1629 Linkside Drive (Janet Pellicciotti) 06.27.2005 June 27, 2005 Janet Pellicciotto 1629 Linkside Drive, North Atlantic Beach, Florida 32233 Re: Impervious Surface Area for proposed addition to 1629 Linkside Drive, North Dear Ms. Pellicciotto: I have discussed your proposed addition with the City’s Public Works Director and City Attorney, and we have concluded that City Staff does not have the authority to approve your addition, which based upon your calculations, would result in a 65% Impervious Surface Area on your lot. The 50% residential Impervious Surface Area limit has been consistently applied to all new residential development since becoming effective on January 01, 2002. As we have discussed, pursuant to Section 24-64 of the City’s Land Development Regulations, a Variance cannot be used to modify this particular development standard. There are several other options you may wish to consider.  Section 24-46, enclosed, provides for a Waiver procedure that is considered by the City Commission. I have enclosed a Waiver application form.  Section 24-50 (a), also enclosed, provides for the appeal of an administrative decision made by me, as Community Development Director, to the Community Development Board. I have no objection to an appeal should you wish to pursue this. (I do not take these personally, and in fact, sometimes recommend this procedure when there are questions related to administrative authority.) I believe that the Waiver, however, may be the more appropriate procedure in this case.  Finally, you may wish to consider using an alternative material for your driveway, such as a Turf Block or a semi-pervious paver. Areas using properly installed pavers are calculated as 50% pervious. Please feel free to contact me at 247-5817 if you would like to discuss further.
