Ordinance No. 25-03-34 v ORDINANCE NO. 25-03-34 AN ORDINANCE AMENDING THE CODE OF ORDINANCE S OF THE CITY OF ATLANTIC BEACH, FLORIDA, AMENDING CERTAIN SECTIONS OF CHAPTER 8 FLOOD HAZARD AREAS, ARTICLE 1, IN GENERAL, AND ARTICLE III, FLOOD HAZARD REDUCTION STANDARDS, TO COMPLY WITH REQUIREMENTS OF THE NATIONAL FLOOD INSURANCE PROGRAM AND THE COMMUNITY RATING SYSTEM; PROVIDING AN EFFECTIVE DATE. BE IT ENACTED BY THE CITY COMMISSION ON BEHALF OF THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA: SECTION 1. Section 8-5 Definitions, "Structures", and Section 8-7 Basis for establishing the areas of special flood hazard, and Sec. 8-33, Standards for streams without established base flood elevations and/or floodways (a) and (b), of the Code of Ordinances of the City of Atlantic Beach, Florida, are hereby amended to read as follows: Chapter 8 FLOOD HAZARD DISTRICTS ARTICLE I. IN GENERAL • - - - . Section 8-5. Structures means a walled and roofed building that is principally above ground, a manufactured home, or a gas or liquid storage tank. Section 8-7. Basis for establishing the areas of special flood hazard. The areas of special flood hazard identified by the Federal Emergency Management Agency in its Flood Insurance Study/ Flood Insurance Rate Map, dated March 15, 1977 April 17, 1989, with accompanying maps and other supporting data, and any revision thereto, are adopted by reference and declared to be a part of this chapter. SECTION 2 . Chapter 8 , Flood Hazard Areas, Articles III , Section 8 • Sec. 8-33. Standards for streams without established base flood elevations and/or floodways. Located within the areas of special flood hazard established in section • 8-7, where small streams exist but where no base flood data have been provided or where no floodways have been provided, the following provisions apply: (a) • . • - . . , . .. _ - . .. . . . •. - - - . • '. . . . . • •. When base flood elevation data or floodway data have not been provided in accordance with Article 1, Section 8-7, then the local administrator shall obtain, review, and reasonably utilize any base flood elevation and floodway data available from a federal, state, or other source in order to administer the provisions of Article III. (b) • . . ., . •• . . --• - . section 8 22(k),In special flood hazard areas with base flood elevations (Zones AE) but without floodways, no encroachments, including fill material or structures, shall be permitted unless certification by a registered professional engineer is provided demonstrating that the cumulative effect of the proposed development, will not increase the water surface elevation of the base flood more than one foot at any point within the community. The engineering certification should be supported by technical data that conforms to standard hydraulic engineering principles. • SECTION 2. The Code of Ordinances of the City of Atlantic Beach, Florida, is hereby amended by adding a new definition under Section 8-5, and a new subsection(c) under Section 8-33, which shall read as follows: "Section 8-5. Definitions. Lowest Floor means the lowest floor of the area's lowest enclosed area (including basement) of a building. An unfinished or flood resistant enclosure, used solely for parking of vehicles, building access, or storage in an area other than a basement, is not considered a buildings lowest floor, provided that such enclosure is not built so as to render the structure in violation of the nonelevation design standards of this ordinance. Standards for streams without established base flood elevations and/or floodways. (c) In special flood hazard areas without base flood elevation and floodway data, new construction and substantial improvements of existing structures shall have the lowest floor of the lowest enclosed area(including basement) elevated no less than two (2) feet above the highest adjacent • grade at the building site. SECTION 3. This ordinance shall become effective October 1, 2003. PASSED by the City Commission on first reading this g qday of September, 2003.
