AN ORDINANCE OF THE CITY OF ATLANTIC BEACH
AMENDING THE FUTURE LAND USE MAP OF THE
CITY TO INCLUDE THE AREA INCORPORATED INTO
THE CITY OF ATLANTIC BEACH BY ANNEXATION;
TO ESTABLISH LAND USE DESIGNATIONS AND
BOUNDARY LINES FOR THAT AREA; TO PROVIDE
FOR SEVERABILITY; AND TO SET AN EFFECTIVE DATE:
WHEREAS, The City of Atlantic Beach has annexed the area west of the former
corporate limits out to the Intra Coastal Waterway, and
WHEREAS, It is necessary to expand the adopted Comprehensive Plan's Future Land
Use Map of the City to include the newly annexed areas, and
WHEREAS, The area annexed is primarily wetland marshes with some limited upland
property adjoining the Atlantic Boulevard Right-of-Way, and
WHEREAS, The adopted Comprehensive Plan of the City of Atlantic Beach contains
Land Use designations which are appropriate for the annexed areas,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF ATLANTIC BEACH, FLORIDA:
SECTION 1. The area of annexation shall be incorporated into the Future Land Use Map
of the adopted Comprehensive Plan of the City of Atlantic Beach with the designation as CON,
Wetlands/Conservation for all areas as shown on F.L.U.M. attachment "A".
SECTION 2. Attachment"A" shall be incorporated into and made apart of the Future
Land Use Map of the adopted Comprehensive Plan of the City of Atlantic Beach and subsequent
amendments thereto.
SECTION 3. Severability. If any section, sentence, clause, word, or phrase of this
Ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction, then
said holding shall in no way effect the validity of the remaining portions of this Ordinance.
SECTION 4. This Ordinance shall become effective immediately upon issuance of a final
order pursuant to Chapter 163.3189, Florida Statutes.
