Dear Mr. Bennett:
I have reviewed the legal description and survey for your Kestner Road property. (The map you faxed
with the legal is from a very old zoning map.) This property has 200-feet of frontage, and is
approximately 135-feet deep. The property does not contain sufficient width to divide into more than
two lots since the minimum width for new lots is 75-feet. Also, the property has not been previously
platted, and division into more than two lots would require approval by the City Commission and
recording of a Final Subdivision Plat.
Within your correspondence, you made reference to the smaller lots of the Paradise Cove subdivision.
That project went to public hearings before the Community Development Board and the City
Commission several years ago. The lot sizes and a Final Subdivision Plat were approved by the City
Commission. The City’s Zoning and Subdivision regulations have been amended several times since
that project was approved.
The Kestner Road property is zoned RG-1 and it is within a Residential, Low Density (RL) land use
category. In accordance with the City’s Land Development Regulations and Comprehensive Plan, the
existing 200-foot by 135-foot parcel can be divided into only two lots, per attached Section 24-189. The
lots may be configured at your discretion, provided that each lot is at least 75-feet in width and contains
7500 square feet of lot area. Either a single-family residence or a duplex / two-family dwelling could be
constructed on each resultant lot, subject of course to other applicable Land Development Regulations
