Mayor Glasser called the meeting to order at 10:00 a.m.
1 TOPIC FOR DISCUSSION AND PUBLIC COMMENTS
A. Complete Streets
PCDD Askew presented a PowerPoint on Complete Streets, a proposed transportation
policy designed to create safe and accessible streets (which is hereto attached and made
part of this official record as Attachment A).
Discussion ensued regarding how the Complete Streets policy would affect road
construction projects, the usefulness of the Complete Streets checklist, safety of Mayport
Road, school bus stops, and ideas for increased bike safety on Beach Avenue.
Commissioner Norris suggested implementing an engineer study to evaluate traffic on
Main Street and Donner Road in support of the Complete Street initiative. Mayor Glasser
acknowledged the tremendous contributions PCDD Askew and the Planning and Zoning
Department have made to the City of Atlantic Beach through the Complete Streets and
Resiliency projects.
CM Corbin discussed the handout from AE Engineering, Inc. proposal for Donner Road
Design Review and Comments (which is hereto attached and made part of this official
record as Attachment B) and the Complete Streets Planning and Initial Design Concepts
for Main Street (which is hereto attached and made part of this official record as
Attachment C). CM Corbin spoke regarding additional projects including chicanes, an
artificial narrowing of the road used to reduce vehicle speeds. Traffic engineers will audit
the traffic controlling devices implemented by COAB and determine if they are meeting
the desired outcomes and offer constructive feedback. CM Corbin discussed the
evidence of neighborhood support as a governing factor in creating a thoughtful process

regarding requested traffic calming devices and spoke regarding the importance of data
in determining priority outcomes. Commissioner Norris suggested implementing
solutions that encourage accountable driving and recalled how citizens parking their cars
on Main Street has resulted in the calming of traffic.
CM Corbin discussed parking concerns/projects that would benefit from a traffic
engineer study including Ahern Street, Sherry Drive at Atlantic Beach Elementary, in
addition to Donner Road and Main Street.

2 PUBLIC COMMENTS - OPEN TOPIC
Jane Stevens expressed gratitude for the painting of the curb along the south side of Penman
Road and increasing safety for bikers. She also suggested painting a strip of reflective paint on
the Seminole Road sidewalk to illuminate the path.
Dee Davis, Jordan Community Center Manager, spoke regarding the opportunities and
challenges of the Jordan Park Community Center after school program. Discussion
continued regarding center procedures and certification requirements as well as next
steps going forward.

The scope of services for this contract includes providing Planning and Engineering staff to assist the City of
Atlantic Beach on tasks (outlined below), on an hourly basis not to exceed the presented budget. Tasks are

used and tasks assigned. Task 5 additional services are at the discretion of the city and will not be performed until

Day celebration was Birds of Fire band leader Kenny White,who sadly left this world in October 2021,and
whose message of hope,unity and the gospel re?ected Dr.King’s vision and will inspire us forever;and
WHEREAS,the 2022 Martin Luther King,Jr.,Day Celebration will be held at 11 a.m.Saturday,
January 15,at the Seawalk Pavilion in Jacksonville Beach;and

WHEREAS,the current year budget for Public Works contains funding for one new truck for the Parks
Division and one new truck for the Streets Division;and
WHEREAS,the price quoted from Alan Jay Fleet Sales under Sourcewell’s Contract #2022 120716—NAF
&060920-NAB for a new 2022 Ford F150 Pickup Truck is $28,307.00 each,for a total of $56,614.00;and
WHEREAS,the truck for the Parks Division will replace P-59,a 2010 Ford Ranger with 51,878 miles,
and the truck for the Streets Division will replace P-50,a 2008 Ford F250 with 100,594 miles;and
WHEREAS,since individually,each of these trucks are over the $25,000 City Manager approval level,
we are seeking Commission approval to streamline the purchasing process;and
WHEREAS,trucks are funded in both the Parks and Streets FY21—22budget.
NOW THEREFORE,be it resolved by the City Commission of the City of Atlantic Beach as follows:
SECTION 1.The City Commission hereby authorizes Public Works to enter a requisition for two new
2022 Ford F150 Pickup Trucks as quoted by Alan Jay Fleet Sales;and
SECTION 2.The City Commission hereby authorizes the City Manager to approve a purchase order to
Alan Jay Fleet Sales in the amount of $56,614.00 for both trucks,and to otherwise execute contracts in accordance
with and as necessary to effectuate the provisions of this resolution.
SECTION 3.Funds are allocated in the FY 21-22 budget for this purpose.
SECTION 4.This Resolution shall take effect immediately upon its passage and adoption.

