Dear Mr. Marcello:
In considering the several options that might be used to address the Richardson Lane
roadway issue, the City proposes to prepare and have recorded a plat, or an amended
plat of this area, which would establish the proper right -of-way for Richardson Lane,
and also include within this plat the two new lots that Beaches Habitat has proposed to
develop. A portion of Richardson Lane is within the E.H. Donner’s Subdivision, but
the property immediately north of Donner’s Road and east of Richardson Lane consists
of un-platted tracts of land.
Section 95.361, Florida Statutes, establishes a presumption of dedication of this
roadway to the City in any event, but since this is not a particularly large area, and the
City has a current survey of Richardson Lane, I believe that the recording of a plat is
the clearest way to resolve this issue. In the event that your plans to develop the two
lots precede the completion of the platting process, the City will recognize the property
purchased by Beaches Habitat, and the proposed division of this tract into two lots as a
legal division of property with each lot entitled to each be developed with a two-family
