May 1— May 7, 2022
WHEREAS, the Office of the Municipal Clerk, a time-honored and vital part of local
government exists throughout the world; and
WHEREAS, the Office of the Municipal Clerk is the oldest among public servant; and
WHEREAS, the Office of the Municipal Clerk provides the professional link between the
citizens, the local governing bodies and agencies of government at other levels; and
WHEREAS, Municipal Clerks have pledged to be ever -mindful of their neutrality and
impartiality, rendering equal service to all; and
WHEREAS, the Municipal Clerk serves as the information center on functions of local
government and community; and
WHEREAS, Municipal Clerks continually strive to improve the administration of the
affairs of the Office of the Municipal Clerk through participation in education programs,
seminars, workshops and the annual meetings of their state, province, county and international
professional organizations; and
WHEREAS, it is most appropriate that we recognize the accomplishments of the Office of
the Municipal Clerk.

the week of May 1 through May 7, 2022, as Municipal Clerks Week, and further extend

Mayor's Monarch Pledge Day
WHEREAS, the monarch butterfly is an iconic American species whose multigenerational
migration and metamorphosis from caterpillar to butterfly has captured the imagination of millions of
Americans; and
WHEREAS, 20 years ago, more than one bill ion Eastern monarch butterflies migrated to Mexico,
but in the winter of 2014, only 60 million made the trip; and
WHEREAS, cities, towns and counties have a critical role to play to help save the monarch
butterfly and the City of Atlantic Beach can play a leadership role by planting native plants and milkweed
that support this spectacular iconic migration; and
WHEREAS, every citizen of Atlantic Beach can make a difference for the monarch by planting
native milkweed and nectar plants to provide habitat for the monarch and pollinators in locations where
people live, work, learn, play and worship; and
WHEREAS, on behalf of the citizens of Atlantic Beach who have already joined me in creating
healthy habitat for these magnificent butterflies, I am honored to sign the National Wildlife Federation's
Mayor's Monarch Pledge; and I encourage other local government officials across our great nation to take a
stand with me so that the monarch butterfly will once again flourish across the continent.
NOW, THEREFORE, I, Ellen Glasser, Mayor of the City of Atlantic Beach, Florida, do hereby

AGENDA ITEM: 90 -Day Calendar for the Mayor and Commission

TODAY'S DATE: April 11, 2022
MEETING DATE: April 25, 2022
BACKGROUND: The 90 -day calendar is included on the agenda for the purpose of setting
meeting dates and determining the location, time and whether to
videotape special meetings and workshops.
The rolling 90 -day calendar will be revised after receiving input from
City staff and the Commission, and will be included in each agenda for
consideration.
Notes:
• Annual Board and Committee Member Appreciation Reception will be
held on Thursday, May 26 from 6:30 to 8 pm at the Adele Grage Center.
• A Town Hall Meeting is scheduled for Saturday, July 16 from 10 am
to Noon at the Adele Grage Center.
BUDGET: None

Re: Johnston island—Public Purpose Lease
Dear Ms. Bassett:
Thank you for your information regarding Johnston Island, located at Atlantic Boulevard and the Atlantic
Intracoastal Waterway within the City of Atlantic Beach. The City of Atlantic Beach is interested in
exploring the potential for a public purpose lease from the Department to allow for public access to the
island should a temporary surplus declaration regarding the island be made by the Department.
This area has historically been popular for activities such as fishing and picnicking. However, the island
itself has not been open to the public. The City offered to purchase Johnston Island from the previous
owner In 2019 for development of a park, but our offer of the appraised value of the Island was
rejected. The recent purchase of the island by FOOT provides an excellent opportunity to again explore
public access to the island.
We understand the limitations posed by the 3 ton load limit on the access bridge as well as the
possibility of a major weather event further limiting vehicular access to the island. Given those
limitations, the City would still like to discuss with the Department a public purpose lease allowing for
public access to the island along with minor improvements such as more formalized parking, picnic
shelters, etc.

