Mr. Snodgrass,
I have reviewed the conceptual site plans you provided. I am unclear from your survey where
the existing garage is located, but converting the existing garage into a bedroom is permitted
with respect to zoning regulations, subject to compliance with Florida Building Codes for that
type of conversion, and provided there is no increase to the building footprint (unless any
addition complies with setbacks and the Building Restriction Line.)
The additions you have proposed in both drawings A and B present problems. The required
front yard setback in the RS-2 Zoning District is 20 feet, but the Seaspray subdivision has a
stricter Building Restriction Line of 25-feet. (The Community Development Board cannot
grant Variances to deviate from Building Restriction Lines. This would require a change to the
subdivision plat.) The side yard setback in the RS-2 Zoning District is a combined 15 feet,
with not less than five feet on either side. Since the north side of your residence is
approximately seven feet, the required setback on the south side is eight feet.
A Variance could be sought for the zoning district setbacks, but I must frankly advise that these
types of Variances are rarely approved. I have provided a Variance application for your
information.
