Ordinance No. 75-22-27Sit I►`l:��L�7 �► 1 AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, AMENDING CHAPTER 19, STREETS, SIDEWALKS AND OTHER PUBLIC PLACES, ARTICLE I, GENERAL PROVISIONS, SECTION 19-6, TRAFFIC CALMING DEVICES; PROVIDING FOR CONFLICT, FOR SEVERABILITY, AND FOR AN EFFECTIVE DATE. WHEREAS, the City Commission recognizes the need to modify the traffic calming process to align with the adoption of the Complete Streets Policy. WHEREAS, the City Commission finds that the existing code provisions in Section 19-6 which require traffic calming devices to be reviewed by the police department should be amended to require City Manager review in order to align with the procedures adopted in Resolution No. 21-61 (Complete Streets Policy). WHEREAS, broadening Section 19-6 to include Complete Streets improvements as well as traffic calming devices reflects the goals of Commission to create a comprehensive, integrated transportation network with infrastructure and design that allow safe and convenient travel along and across streets for all users, including without limitation, pedestrians, bicyclists, persons with disabilities, motorists, movers of commercial goods, users and operators of public transportation, seniors, children, youth, and families; and WHEREAS, this revision will create a formal process to implement the Complete Streets Policy that will improve public health and safety by reducing the risk of injuries and fatalities from traffic collisions for users of all modes of transportation; and WHEREAS, this tool is available to help evaluate streets so that they are designed with the safety and convenience of pedestrians and bicyclists in mind and to increase the number of people walking and bicycling; and WHEREAS, a balanced transportation system that includes the Complete Streets Policy is conducive to streets that are lively with people walking and bicycling to everyday destinations, such as schools, shops, restaurants, businesses, parks, transit, and jobs, which in turn enhances neighborhood economic vitality and livability; and Ordinance No. 75-22-27 Page 1 of 3 WHEREAS, encouraging people to walk, bicycle, and use public transit saves energy resources, reduces air pollution, and reduces emissions of global warming gases. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION ON BEHALF OF THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA that: SECTION 1. Regulation Amended. Section 19-6, Traffic calming devices, of the Code of Ordinances of the City of Atlantic Beach, Florida is hereby amended as follows: Sec. 19-6. - T..affie alming .nevi ,,s Complete Streets Improvements and I 1 illll Traffic Calming Devices. SECTION 2. Conflict. All ordinances, resolutions, official determinations or parts thereof previously adopted or entered by the City or any of its officials and in conflict with this Ordinance are repealed to the extent inconsistent herewith. SECTION 3. Severabilitv. If a court of competent jurisdiction at any time finds any provision of this Ordinance to be unlawful, illegal, or unenforceable, the offending provision shall be deemed severable and removed from the remaining provisions of this Ordinance which shall remain in full force and effect. SECTION 4. Effective Date. This Ordinance shall take effect upon final reading and approval. PASSED by the City Commission on first reading this day of , 2022.
