410111 AN ORDINANCE AMENDING ORDINANCE NO. 25-75-11,
THE SAME BEING THE ORDINANCE PERTAINING TO
REQUIREMENTS FOR COMPLIANCE WITH THE NATIONAL
FLOOD INSURANCE ACT OF 1968.
WHEREAS, the City of Atlantic Beach did adopt Ordinance No. 25-75-11
on June 23, 1975, and
WHEREAS, the Federal Emergency Management Agency has reviewed said
ordinance and required amendments to the ordinance, and
WHEREAS, a Flood Plain Management Ordinance is required to enable
citizens to participate in the National Flood Insurance Program,
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC
BEACH, FLORIDA, That Ordinance No. 25-75-11 be amended as follows:
Section 1. Section 2(a) be amended to read:
"Coastal High Flood Hazard District", (hereinafter
referred to -as HFD District), means that portion
of the City of Atlantic Beach, Florida, subject to
flooding or erosion from abnormally high tidal
waters and wave velocities resulting from severe

storms or hurricanes. Said HFD District shall be
comprised of those areas designated "Zone V" as
provided in the Flood Insurance Rate Study dated
October 18, 1982, and the Flood Insurance Rate Map,
City of Atlantic Beach, Florida, Duval County,
Community Panel No. 1200750001C dated April 18,
1983, as issued by the Federal Emergency Manage-
ment Agency, and as the same may, from tine to
time, be a::::ended.
Section 2. The first sentence in Section 2(d) be a: ended, in
part, to read:
"Floodproofing" means structural and nonstructual
additions, changes, or adjustments (other than
elevating) to non-residential structures and
utilities which reduce or eliminate flood damage
to water supply and sanitary sewage facilities,
structures and contents of buildings, and includes,
by way of illustration, not limitation, the follow-
ing measures:
Section 3. Section 3(d) be amended by adding:
(iv.) Base Flood Elevation data shall be pro-
d) vided for subdivision proposals and other
proposed developments which is greater than the
lesser of fifty lots or five acres.
Section 4. Section 4 (b) (ii) be amended by adding:

So that the lowest portion of the structural
members of the lowest floor (excluding the
pilings or columns) is elevated at or above
the Base Flood Elevation (BFE) . Compliance
with this provision shall be certified to by a
professional engineer or architect.
Section 5. That Section 5(b) be amended to read:
No new construction or substantial improvement of
any non-residential structure shall be permitted
in GFH Districts, and no building permit referred
to in Section 3 of this ordinance shall be issued
therefore unless said new construction or sub-
stantial improvement has the lowest floor (includ-
ing basement) elevated to or above the level of
the regulatory flood (100-year flood), or if the
lowest permitted floor level of such nonresidential
structure (including basement) is below the regu-
latory flood level then such nonresidential
structure together with attendent utility and
sanitary facilities shall be flood proofed up to
the level of the regulatory flood; provided that

the lowest floor level of such nonresidential
structure (including basement) shall be no more
than 3 feet below the regulatory flood level.
Section 6. That any reference to Federal Insurance Administration be
deleted and replaced by Federal Emergency Management Agency.
Section 7. This ordinance shall take effect immediately upon its
final passage.
