The City of Atlantic Beach stated that they have received emails from the Respondent stating he would work on removing the vehicles to come into compliance. The Respondent had 4 vehicles on the Property instead of the allowable two vehicles. On January 19, 2023 the City of Atlantic Beach reviewed the Property and stated that only two vehicles remained on the Property and had been moved to come into Code. The City of Atlantic Beach requested that although the Respondent was now in compliance, they are not requesting a fine be imposed at this time. However, due to the fact the Respondent was in violation, if the violation reoccurs, it should be treated as a repeat violation for a fine of$500.00 per day. CONCLUSIONS OF LAW 5. The City of Atlantic Beach provided proper notice to the Respondent and the Respondent had been conversing with the City of Atlantic Beach regarding compliance and the hearing. The Respondent was in violation of Section 24-163, but was in compliance before the hearing date. ORDER Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is Ordered: A.
