AN ORDINANCE REQUIRING THAT UPON THE ISSUANCE
OF ANY PERMIT FOR CONSTRUCTION OR IMPROVEMENT
OF PROPERTY IN THE CITY OF ATLANTIC BEACH,
FLORIDA, THERE SHALL BE DEPOSITED WITH THE CITY
THE SUM OF $100.00 TO SECURE AND INDEMNIFY THE
CITY AGAINST DAMAGE TO PUBLIC PROPERTY ARISING
OUT OF THE WORK DONE IN OR ABOUT SAID CONSTRUCTION
OR IMPROVEMENT.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, DUVAL
COUNTY, FLORIDA, THAT
Section 1. All persons, firms or corporations here after
applying for any permit for the construction upon or improvement
of any land or premises in the City of Atlantic Beach, Florida,
which in the jue.?gement of the Building Official might result in
any damage to public property, shall before such permit shall be
granted, deposit with the City Clerk the sum of one hundred ($100.00)
dollars cash to be held by the City as security for and to indemnify
the City against any damage which may be done by anyone engaged in
41/1 or contributing to the work involved in such construction or
improvement
In the event a contractor anticipates the construction upon or
improvement of several different lots or plots at the same time
he may provide, in lieu of the above required deposit, a surety
bond to indemnify the City against any damage which may be done
by anyone engaged in or contributing to the work involved in such
construction or improvement, in the amount of one hundred ($100.00)
dollars for each improvement in progress.
All persons, firms or corporations hereafter engaged in the con-
struction or improvement of any land within the City of Atlantic
Beach for which no building permit is required, such as lot clearing,
grading, removing trees, excavation, dirt moving, paving, etc. , shall
before commencing such work notify the Building Official, if in the
judgement of the Building Official such work might cause any damage
to City property, such person, firm or corporation shall deposit
with the City Clerk the sum of one hundred ($100.00) dollars cash
to be held by the City as security for and to indemnify the City
against any damage which may be done by anyone engaged in or
contributing to the work involved in such construction or improvement.
40110 Section 2. Upon notification of the completion of any con-
struction or improvement covered by Section 1 above it shall be the
duty of the Building Official to ascert-.in whether any damage or
injury has been done to any sidewalk or other City property by
anyone engaged in or contributing to said construction or improve-
ment, and if any such damage or injury is found to have been done
or occasioned, the City shall, as soon as practicable, cause the
said City property to be repaired and restored and the cost thereof
shall be paid out of said deposit required by Section 1 above,
insofar as the same may reach, all persons liable thereunder to be
and remain liable therefor to the City for any excess in the costs
of said repair or restoration. If no damage is found to have been
caused or occasioned to said City property, or in the event the cost
of repair and restoration is less than the amount of said deposit,
then the said deposit, or such part thereof as is not required for
said repair or restoration, as the case may be, shall be refunded
to said depositor.
Section 3. Any person, firm or corporation violating any
provision of this ordinance, shall upon conviction thereof be
punished by fine of not more than gr/60, 0 0 or
imprisonment of not more than days, or by both such
fine and imprisonment, in the discretion of the Court.
Section 4. Ordinance No. 192 of the Town of Atlantic Beach,
Florida and all ordinances or parts of Ordinances in conflict
41/1 herewith are hereby repealed.
Section 5. This ordinance shall become effective immediately
upon its final passage.
