and were adopted as part of the City of Atlantic Beach Code of Ordinances in Chapter 6, Article II,
Section 6-16.
A code enforcement inspection at 1770 MAYPORT RD was conducted on 3/2/2022. The City of
Atlantic Beach Code Enforcement has found your property to be in violation of the City of Atlantic
Beach Code of Ordinances:
VIOLATION CODE: Sec. 17-61. - Permit required. No sign shall be installed, erected or placed prior
to issuance of a sign permit as required by this chapter, except for exempt signs as set forth in section
17-26. A sign permit shall not be issued prior to issuance of the appropriate occupational license as
required for the activity on the property for which the sign permit is sought.
NATURE OF VIOLATION: The signage for this building has been changed. No permit application
has been submitted to the City of Atlantic beach for this signage.
This letter requests that the noted violation(s) be corrected by obtaining a valid sign permit within
ten (10) days of the receipt of this notice.
Thank you for your cooperation in this matter. Failure to correct the violation by the required date may
result in this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two
hundred fifty dollars ($250.00) per day. Upon completion of the action required, it is your responsibility
to contact me and arrange for an inspection to verify compliance. Please contact Atlantic Beach Code

STATEMENT OF CODE ENFORCEMENT OFFICER: The signage for this building has been

correction by the Code Enforcement Officer in the Notice of Violation that you received, the case may be

So pole sign banners come down now and banner on the building can remain ( with permit of couse)?
I understand the pole sign has to conform to current code and this is showing to be updated to a monument
in the permanent sign permit submittal.
With the pole sign now being non-conforming does that need to also be removed now?

Banners, under our code, are considered temporary signs and are only allowed for up to 60 days.They can only have 2.
If they wanted permanent signage on the fronts of those buildings,they would need to include that in their permit

1. Respondent owns the Property located at 1770 Mayport Road, Atlantic Beach, Florida. ("The
Property").
2. Notice of the hearing was sent certified mail on November 22, 2022, for the January 19, 2023,
Code Enforcement hearing.
3. The Respondent was cited for violation of City of Atlantic Beach Code, Section 17-61 Signage
changed on building without permit application to the City of Atlantic Beach.
4. The City of Atlantic Beach provided evidence that the signage on the Property was changed
without a permit. The business is now a Self-Storage facility. The business has resubmitted their
permit and the City of Atlantic Beach stated they have been approved and is now in compliance.
CONCLUSIONS OF LAW
5. The City of Atlantic Beach provided proper notice to the Respondent. The Respondent was in
violation for changing a sign without a permit. A revised permit application was received by the City
of Atlantic Beach and was approved. The City of Atlantic Beach did not request a fine be imposed.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority
granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach,
Florida it is Ordered:
A. The Respondent is now in compliance and no fine is assessed.
