AN ORDINANCE Relating to and Regulating Building Cpnstruc-
tion in the Town of Atlantic Beach.
BE IT ORDAINED BY THE 1VIAYOR' AND TOWN COUNCIL OF THE TOWN OF
ATLANTIC BEACH, FLORIDA.
SECTION 1. That
of the Town of Atlan-
tic Beach, Florida, be and he is hereby constituted and appointed
Building Inspector for the Town of Atlantic Beach, Florida.
SECTION 2. Before any person, firm or corporation shall
erect, repair, change or alter any building, furnace, bake oven,
tank for oil or gas, or structure within the Town limits, he or
they shall first make written application to. the Building Inspec-
tor for a permit for that purpose, and shall file with him a writ-
ten statement giving the proposed location by lot and block number,
dimensions and manner of the construction of the proposed building
or other structure and the material used, and`shall, when required
by the Building Inspector, file plans and specifications of the pro-
posed building or structure, and if it shall appear that the laws
and ordinances of the Town are complied with and that the proposed
construction is satisfactory to the Building Inspector, he shall
grant

not, however,
be required to
grant
any
permit
until
the

shall be such
as to insure that the building or structure will -be of requisite
strength and not necessarily dangerous'as a fire risk, and are in
accordance with this ordinance. The Building Inspector shall keep
a record of all such permits.
SECTION 3. The Building Inspector in no case shall issue a
permit unless and until the application therefor is examined and
approved in writing by him. A fee of $2.00 for repairs; $3.00 for
remodeling; $5.00 for new structure, shall be paid the Building In-
spector for the issuance of each and every permit in and under the
provisions of this ordinance.
SECTION 4. All wood buildings shall be constructed of
material of sufficient strength to support a building of the
size and description proposed, and every building shall be prop-
erly braced.
SECTION 5. No building or other structure of any kind in
the Town of Atlsn.tic Beach shall be covered with wood shingles or
other wood roofing.
Any person making application for permit to repair a shingle
roof to the extent of not more than ten per cent. thereof may be
granted the privilege of doing so.
SECTION 6. (a) All chimneys or flues for fire -places shall
be well and securely built from the ground up and through the
building to a point at least three feet above a flat roof and two
feet ,above ridge of peak roof of such building; the walls shall.
be of stone or brick, at least eight inches in thickness. Such
or stone work shall be laid in cement mortar up to the first floor,
and thence up to a point where the chimney protrudes through the

anchored together or properly capped; and from and above the roof
to the top of chimney the brick or stone work shall be laid in
cement mortar. All joints shall be struck smooth on the inside,
except when lined with burnt clay or terra cotta pipes. �'Ihen two
or more separate flues are provided in a chimney, the division
walls between the flues may be only four inches in thickness.
Any chimney or other stack built of mortar or like material
shall be erected after first lining said chimney with improved
flue lining of size and dimensions used by the Standard Building
code.
No chimney flue shall be started or built upon any floor
or beam of wood.
(b) No wood casing, furring or lath or other wood shall
be placed in, against or within two inches of chimney or flue,
except that wood rmantbls, floors and baseboards, when protected
by asbestos or other fire -resisting material, may come in con-
tact with chimney or flue.
(c) All hearths shall be composed of incombustible material,
shall rest on trinvner arches, the header kept at least eighteen
inches from face of the chimney breast. The back of all fire-
places shall be not less than eight inches thick,, all stove pipe
holes to have the proper thimbles and stoppers. If a heater is
placed in the fire -place, then the hearth shall be of such area
as to permit of six inches clearance beyond heater on each open
side.
All fire -places in which heaters are placed shall have in-
combustible mantbls; no woodmantels or other wood work shall be
exposed back of a summer piece. The iron work of the summer
pieces shall be placed against the brick or stone work of the
fireplaces. No fireplace shall be closed with a wood fire board.
When a grate is set in a fireplace, a lining of fire brick, soap-
stone, the or cast iron shall be added to the fire back.
(d) Single chimneys or flues for stoves or kitchen ranges
shall be constructed as described in paragraph (a) of this see -
tion, except that the walls of such chimneys or flues may be
only four inches in thickness.
(e) At the completion of building, all flues should be
properly closed and rubbish removed and flues left clean on
the inside.

(f) Chimneys and flues partly or wholly outside the
building shall be constructed as described in the foregoing
paragraphs of this section.
(g) All chimneys now standing which are dangerous in any
manner whatever, or which are not constructed in accordance
with this section, and every wall; house, building or other
structure in the town which is in an unsafe condition and liable
to endanger the life or limb of any person passing thereby or
residing therein or being in the vicinity thereof, or to cause
damage to property other than that of the owner of such wall,
house, building or other structure because of fire or otherwise
is hereby declared to be a nuisance and shall be repaired and
made safe or removed.
SECTION 7. No dwelling shall be erected within five feet
of the boundary line between private property.
ALL buildings shall be built as nearly on a line with other
buildings in the same or adjoining blocks as practicable, and as
nearly as practicable, equal distance from the front line of such
block.
SECTION 8. It shall be the duty of the Fire Committee of
the Town Council to make a general inspection from time to time
of buildings in the Town to see that the requirements of this
ordinance are being enforced and immediately report to the Mayor
any violation thereof, and they shall be and'ar.e hereby em-
powered to call upon the -Building Inspector for any needed
assistance.

SECTION 9. All construction, fixtures, types and structures
in connection with the building or repairing of building shall
adhere as exactly as possible with the building regulations of the
City of Jacksonville, except as set forth in this ordinal ce. A
copy of said building regulations shall be at all times kept in
the office of the Town Clerk an. d open for inspection. By special
reference herein said building regulations, as aforesaid, are made
a part

SECTION 10. Any person violating any of the provisions of
this ordinance shall, upon conviction before the mayor's Court,
be punished by fine not exceeding $100.00, or by imprisonment
not exceeding thirty days.
SECTION 11. This ordinance shall become effective immedi-
ately upon its passage and approval by the Mayor.

Section 1.: In these regulations the follow-
