Respondent owns the property located at 346 Sargo Road, Atlantic Beach, Florida. ("The Property"). 2. Notice of the hearing was sent certified mail on June 13, 2022, and delivered June 15, 2022 for the July 7, 2022, Code Enforcement hearing. The Respondent did not appear, but has been in contact with the City of Atlantic Beach and made application for a fence permit. 3. The Respondent was cited for violation of City of Atlantic Beach Code 24-157 for failure to obtain a permit for a new or replacement fence or wall. 4. The City of Atlantic Beach provided evidence that the Respondent did make an application for a fence permit after receipt of the notice of violation and Special Magistrate Hearing. The City of Atlantic Beach stated that the Respondent has submitted a permit application and also has other pending violations not associated with this fence issue. The City of Atlantic Beach requested the Respondent be found in violation, however no fine be assessed at this time. CONCLUSIONS OF LAW 5. The City of Atlantic Beach provided proper notice to the Respondent. The Respondent was in violation. However, has submitted a fence application to attempt to come into full compliance. ORDER Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is Ordered:, A.
