These standards are set forth in the International Property Maintenance Code and the Florida Building Code and were adopted as part of the City of Atlantic Beach Code of Ordinances in Chapter 6,Article II, Section 6-16. A code enforcement inspection at 300 5TH ST was conducted on 11/22/2021 & 2/2/2022. The City of Atlantic Beach Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of Ordinances: NATURE OF VIOLATION: A stop work order was posted on 11/22/2021 at your property for construction of a pergola without a permit. To date we have not received a permit application and the pergola has not been removed. The our municipal code and the Florida Building code both require a permit for this structure as noted below. VIOLATION CODES: 1. FBC Section 105 Permit 105.1 Required. Any owner or authorized agent who intends to construct, enlarge, alter,repair,remove,demolish,or change the occupancy of a building or structure, or to erect, install,enlarge,alter,repair, remove, convert or replace any required impact resistant coverings, electrical, gas, mechanical or plumbing system,the installation of which is regulated by this code, or to cause any such work to be done, shall first make application to the Building Official and obtain the required permit. 2. Sec. 24-151. -Accessory uses and structures. (a)Authorization. Accessory uses and structures are permitted within any zoning district, as set forth within this section,where the accessory uses or structures are clearly ancillary, in connection with,and incidental to the principal use allowed within the particular zoning district. Any permanently located accessory structure,which exceed thirty(30)inches in height, also including without limitation,those which may not require a building permit,are subject to all land development regulations unless otherwise provided for within this chapter.Temporary structures, such as portable tents,canopies,awnings or other nonpermanent structures shall be limited to special occasion use only, and for a period of not more than ninety-six(96)hours, i.e., four(4)days. This letter requests that the noted violation(s) be corrected by obtaining a valid City of Atlantic Beach building permit and approved insepctions of the structure within thirty (30) days of the receipt of this notice. Failure to correct the violation by the required date may result in this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two hundred fifty dollars ($250.00) per day.