Re: Continued Maintenance of Pay Scale
With the passage of Resolution 22-28, the pay scales are now up to date. In order for them to remain up to
date and competitive, the City needs to adopt a policy/procedure where the pay scale will be adjusted on
an annual basis.
The past few years, the Commission has granted a 3% increase to employees during the annual budget
process. Historically, the pay scale was increased each year by 1% and employees received a percentage
of the mid -point of the specific pay grade. In my opinion, with the current environment, I don't think
increasing the pay scale by 1% each year will sustain the competitiveness of the City's wages. Adjusting
employees' pay by a percentage of their pay grade mid -point can be cumbersome to administer.
My recommendation would be to adopt a mechanism to adjust the pay scales, and adjust employee wages
by the same percentage. As mentioned in previous memos during the pay adjustment journey, the
Commissioners' pay increases are linked to the Consumer Price Index (CPI). I would suggest utilizing the
CPI to adjust the pay scale annually. Additionally, I would suggest adopting a "not to exceed" percentage
to protect the taxpayer dollars should the CPI be very high. In short, the policy statement could read that
"the City will adjust the pay scale and employee wages by the CPI for the month of May or 3% whichever
is less".

As illustrated in the table above, the years 2019 and 2020 the CPI would have been utilized since the CPI
was lower than the percentage, but In 2021 the percentage would be been utilized to increase the pay scale
and employee wages because the CPI was higher than the percentage.

The City Commission has recognized the need to increase the City's
ability to recruit and retain employees.
On April 11, 2022, the Commission unanimously agreed to increase the
City's pay scale by 9%, in an attempt to both recruit qualified applicants
and retain current employees.
The Commission has initially approved a budget amendment to give all
employees not on a step plan a 12% salary adjustment.
The City has a policy prohibiting employees from going over the
maximum of their pay grade.
This results in 9 employees not receiving the entire 12% salary
adjustment,
Sufficient funds are included within the current budget amendment
being considered.
Approve an exemption to the City policy, allowing those otherwise
eligible to receive the entire 12% salary adjustment, even though it
puts them over the maximum of their pay grade.

RESOLUTION NO. 22-29
A RESOLUTION OF THE CITY OF ATLANTIC BEACH EXEMPTING
EMPLOYEES FROM THE POLICY PROHIBITING SALARY OVER THE
PAY GRADE MAXIMUM, TO ENSURE THAT THOSE OTHERWISE
ELIGIBLE WILL RECEIVE THE ENTIRE 12% SALARY ADJUSTMENT.
WHEREAS, on March 28, 2022, the Commission recognized the need to take steps to
better position the City to recruit and retain employees; and
WHEREAS, on Aril 11, 2022, the Commission unanimously approved an increase to the
City's pay scale by 9%;
WHEREAS, on April 11, 2022, the Commission approved the first reading of a budget
amendment to give all employees not on a step plan a 12% salary adjustment;
WHEREAS, the City has a policy that no employee may go over the salary maximum for
their pay grade;
NOW THEREFORE, be it resolved by the City Commission of the City of Atlantic Beach
as follows:
SECTION 1. The City Commission hereby exempts those employees who would
otherwise not receive the entire 12% salary adjustment from the City from the maxed out policy.
SECTION 2. This Resolution shall take effect immediately upon its passage and adoption.

This proposed ordinance will accomplish a few budget adjustments related
to the proposed increase in employee wages and related payroll taxes,
provide additional funds for the City Attorney and correct errors from a
previous budget amendment.
Emtalovee Waves and Payroll Taxes
During the past few months the City Commission has contemplated the
need to adjust the City's pay scale the impact adjusting the pay scale
would have on current employees. At the Commission meeting held on
March 28, 2022, staff was given direction to adjust the pay scale by 9%
and adjust current employees' wages by 12%. These wage adjustments
will be effective as of April 1, 2022. The cost of the wage adjustment and
corresponding payroll taxes will be covered by the use of funds from the
American Rescue Plan Act.
Leval Counsel — Professional Services
Explanation for the need for $40,000 additional provided by the City
Attorney is as follows: In regards to the legal services adjustment, this is
the first time a mid -year adjustment has been necessary since the 2015-
2016 FY. This increase is the result primarily of two litigation matters ---a
tree code case, which is now on appeal in the Circuit Court, and an ADA

