Agreement contains the entire Agreement between the parties and supersedes any and all prior agreements and understandings whether written or oral,between the parties relating to the subject matter of this Agreement. SECTION XVI.EFFECTIVE DATE AND TERM This Agreement as Amended shall be effective upon the approval and execution by all parties hereto.This Agreement will continue and be effective through June 30,2023,unless terminated prior thereto. SECTION3.CONFLICTING ORDINANCES.All ordinances or parts of ordinancesin conflict with this Ordinanceor parts thereof previously adopted or enteredby the City in con?ict with this Ordinance are temporarily suspendedto the extent inconsistent herewithand until a ?iture ordinance is adopted which permanently addresses the subject matter.This Ordinance shall not be codified. SECTION 4.SEVERABILITY.If any section,subsection,clause,or provision of this Ordinance is deemedinvalid or unconstitutionalby a court of competent jurisdiction,such portion will become a separate provision and will not affect the remaining provisions of this Ordinance.
