Ordiance No. 2-90-1 vL .wr ORDINANCE NO. 2-90-1 AN ORDINANCE IMPOSING AN IMPACT FEE ON CERTAIN LOTS IN THE SECTION "H" SUBDIVISION FOR IMPROVEMENT, EXPANSION, AND/OR REPLACEMENT OF THE ROAD SYSTEM OF THE CITY. WHEREAS, the City Commission of the City of Atlantic Beach is improving the Section "H" subdivision by the construction of paved roads and a drainage system, and WHEREAS, the funds for this project are being fully funded by a bond issue to be paid for from general income to the City, NOW, THEREFORE BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS: SECTION 1. There is hereby imposed an impact fee upon all the blocks and lots in an area bounded on the north by Levy Road, on the east by Mayport Road, on the south by Atlantic Blvd., and on the west by a line 102 feet west of the westerly right-of-way line of Jasmine Street excepting therefrom the following Blocks: 43, 44, 54, 63 and 64 in Section "H" subdivision and Lots 5 A & B, 6 A & B, 7 A & B, 8 A & B, 9 A & B, 10 A & B, 11 A in the Snug Harbor Subdivision. Section 2. IMPACT FEES. The fee for paving and drainage and maintenance and expansion of the City's road system for growth shall be as follows: $15.00 per front foot for each Lot or Block, or fractional part thereof, on which a building permit is requested. SECTION 3. PAYMENT OF IMPACT FEES. Impact fees shall be paid prior to the issuance of a building permit. The City Manager may allow payment of fees on an extended plan for up to five years in the event the owner has demonstrated to the satisfaction of the City Manager that the lump sum payment will constitute a hardship to the applicant. A lien for the amount due shall be executed in recordable form reflecting the payment schedule. Upon all payments being made in full, a release of lien shall be issued by the City. SECTION 4. DISPOSITION OF IMPACT FEES. All revenues collected by the City through Paving and Drainage impact fees shall be held in a special account to be known as the Paving and Drainage Capital Improvement Account. The money so deposited and held in said account and all interest accrued thereto shall be used only for the improvement, expansion, and/or replacement of paving and drainage in the City. SECTION 4. This ordinance shall become effective immediately upon its final passage.