dog leash case which is in County Court. While there have been several
other unexpected legal projects this year, most of the increase is the result
of the tree code case. Both cases of course were unforeseen at the time the
budget was developed and approved. Currently, most of the work for the
ADA dog leash case is now completed (the trial has been postponed twice
by the court, neither of which has been at the request of the City and a new
trial date will be set on April 6th by the court) and the City's appeal brief
in the tree code case will be due in early June. The City Attorney and the
HR/Risk Management Director have requested our insurance carrier to
cover both cases, but to date, the carrier has not accepted coverage for
either case. While it cannot be guaranteed, the City Attorney anticipates
that the increase will be adequate through the end of this FY barring any
further unexpected turns in the cases or new matters.
Budeet Amendment Corrections
There are times when other governmental or enterprise funds provide
funds to others such as a capital project fund. Typically, the budget
amendment would show the funds being appropriated from one fund as an
expenditure (transfer out) and then received by the other fund as a revenue
(transfer in). In the most recent budget amendment, it shows the Capital
Projects fund receiving a transfer in from the Half Cent Sales Tax (Better
Jax) Fund and the American Rescue Plan Act Fund, but it does not show
the appropriation of the funds in either fund.
This budget amendment creates a net increase in the General Fund of
$40,000; a net increase in the Half Cent Sales Tax Fund of $167,800 and a
net increase of $629,406 in the American Rescue Plan Act Fund.

WHEREAS, the City Charter of the City of Atlantic Beach requires that the City Commission
approve all budgetary increases and transfers at the fund level, and
WHEREAS, the nature of budgetary systems and those day-to-day decisions affecting such
budgetary systems require adjustments from time -to -time, and
WHEREAS, the City is amending the Operating Budget to add net funds totaling $40,000 in the
General Fund. The City has amended its pay scale and desires to increase current wages in an effort to
retain current employees. The City has incurred additional litigation fees unforeseen during the preparation
of the annual budget, it is estimated that an additional $40,000 needs to be appropriated to cover the increase
in costs; and
WHEREAS, the City is amending the Half Cent Sales Tax (Better Jax) Fund in the amount of
$167,800 to offset the transfer to Capital Projects Fund outlined in the previous budget amendment; and
WHEREAS, the City is amending the American Rescue Plan Act Fund to appropriate $342,406 to
transfer to the General, Water, Sewer, Sanitation, Building and Stormwater funds to cover the increase in
employee wages and payroll taxes, and $287,000 to transfer to the Capital Projects Fund to correct an error
from the prior budget amendment; and
WHEREAS, the City is amending the Operating Budget of the Water Utility Fund to add net funds
totaling $0 for additional personnel expenses due to the increase in employees' wages and payroll taxes;
and
WHEREAS, the City is amending the Operating Budget of the Sewer Utility Fund to add net funds
totaling $0 for additional personnel expenses due to the increase in employees' wages and payroll taxes;
and
WHEREAS, the City is amending the Operating Budget of the Sanitation Fund to add net funds
totaling $0 for additional personnel expenses due to the increase in employees' wages and payroll taxes;
and
WHEREAS, the City is amending the Operating Budget of the Building Code Enforcement Fund
to add net funds totaling $0 for additional personnel expenses due to the increase in employees' wages and
payroll taxes; and
WHEREAS, the City is amending the Operating Budget of the Stormwater Utility Fund to add net
funds totaling $0 for additional personnel expenses due to the increase in employees' wages and payroll

the rezoning to come into compliance with the current used (apartments/multi-fancily) and the Future
Land Use Map (FLUM) designation.

The subject property was developed as a 32
unit apartment complex in 1975. This
property is located on the east side of
Sailfish Drive approximately 400 feet north
of Atlantic Blvd. and is 1.89 acres in size.
The property is comprised of ten (10)
different platted lots. Seven (7) are within
the RS -2 zoning district, one (1) is located in
the RS -1 zoning district, one (1) is within
the RG -M zoning district, and one (1) parcel
is zoned CG, As a result, the property is
considered "legally non -conforming" since
the only zoning district that allows multi-
family development with three (3) or more
units is RG -M. Legal non -conforming uses,
such as this, are allowed to continue
("grandfathered") as is, however they may
not be relocated or expanded.
The applicant has recently purchased the property and is in
the process of renovating the apartment buildings, The city
communicated to the applicant that the site is non -conforming
due to the number of residential units. While the property can
continue to be used as is, any potential additions (including
accessory structures) would not be allowed and would require
a rezoning. The applicant has expressed the desire to add
some outdoor amenities (patio area with grills) however, due

