Ordinance No. 15-71-3 vORDINANCE NO. 15-71-3 AN ORDINANCE ORDERING AND PROVIDING FOR THE HOLDING OF A BOND ELECTION OF THE FREEHOLDER ELECTORS AND A BOND ELECTION OF THE QUALIFIED ELECTORS IN THE CITY OF ATLANTIC BEACH, FLORIDA, ON THE QUESTION OF THE ISSUANCE OF NOT EXCEEDING $500,000.00 GENERAL OBLIGATION SEWER BONDS OF THE CITY FOR VARIOUS MUNICIFAL PURPOSES. SUCH BOND ELECTIONS TO BE HELD ON April 20th , 1971. BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA, that: SECTION 1. A bond election of the qualified electors re- siding in the City of Atlantic Beach, Florida, who are owners of freeholds therein not wholly exempt from taxation (herein sometimes called "freeholders"), is hereby called to be held on the 20th day of April , 1971, at the time and places hereinafter set forth, to determine whether or not the issuance of general obligation bonds not exceeding $500,000.00 shall be approved by such qualified elec- tors who are freeholders to finance the cost of acquiring and con- structing extensions, additions and improvements to the sewer system owned and operated by the City, more particularly described in the engineers report of Walter J. Parks, Jr., Consulting Engineers on file with the City Clerk. Such purpose described above shall also include any other purposes appurtenant and incidental thereto. The bonds proposed to be issued shall be payable from ad valorem taxes levied without limitation as to rate or amount on all taxable property in the City; none of such bonds shall be issued for a longer term than thirty (30) years and no bond shall bear interest at a rate or rates exceeding the maximum legal rate of interest at the time of the sale of the bonds. • SECTION 2. A separate bond election of the qualified electors who are not freeholders residing in the City of Atlantic 0 Beach is hereby called to be held on the 20th day of April 1971, at the time and places hereinafter set forth, to determine whethE!r or not the issuance of general obligation bonds not exceed- ing $500,000.00 shall be approved by such qualified electors to finance the cost of the purpose described in Section 1 hereof. SECTION 3. The bond elections provided for in Section 1 and in Section 2 shall be held at the same time and places but shall be held and conducted as separate bond elections. Only qualified freeholder electors shall be permitted to vote in the bond election provided for in Section 1 hereof, and only qualified electors who are not freeholders shall be permitted to vote in the bond election provided for in Section 2 hereof. All qualified freeholder electors shall submit proof by affidavit made before the inspectors that they are freeholders who are qualified electors residing in the City. Qualified freeholder electors who vote by absentee ballot shall submit proof by affidavit made before a notary public or other person authorized to take oaths under Florida law. The polls will be open at the voting places for both bond elections from seven o'clock A.M. until seven o'clock P.M. on the same day. SECTION 4. The places of voting and the Inspectors and Clerks for the polling places for the bond elections, who are hereby appointed for such bond elections, are as follows: POLLING PLACES CLERKS INSPECTORS City Hall, Atlantic Beach, Mrs. Zoe Moore Mrs. Eloise Claiborne Florida Mrs. Mollie A.Griffin,Mrs.Cynthia Whittlesey Mrs. Peggy Goodling f Alternates: Mrs. Enid Nelson Mrs. Harriet Faulkner -2- SECTION 5. Voting machines shall be used at both bond elections and the form of ballot to be used in both bond elections shall be in substantially the following form: OFFICIAL BALLOT CITY OF ATLANTIC BEACH, FLORIDA BOND ELECTION - April 20th , 1971 Shall the City of Atlantic Beach issue not exceed- ing $500,000.00 principal amount of general obliga- tion sewer bonds of the City bearing interest at not exceeding the maximum legal rate of interest at the time of the sale of the bonds, maturing not later than thirty (30) years from the date of issuance thereof, payable from ad valorem taxes levied on all taxable property in the City with- out limit as to rate or amount for the purpose of financing the cost of acquiring and constructing additions, extensions and improvements to the sewer system of the City as more specifically described and provided in Ordinance No�5-71-3 of the Commis- sion of the City adopted on the 20th day of February , 1971? . Instructions to Voters: Indicate by pulling down lever over "FOR APPROVAL OF BONDS" if you favor the issuance of said bonds. Indicate by pulling down lever over "AGAINST APPROVAL OF BONDS" if you do not favor the issuance of said bonds. SECTION 6. Paper ballots shall be used at such elections for absentee voting. The form of ballot to be used in the elections for absentee voters shall be in substantially the form provided in Section 5 above, except .that Instructions to Voters shall be as follows: 0 Instructions to Voters: If you are in favor of the issuance of said bonds, place an "x" in the space to the left of the words "FOR APPROVAL OF BONDS". If you are not in favor of the issuance of said bonds, place an "x" in the space to the left of the words "AGAINST APPROVAL OF BONDS". SECTION 7. The City Clerk is hereby authorized and directed to have printed on plain white paper a sufficient number of the aforesaid ballots and to deliver them to the appropriate officials for absentee voters and shall also have printed sample ballots and shall deliver them to the Inspectors and Clerks on or before the date and time for the opening of the polls for such bond elections for the voting places at which voting machines are to be used, and is further authorized and directed to make appro- priate arrangements with the proper officials for the use of such voting machines at the polling places specified herein and to have printed on plain white paper and delivered in accordance with law the official ballots for use in such voting machines. SECTION 8. For the purpose of determining the result of the bond elections, the votes cast in the freeholders bond election shall be added to the votes cast in the separate non -freeholders bond election of qualified electors, and the bonds shall be approved if a majority of the total votes cast in the freeholders bond elec- tion and the separate non -freeholders bond election of qualified electors shall be in favor of the issuance of the bonds. SECTION 9. This ordinance shall be published in full as a part of the notice of such bond elections, together with an appro- priate caption in such form as the City Clerk shall determine, in #hR THE LEADER a newspaper published and of general circulation in the City of Atlantic Beach, once each week for four (4) consecutive weeks, the first publication to be not less than thirty (30) days prior to the date of such bond elections. SECTION 10. In the event that any word, phrase, clause, f, sentence or paragraph hereof shall be held invalid by any court of competent jurisdiction, such holding shall not affect any other word, clause, phrase, sentence or paragraph hereof. -4- v SECTION 11. All ordinances in conflict or inconsistent herewith hereby are repealed, insofar as there is conflict or in- consistency. SECTION 12. This ordinance shall take effect upon its becoming a law.