TERM OF SUZANNE GREEN AS SPECIAL MAGISTRATE FOR ONE YEAR;
AUTHORIZING THE CITY MANAGER TO EXECUTE CONTRACTS AND
PURCHASE ORDERS IN ACCORDANCE WITH AND AS NECESSARY TO
EFFECTUATE THE PROVISIONS OF THIS RESOLUTION;AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS,the City retained the Special Magistrate services of Suzanne Green as
approved in Resolution No.21-13;and
WHEREAS,the City of Atlantic Beach Code of Ordinances Sec.2-143 (e)stipulates that
the annual term of Special Magistrate may be extended upon adoption of a resolution of the City
Commission;and
WHEREAS,the City of Atlantic Beach desires to extend Suzanne Green’s term as Special
Magistrate for one year.
NOW THEREFORE,be it resolved by the City Commission of the City of Atlantic Beach
as follows:
Section 1.The City Commission hereby extends the term of Suzanne Green as Special
Magistrate to perform Special Magistrate services.
Section2.Funds are available for this purpose in Account No.001-1006-524.34-O0 Code
Enforcement-Other Contractual Services.
Section 3.The City Manager is hereby authorized to execute the contract in accordance

APPROVING THE ENGINEERING SERVICES FOR A 12”WATER MAIN
INSTALLATION NEAR NORTH SHERRY DRIVE;AUTHORIZING THE

WHEREAS,on December 10,2021,staff received a Continuing Contract Agreement from
Crawford,Murphy &Tiller,Inc.,in the amount of $92,138 to provide professional engineering
services for the installation ofa new 12”water main near North Sherry Drive;and
WHEREAS,an engineering proposal by Crawford,Murphy &Tiller,Inc.,provided the City
with a scope of work to include permitting,design,bidding assistance and performance of
construction administration services;and
WHEREAS,funds for this design are budgeted in infrastructure account 400-5504-533-63-00
under project number AR2203.
NOW THEREFORE,be it resolved by the City Commission ofthe City ofAtlantic Beach as
follows:
SECTION 1.The City Commission hereby authorizes the City Manager to execute the
Continuing Contract Agreement with Crawford,Murphy &Tiller,Inc.,in the amount of $92,138.00
for Engineering Services related to the installation of a new 12”water main as described in the
Crawford,Murphy &Tiller,Inc.,contract agreement,and;
SECTION 2.The City Commission hereby authorizes the City Manager to approve a

D.SCOPE OF SERVICES
Part 1:Design from the northwest comer of Oceanwalk Community a 12”water main
that will connect to the existing 10”water main at this location and continue north to
Wonderwood Drive where it will connect to an existing 8”water main.
Part 2:Identify most appropriate location for a 12”water main north of the connection at
Oceanwalk with the 12”water main continuing westerly to Mayport Road and inter-tie
with an existing 10”water main at this location.Upon acceptance of the Department of
Public Utilities of the proposed location,design the 10”water main inter-tie and assist the
Department of Public Utilities in obtaining easements,if necessary.
Topographic survey will be provided in this task order and will be used for the layout of the
proposed water main.This work order scope also includes Subsurface Utility Engineering
services (SUE)for the location of existing water distribution mains and other utilities found to be
in close con?ict with the proposed construction.We do not anticipate the need for a geotechnical
investigation,environmental evaluation,R/W mapping,easement acquisition,and
landscape/irrigation design services.
We anticipate plans and speci?cations to be submitted for review and approval by Department of
Public Utilities staff at the 60%and a ?nal submittal for bidding purposes.A cost estimate will
be submitted for the Department of Public Utilities use at the Final design stage.A construction
permit application will be submitted to the Florida Department of Environmental Protection
(FDEP)for the water main construction and to the Florida Department of Transportation (FDOT)
for workinside the FDOT right of way and easement.We do not anticipate Water Management
District permitting,or sanitary sewer utility replacement or adjustments within the project area.
E.PROJECT TASKS
1.00 Design Plans:
A.Develop 60%design of water main running along the unimproved portion of Sherry
Drive.This preliminary design will take the most ef?cient route possible without the
indiscriminateremoval of large trees.This design route will continue north within the
improved portion of Sherry Drive N.to Wonderwood Dr.avoiding large specimen
trees and other underground utilities within the right—of-way.
B.Evaluate and determine the most appropriate location for a 12”water main north of
the connection at Oceanwalk with the 12”water main continuing westerly to Mayport
Road and inter-tie with an existing 10”water main at this location.Upon approval of
the proposed location by Department of Public Utilities staff,develop 60%design of
the water main inter-tie and prepare draft easement documents,if necessary.
C.Contact R/W utility users in an attempt to identify utility con?icts and coordinate

