Sec. 24-173.Neighborhood preservation and property maintenance standards. (b)Appropriate maintenance and upkeep. All areas of a lot and structures that are visible from the street or a neighboring property shall be maintained in an acceptable manner,which shall be defined by the following characteristics: 1. Lots are maintained free from litter,trash, debris, discarded belongings, automotive parts,old tires,construction materials,and broken and abandoned items. 2. NATURE OF VIOLATION: The green Waste Management dumpster is unscreened. In accordance with code, dumpsters and refuse collection areas must be screened from view as required by Section 24-160. VIOLATION CODE(S): Sec.24-160. Dumpsters, garbage containers and refuse collection areas and above ground tanks.(b)Within commercial, industrial and multi-family zoning districts,dumpsters,trash receptacles, above-ground tanks and similar structures and containers shall be screened from view by fencing or landscaping,or shall be located so that these are not visible from adjacent properties or streets. Above-ground tanks used to store hazardous, chemical or explosive materials may remain unscreened upon determination by the director of public safety that a threat to security and public safety may result from screening such tank(s)from view. Screening shall consist of either: densely planted trees and shrubs at least four(4)feet in height at the time of installation and of an evergreen variety that shall form a year round visual barrier and shall reach a minimum height of six(6)feet at maturity;or an opaque wood, masonry,brick or similarly constructed fence,wall or barrier. Respondent owns the property located at 1985 Mayport Road, Atlantic Beach, Florida. ("The Property"). 2. Notice of the hearing was sent on June 13, 2022, for the July 7, 2022, Code Enforcement hearing. The Respondent did not appear, but has been in contact with the City of Atlantic Beach and made application for a fence permit. 3. The Respondent was cited for violation of City of Atlantic Beach Code 24-160 for failure to screen or enclose a dumpster from the street view. 4. The City of Atlantic Beach provided evidence that the Respondent had cleaned up the material around the dumpster and had submitted application for a fence permit on June 28, 2022. The City of Atlantic Beach recommended that the Respondent be allowed a thirty (30) day grace period to comply after the permit has been approved. CONCLUSIONS OF LAW 5. The City of Atlantic Beach provided proper notice to the Respondent. The Respondent was in violation. However, has mitigated some of dumpster material violations and has submitted a fence application to attempt to come into full compliance. ORDER Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is Ordered:, A. The hearing on the violation is stayed until the September 1, 2022 special magistrate hearings (if necessary). Respondent owns the Property located at 1985 Mayport Road, Atlantic Beach, Florida. ("The Property"). 2. Notice of the hearing was sent certified mail on November 7, 2022, for the January 19, 2023, Code Enforcement hearing. The Respondent appeared for the hearing. 3. The Respondent was cited for violation of City of Atlantic Beach Code, Section 24-160, Dumpster and screened enclosures. 4. The City of Atlantic Beach provided evidence that the Respondent did make an application for a fence permit after receipt of the notice of violation and Special Magistrate Hearing. However, the permit was denied as was a variance application to the Community Development Board. 5. The Respondent stated he had made an effort to hide the dumpster using artificial turf as fence material. The City of Atlantic Beach stated they met with the Respondent and approved the hedges, requested removal of the screening and move the structure back. The City of Atlantic Beach stated that if this is completed by January 27, 2023, they would not be requesting a fine be imposed. CONCLUSIONS OF LAW 6. The Respondent was properly served notice of the hearing and appeared at the hearing. ORDER Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is Ordered: A.
