Shellenberger, Jr. 1850 Live Oak Lane Atlantic Beach, Florida 32233-4510 Re: Fence location at 1850 Live Oak Lane Dear Colonel Shellenberger: I have reviewed the information you have provided depicting the location of the split rail fence, which extends around the corner of your lot, and encroaches into the public right -of-way. Based upon information in City files, this fence has been in its current location since at least 1988. After consulting with the Department of Public Safety and Fire Services, it is the position of the City that the fence may remain its present position, with the exception of that portion of the fence located closest to the fire hydrant. The fence must be “shortened” to provide a clear distance of six (6) feet on either side of the fire hydrant. Additionally, any landscaping that interferes with clear visibility of the fire hydrant should be trimmed or removed. Please bear in mind that the fence remains in the right-of-way at your risk. Should the City need access to this portion of the right-of-way for any reason, including road construction, utility work or to provide emergency services, the fence may be removed by the City with no obligation to repair or replace the fence.
