I spoke with Mr. Kazmierczak this morning and told him that the dead palm on your private property
may be removed without a tree removal permit. It qualifies for an exemption under provisions of
Section 23-22(a), which allows for removal of trees on previously developed sites with no development
activity, as well as Section 23-22(c), which allows removal of trees deemed to be a safety hazard, and/or
Section 23-22(d), which allows removal of trees deemed to be diseased or pest -infested.
As to the other two palms that you indicated to be located between your property line and the sidewalk,
have confirmed that, according to the survey of the Historic Palm Corridor, that those trees adjacent to
your property are not "historic", and therefore do not require approval of the City Commission to
remove. However, these are still located in the City right-of-way, and are therefore considered "public"
trees. You may apply for a tree removal permit to remove them, but it is generally the position of the
Public Works Department to deny approval to remove public trees unless they meet one of the
conditions for exemption, such as diseased, pest -infested or dead; emergency or safety hazard, such as
after a severe storm; or for access, utility or infrastructure improvements.
I will forward a copy of your letter and this response to the Public Works Department so that a field
crew may once again assess the condition of those palms in the right-of-way, and prune as may be
needed.
