Ordinance No. 5-85-15 v ORDINANCE NO. 5-85-15 AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER 2, ARTICLE VII, TO CREATE DIVISION 4, AUTHORIZING SERVICE CHARGES AND USER FEES; AMENDING CHAPTER 22, ARTICLE II SECTION 22-22 AND CHAPTER 2, ARTICLE III , DIVISION 7, SECTION 22-174 TO CONFORM WITH SAID AUTHORIZED SERVICE CHARGES AND USER FEES; PROVIDING AN EFFECTIVE DATE BE IT ORDAINED by the City Commission of the City of Atlantic Beach, Florida: Section 1. Chapter 2, Article VII is hereby amended to create Division 4 which shall read as follows: CHAPTER 2 ARTICLE VII FINANCE Division 4 Section 2-367. Service and User Charges Authorized The city of Atlantic Beach hereby authorizes the establishment of service charges and user fees for services provided by the city not otherwise paid for by advalorem taxes and as set and approved from time to time by the City Commission. Section 2-368. Service Charges, Approved In accordance with the provisions of Section 2-367 herein, the following fees and charges are approved: Water late charge (After 30 days) $ 5.00 Water delinquent charge (Cut on/Cut off) 15.00 Application for re-zoning 100.00 On approval of zoning change, an additional 150.00 Application for exception 75.00 Application for variance 50.00 City Clerk lien letter 3.00 Copy machine (per copy) .10 Backhoe (Including travel time) 35.00 per hour Minimum four hours portal to portal Labor Actual cost plus 30% fringes Mud Hog 15.00 per hour Trucks, each (Including travel time) 10.00 per hour Tractor (Including travel time) 25.00 per hour Bush Hog 15.00 per hour Materials Cost plus 10% for handling Section 2. Chapter 22, Article II, Section 22-22 and Article III, Division 7, Section 22-174 are hereby amended to read as follows: CHAPTER 22 ARTICLE 2 WATER WORKS SYSTEM Section 22-22. Fee to Establish Service After Cut-off If water service is turned off, either because of delinquency or upon the request of the consumer, for any purpose, a cut-on fee of teR fifteen dollars 410700} ($15.00) shall be charged and paid when water is turned on. A deliRqueRt late fee of five dollars ($5.00) will be charged if an account is not paid within thirty (30) days of the billing period. ARTICLE 3 WASTEWATER SYSTEM DIVISION 7 SEWER USER CLASSIFICATION RATES AND CHARGES Section 22-174. Delinquent Bills If any bill for monthly sewer, water or garbage service shall remain due and unpaid on and after the thirtieth day from the billing date, dated on the bill , a penalty of five dollars ($5.00) shall be imposed and added to the bill. The City shall mail at that time a deliRqueRt late notice to the user stating that if the bill remains unpaid for a period of ten (10) additional days, then the City shall discontinue the service. If the bill remains unpaid for a period of ten (10) additional days, then all services shall be discontinued and shall not be reconnected until all past due charges have been fully paid together with a turn-off and turn-on charge of teR fifteen dollars 0l0:08} ($15.00) . If, after discontinuation of services, the bill remains unpaid for an additional thirty (30) days, the City shall acquire a lien on the property being serviced which may be foreclosed within thirty (30) days by the City unless the bill and the penalties thereon are paid and the lien satisfied. Section 3. This Ordinance shall take effect as provided by law.