A RESOLUTION OF THE CITY OF ATLANTIC BEACH,FLORIDA,DESIGNATING
A 32-INCH DIAMETER LIVE OAK TREE AS A HERITAGE TREE ON THE CORNER
OF 19”‘STREET AND NORTH SHERRY DRIVE;AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS,Atlantic Beach’s tree canopy beautifies our community and improves the lives of our citizens
and visitors by bringing nature to our urban environment and preserving environmental sanctuaries for connection
with the natural world;and
WHEREAS,the City Commission of the City of Atlantic Beach desires to be a good steward of the tree
canopy,particularly specimens of physical and historical significance;and
WHEREAS,the City Commission has the ability to designate individual trees as Heritage Trees according
Section 23-41 (a)of the Atlantic Beach Code of Ordinances;and
WHEREAS,the Heritage Tree designation runs with the property and increases the mitigation ratio ifthe tree
is ever removed;and
WHEREAS,the City Commission created the Environmental Stewardship Committee in 2017 to serve as
curators of our environment,thus creating a legacy for future generations of our community;and
WHEREAS,as its 2022 Arbor Day project,the Environmental Stewardship Committee has nominated a 32-
inch-diameter live oak tree at the corner of 19"‘Street and North Sherry Drive as a Heritage Tree;and
WHEREAS,the nominated tree has a 100.53-inch circumference;is approximately 128 years old;was
selected because of its intrinsic value due to its age and size;and is nicknamed “The Companion Tree”;and
WHEREAS,the Environmental Stewardship Committee will hold an event on January 21,2022
commemorating Arbor Day and celebrating the Heritage Tree designation.
NOW,THEREFORE,be it resolved by the City Commission of the City of Atlantic Beach:
SECTION 1.The City Commission hereby designates a 32-inch diameter live oak at the corner of 19"‘Street
and North Sherry Drive as a “Heritage Tree.”

II.Basic Services Description
A.The Architect will rely on the approvedSchematicDesign Office Layout drawings
dated 09 O7 21 as the basis for design.Both parties,however,recognize that such
information may change by mutual consent,and,in that event,the Client and the
Architect shall appropriately adjust the schedule,the Architect’s servicesand the
Architect’s compensation if the changes are “material”.
B.The Architect’s Basic Services consist of those described in this Article III and
include the usual mechanical and electricalengineering services,but the structural
services are based on the previousStructuralAssessment completedby LJG
Engineering,Inc.whose recommendationswere accepted by the Client.Services
not set forth in this Article III are Supplementalor Additional Services.
C.The Architectshall coordinateits services with those services providedby the Client
and the Client’s consultants.The Architect shall be entitled to relay on (1)the
accuracy and completeness of the services and information furnished by the Client
and (2)the Client’s approvals.

is consistent with the Client’s schedule and budget for the Cost of the Work.
F.Discuss any new ideas from the Client and Client Representativethat will help
?nalize the design and operationalscope of this project and incorporate same into
the preliminaryproject templates.
G.Prepare Design Development plans,sections,and elevations based on the outcome
of the previous Schematic Design approved by the Client for discussion and further
re?nement.Re?ne elevations as necessary to achieve the desired aesthetic as
determinedby the Architect and the Client.The Design Development package will
be based on sketches provided by the client for character and the Schematic Design
sketchesprovidedby Architect and approved by the Client.
H.If applicable,review schematicwork with Client and make any necessary changes
or contract adjustments required to establish an approvedplan from which design
development documents can be developed.
1.Prepare documents required to obtain planning approvalfor the project by the
reviewing authorities.This is expected to be consistentwith the information
providedby the Client.
J.Prepare ?nal Design Development Documents to include CAD base sheets,
additionalwall sections,basic details,window and door scheduleoutlines and
complete engineeringschematics including HVAC,Elec.,Plumbing,and Structural
Designs per the previous study by LJG Engineering.
K.Based on the Client’s approvalof the Design Documents,the Architect shall prepare
for the Client’s submittal Construction Documents consisting of Drawings and
Informationthat the local jurisdictionrequires in order to issue a permit to complete
the Project.The actual permits will be obtainedby the Client and their Contractor.
This phase will include all necessary coordinationof all requiredengineering.The
Client and Architectacknowledge that in order to construct the Work the Contractor
will provide additional information including Shop Drawings,Product Data,
Samples and other similar submittals,which the Architectwill review in accordance
with Section 13.
L.The Architect shall review and approve,or take other appropriateaction,upon the
Contractor’s submittals such as Shop Drawings,Product Data and Samples,but only