to its non -conforming statutes this is not possible unless the property is rezoned to RG -M.
The applicant was approved for a FLUM
amendment in 2021 to change the density
designation to Residential High (RH).
This property also had various land -use
designations that did not match the
current densities. This permits a total of
37 units on the site (1.89 acres X 20 units
per acre). The approved FLUM
amendment in conjunction with a zoning
map amendment to RG -M would make
the existing number of residential units
(32) and residential use conforming.
ANALYSIS
Per Section 24-62(c)(2) of the Land
Development Code, the Community
Development Board shall "indicate the
relationship of the proposed rezoning to
the Comprehensive Plan for the City and IM11 EMI 1 I 11 Atlantic Blvd.
provide a finding that the requested
change in zoning is consistent with the
Comprehensive Plan". The subject property request to change
the entire property to Residential, General, Multi -Family
zoning district matches the appropriate FLUM designation of

support of this Ordinance, and the City Commission finds as follows:
a. This change in zoning district classification has been fully considered after public hearings
with legal notice duly published as required by law and has met the procedural requirements
as set forth in Sections 24-51, 24-62 and the Land Development Regulations.
b. The proposed rezoning to Residential, General, Multi -Family (RG -M) is consistent with the
Future Land Use Map Residential High Density (RH) designation and the goals, policies
and objectives of the City's adopted Comprehensive Plan.
c. All development within lands subject to this rezoning to Residential, General, Multi -Family
(RG -M) and any future development shall be consistent with the zoning, subdivision, Land
Development Regulations and other applicable provisions of the Atlantic Beach Code of
Ordinances prior to issuance of local permits authorizing construction or site alteration.

d. The zoning district classification of Residential, General, Multi -Family (RG -M) is
consistent and compatible with the surrounding development and zoning districts in that
the adjoining properties to the east are designated Residential, General, Multi -Family
(RG -M) and Residential, General, (RS -2), properties to the north are Residential,
General, (RS -2) and Residential, General, (RS -1), properties to the west are Residential,
General, (RS -1) and Commercial General (CG), and properties to the south are
Commercial General (CG).
SECTION 2. Affected Properties. Pursuant to this change in zoning district designation procedure,
the zoning district classification of those certain lands within the City of Atlantic Beach, as more
particularly described in Exhibit A, attached hereto and made a part hereof, are hereby reclassified
as Residential, General, Multi -Family (RG -M) from Residential, Single -Family (RS -1),
Residential, Single -Family (RS -2), Residential, General, Multi -Family (RG -M), and Commercial
General (CG). This reclassification does not grant authority for any specific uses on said lands.
Any proposed use on said lands shall be reviewed and approved in accordance with the provisions
of Chapter 24, Land Development Regulations.
SECTION 3. Zonine Man Revised. The Director of Planning and Community Development is
hereby directed to revise the official Zoning Map of the City of Atlantic Beach to reflect the change
in zoning classification for those properties described in Exhibit A from Residential, Single -Family
(RS -1), Residential, Single -Family (RS -2), Residential, General, Multi -Family (RG -M), and
Commercial General (CG) to Residential, General, Multi -Family (RG -M).
SECTION 4. Conflict. All ordinances, resolutions, official determinations or parts thereof
previously adopted or entered by the City or any of its officials and in conflict with this Ordinance
are repealed to the extent inconsistent herewith.
SECTION 5. Severability. If a Court of competent jurisdiction at any time finds any provision of
this Ordinance to be unlawful, illegal, or unenforceable, the offending provision shall be deemed
severable and removed from the remaining provisions of this Ordinance which shall remain in full
force and intact.
SECTION 6. Effective Date. This ordinance shall take effect upon final reading and approval.

A. 2337 Seminole Road ZVAR22-0004 (Michael Dunlap)
Request for a variance from Section 24-68(b)(2) to reduce the required on-site storage
of stormwater at 2337 Seminole Road.
STAFF REPORT: Director Askew presented the information as explained in the staff
report. She also provided a PowerPoint presentation.
Mr. Haynie asked if the 250 square foot trigger is one of the new provisions added in
2019, Director Askew said it was added in 2019 prior to the major code update and is
directly related to reducing flooding and impervious surface area, Mr. Haynie asked
what strict compliance would look like. Director Askew said it is a mathematical
equation looking al the volume of stormwater generated on site and accommodating that
volume. She said different methods can be used depending how the storage is designed,
soils and other conditions. Ms. Simmons asked if the applicant would have to
accommodate for the existing project and the additional 900 square feet. Director Askew

