1660 Beach Avenue VIOLATION
IMAGES ABOVE AND BELOW ARE FROM GOOGLE EARTH, ACCESSED ON 10/27/2011. ABOVE IMAGES SHOW THE REAR OF 1660 BEACH AVENUE AND CRAPE MYRTLES
PLANTED IN RIGHT-OF-WAY BEHIND WHITE VAN THAT WERE REPORTEDLY REMOVED A BY RESIDENT ON 10/20/2011. THE INFORMANT TOLD THAT AT
APPROXIMATELY THE SAME TIME AS REMOVAL, OFFICER PECK HAD STOPPED AND ASKED THE RESIDENT TO MOVE HER VAN OFF OF THE ROAD, AND SHE TOLD HIM
THAT SHE WOULD AS SOON AS SHE HAD REMOVED THE TREES. HE TOLD HER THAT SHE NEEDED TO CHECK WITH THE CITY REGARDING TREE REMOVAL, AND
APPARENTLY SHE TOLD HIM THAT SHE PLANTED THE TREES SO SHE COULD REMOVE THEM.
INFORMANT SAID RESIDENT LIVES AT 1660 BEACH AVENUE, SO THE
REAR OF HER CONDO IS ADJACENT TO COQUINA PLACE WHERE IT
INTERSECTS WITH SHELL, JUST NORTH OF THE LITTLE PARK. THERE IS
A “NO PARKING” SIGN JUST BEHIND THE VAN, AND THE WOODEN
FENCE IS LOCATED ON THE PROPERTY LINE, ACCORDING TO A SITE
PLAN FOUND IN LASERFICHE.
REMOVAL OF TREES FROM PUBLIC R/W PRIOR TO OBTAINING A
PERMIT IS A VIOLATION OF CHAPTER 23 OF THE MUNICPAL CODE,
REQUIRING AN AFTER-THE-FACT PERMIT [SECTION 23-23(a)(3)], THE
COST OF WHICH IS $250.00, OR TWICE THE NORMAL ESTABLISHED
FEE [23-51(d)(1)] AND REPLACEMENT OF REMOVED TREES AT THE
RATE OF TWO (2) INCHES PER EACH ONE (1) INCH REMOVED, WHICH
IS DOUBLE THE STANDARD MITIGATION RATE WITHIN PUBLIC R/W
[SECTION 23-51(d)(2)]