professionalresponses.If there are any con?icts or oversights by our consultant
group in our contract documents,it is the responsibility of the Architect to provide
this additionalinformation or amended details at no additional cost to the clients.
Design and Construction are not perfect sciences but a team effort to do the best job
possible to help create a good and fully functional facility in which all parties
involved can take pride at its completion,commissioning and ultimate functionality.
The Architect shall advice and consult with the Client during the Construction Phase
Services.The Architect shall visit the site at intervals appropriateto the stage of
constructionto become generally familiar with the progress and quality of the
portion of the Work completed,and to determine,in general,if the Work observed
is being perfomied in a manner indicatingthat the Work,when fully completedwill
be in accordance with the Contract Documents.However,the Architect shall not be
required to make exhaustive,or continuouson-site inspections to check the quality
or quantity of the Work.The Architect shall not have control over,charge of,or
responsibilityfor the constructionmeans,methods,techniques,sequences or
procedures,or for safety precautionsand programs in connection with the Work,nor
shall the Architect be responsiblefor the Contractor’s failure to perform the Work in
accordance with the requirementsof the Contract Documents.The Architect shall
not be responsible for,acts or omissions of the Contractor or of any other persons or
entities performing portions of the work.
Prepare ?nal close-out review of the project including the Contractor’s punch list
resolution,?nal pay and retention release documentationand contract closure.
Additional Services Description
The basic servicesoutlined above will be an all-inclusivepackage to cover
Design Development through ?nal Contract Documents required for permitting and
project completion.
The Architect shall provide servicesnecessitatedby a change in the Initial
Information,changes in previous instructions or approvalsgiven by the Client,or a
material change in the Project including size,quality,complexity or the Client’s

Project Qualitvand Budget Expectations
The quality level of this project can be best described as consistent with the recent

marketplace.Budgets will be establishedas soon as there is agreement on the
overall design concepts and building systems are conceptually identi?ed.The
budget will be continuously revised as more detail is known about the scope and
quality of the project.
Project Schedule
Work can begin immediately upon acceptance of this Agreement and receipt of the
retainer.Client further understandsthat Z&A does not control consultant and/or
city and/or state agencies and their holiday scheduleand delays may be incurred.
Client Responsibilities
The Client will be responsibleto deliver to the Architect accurate surveys to
describe physical characteristics,legal limitationsand utility locationsfor the site of
the Project,topographicaldata and test boring analyses and recommendations.The
Client will also obtain any necessary Site planning permits requiredby the local

Architect/Engineering Liabilities
The Architect and Engineers must hold required current licenses to practicetheir
respective professions in the appropriatestate and sign and seal their respective
drawings and details as required for permitting.The Architect and his consultants
will carry appropriatelevels of E+O insurance and general liability coverage.
Deliverables
Periodiccopies of progress work will be provided to the Client for review and
comments throughout the evolution of the design process.In addition,record sets
of documents or conclusion of groups of activities will be provided for review at the
completionof the following milestone activities:
All necessary Engineering Services will be incorporatedinto the
Construction/ContractDocuments and be co-coordinatedwith each other.Technical
speci?cations will be preparedjointly by the Architect and General Contractor and
speci?cationswill be incorporatedinto the Contract/ConstructionDocuments as
notes and Drawing Sheets.It is the Contractor’s responsibilityto obtain all
necessary building permits for the project.
Fee and Payment Schedule
The A/E fee will be $60,000 be paid in accordance with the following schedule.

Project Engineering Services included in this proposal are Mechanical,
Plumbing,Electrical,Structural and Fire Protection.Additional Engineering
services which mav be needed are contracted directlv with the clients such as:

or treated as a reimbursableexpense)

Normal reimbursableexpenses such as,but not necessarily limited to the following:
Postage,courier delivery when requested by the client;prints other than in-house
progress prints,large scale reproductions,etc.,will be billed to the client without a
markup.
Interpretation
Interpretationsand decisions of the Architect shall be consistent with the intent of
and reasonably inferable from the Contract Documents and shall be in writing or in
the form of drawings.When making such interpretationsand initial decisions,the
Architect shall endeavor to secure faithful perfonnance by both Client and
Contractor,shall not show partiality to either,and shall not be liable for results of
interpretationsor decisions so rendered in good faith.Architect’s decisions on
matters relating to aesthetic effect shall be ?nal if consistent with the intent
expressed in the Contract Documents.
Indemnification:The Client and its af?liates shall indemnify and hold harmless
Zona &Associates,P.A.and all of its personneland consultantsform and against
any and all claims,liability,damages,losses and expenses (including attomey’s fees
and defense costs)arising out of or resulting from the performanceof the services,
including the procurement of specializedpermits by consultants,provided that any
such claims,damage,loss or expense is caused in whole or in part by the negligent
act(s)or omission(s),and/or strict liability of Zona &Associates,P.A.or anyone
directly employed by Zona &Associates,PA.This indemni?cationshall include
any claim,damage,or losses due to the presence of hazardous materials.