said there are 2 triggers: 1) addition of 250 square feet and 2) the 50% market value of
the structure (not including the land), then you have to bring the entire site up to
compliance. Ms. Golombek asked if it was a flat 250 square feet or if there was a
schedule. Director Askew said it was based on the 250 square feet alone. Ms. Durden
read the section of the code pertaining to this and further clarified it for the Board.
APPLICANT COMMENT: Michael Dunlap of 1120 22nd Avenue in Jacksonville
Beach introduced himself as the architect for the project. He explained some of the
history of the house and spoke highly of its unique architecture. Mr. Dunlap believed
there was sufficient retention on the lot which is 1.3 acres. He explained that cost for
stornwater retention was a concern for the owner.
Ms. Simmons said she was concerned about the direction of the drainage after the new
construction. Mr. Dunlap said the existing conditions wouldn't change and there
currently isn't an issue with drainage. He confirmed for Chair Hansen that this would be
an addition to the first unit and not an additional 4th unit. Mr. Dunlap explained that the
addition would be a mix of living area and a covered area with 8' overhangs. Mr. Haynie
asked if there were any other options considered that would meet the code. Mr. Dunlap
said this is the 2nd option they have considered. Mr. Moyer asked what the drainage
designer thought of this option. Mr. Dunlap said they were hoping for a favorable
outcome of the variance request so they didn't bring the drainage designer.
PUBLIC COMMENT: Chair Hansen opened the floor to public comment. Ms. Durden
held the swearing in. Allen Wankat of 60 Seminole Landing Road introduced himself
as the neighbor to south. He said he currently experiences washout from the pool. Mr.
Wankat was concerned that the current swale would be covered up during construction.
Don Ford of 338 6th Street introduced himself as project manager for the applicant. He
spoke in favor of the project and said he would not allow any additional run-off to any
adjacent properties. Sarah Bohr introduced herself as the applicant. She spoke about the
excellent drainage that the property has had during the past 26 years.
BOARD DISCUSSION: Mr. Dunlap confirmed for the Board that there are 3 units.
Ms. Lanier asked whether the swale would be filled in during construction. Mr. Dunlap
said they have a permit to put in 50 cubic yards east of the new deck which would fill
1/3 of the swale in. Ms. Durden confirmed for Ms. Golombek that the property owner
can only ask for a retention exception one time and any future additions would have to
meet code. Ms. Lagner asked who calculates the retention and do they take right-of-
ways into consideration. Director Askew said Public Works does the calculations and it
is based on the boundaries of the property. She confirmed for Ms. Simmons that the
existing swale is on the property. Ms. Lanier disclosed that the owner of the property is
a friend of hers and she has been to the property. She agreed with Mr. Dunlap and she
is in support of this variance. Chair Hansen said he has also been inside the property.
He said that he is concerned about the run-off that the neighbor spoke of. Chair Hansen
said that since there is a way to prevent future run-off then it should be done. Mr. Moyer
asked if the variance was approved and then later there was an issue, could the City
mandate that the applicant fix it. Mr. Haynie said he just didn't see a grounds under which
the code shouldn't be complied with. Ms. Simmons suggested grounds #1 but Mr.
Haynie didn't think that had been proven. Ms. Durden added that if the variance is

approved the on-site slormwaler requirement would go away. Ms. Lawler said there is
a code for a reason and there's not an engineering study and one wasn't presented that
would cause her to approve the variance. Ms. Lanier asked if the architect had additional
details.
Mr. Dunlap said the swale is in the center of the lot and wouldn't be able to overflow to
impact anyone. He said the water comes off the roof with even distribution. Mr. Dunlap
said the site is sand and it soaks up water very effectively creating a retention plan
naturally. Ms. Bohr said that the building that she is constructing is about 75 feet from
the neighbor that expressed concern about run-off.

BOARD DISCUSSION: Chair Hansen asked if this was the next step to what the Board
has already approved in order to bring this property into compliance with the Future
Land Use Map and Zoning District. He added that the owner is doing a great job of
fixing the property up. Mr. Haynie asked if it stayed the way it is then would that mean
that the owner couldn't expand or doing anything to the structure. Director Askew said
that was correct and would bring the zoning into compliance with the Future Land Use
Map designation and make the existing use (multi -family) conforming.