XIV.Hidden Conditions:Zona &Associates,P.A.shall not be responsiblefor hidden
conditions nor any resulting damages to persons or property.A condition is hidden
if concealedby existing ?nishes (excluding lay-in type ceilings),buried below
?oors or ?nished grade,or is not capable of investigation by reasonablevisual
observation.If Architect has reason to believe that such a conditionmay exist,
Architect shall notify the Client who shall authorize and pay for all costs associated
with the investigation of such a conditionand,if necessary,all costs necessary to
correct said condition.If (1)the Client fails to authorize such investigation or
correctionafter due noti?cation,or (2)Architect has no reason to believe that such a
condition exists,the Client is responsiblefor all risks associatedwith this condition,
and Architectshall not be responsiblefor the existing conditionnor any
resulting damages to persons or property.Architectshall have no responsibilityfor
the discovery,presence,handling,removal,disposal or exposure of persons to
hazardousmaterialsof any form.
XV.Mediation
1.Any claim,dispute or other matter in questionarising out of or related to this
Agreement shall be subject to mediation as a conditionprecedentto binding dispute
resolution.If such matter relates to or is the subject of a lien arising out of Zona’s
and its Consultants services,Zona may proceed in accordancewith applicablelaw
to comply with the lien notice or ?ling deadlinesprior to resolutionof the matter by
mediation or by binding dispute resolution.
2.Mediation,unless the parties mutually agree otherwise,shall be administeredby the
American Arbitration Association in accordancewith the Construction Industiy
Mediation Rules of the American Arbitration Associationcurrently in effect on the
date of this Agreement.The parties shall share the mediator’s fee and any ?ling
fees equally.

A demand for arbitration shall be made no earlier than concurrently with the ?ling
of a request for mediation,but in no event shall it be made after the date when the
institution of legal or equitableproceedingbased on the claim,dispute or other
matter in questionwould be barred by the applicablestatute of limitations.For
statute of limitationsptuposes,receipt of a written demand for arbitrationby the
person or entity administering the arbitration shall constitute the institute of legal or
equitableproceedings based on the claim,dispute or other matter in question.
The award rendered by the arbitrator(s)shall be ?nal,and judgement may be
enteredupon it in accordancewith applicablelaw in any court having jurisdiction
thereof.
XVII.Jurisdiction and Venue
This agreement shall be governed by,and construedwith,the laws of State of
Florida and venue for any disputes shall be in Duval County,Florida.
XVIII.Termination or Suspension

This Agreement may be terminated by either party with or without cause upon not
less than seven (7)days written notice.In the event of termination,the Architect
shall be compensatedfor services performedprior to termination,reimbursable
expenses incurred,and all costs attributedto termination,including costs
attributableto the Architect’s terminationof consultant agreements.
If the Client fails to make payments to Zona accordance with this Agreement,and
at Zona &Associates’sole option,the failure to pay as describedin this Section is
cause for suspensionof performance of services under this Agreement.If Zona
elects to suspend services,Zona shall give seven days’written notice to the Client.
Upon receipt of such notice,if Client pays Zona within seven days,all amounts due
under this Agreement for servicesperformed through the date of suspension plus
any expenses incurred in the interruptionand resumption of the Architect’s
services,then the failure to pay is deemed cured and the Parties shall resume with
this Agreement.
Neither Zona’s failure to immediately exercise its options to terminate for cause,
nor its implementationof suspensionrights as identi?ed in this Section of this
Amendment,shall constitute waiver.

Copvri,uht &Licenses
The Architect grants to the Client a nonexclusivelicense to use the Architect’s
Instruments of Service solely and exclusively for purposes of constructing,using,
maintain,altering and adding to the Project.Any unauthorizeduse of the
Instruments of Service under this section shall not apply if the Client rightfully
terminatesthis Agreement.Additionally,any unauthorizeduse of the Instruments
of Service shall be at the Client’s sole risk and without liability to the Architect and
the Architect’s consultants.
CAD Files
Upon completionof the project and upon receipt of CAD File Release Fomr;
Architect will provide Client/ClientAutoCAD ?les of the permittedproject.
