ORDINANCE NO. 33-67-1
AN ORDINANCE CALLING FOR A SPECIAL REFERENDUM ELECTION
FOR THE APPROVAL OR DISAPPROVAL OF AN ACT AMENDING
HOUSE BILL 3029 LAWS OF FLORIDA, SPECIAL ACTS OF 1967,
BY THE QUALIFIED ELECTORS OF THE CITY OF ATLANTIC
BEACH, FLORIDA.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA:
SECTION I. A Special Referendum Election is hereby called to be held
at the City Hall of the City of Atlantic Beach, Florida on the 8th
day of August, 1967 for the approval or disapproval of an Act Amend-
ing House Bill 3029Laws of Florida, Special Acts of 1967 by the
qualified electors of the City of Atlantic Beach, Florida, being an act
entitled:
"AN ACT AMENDING HOUSE BILL 3029, LAWS OF FLORIDA,
REGULAR SESSION 1967, ENTITLED THE CHARTER OF THE CITY
OF JACKSONVILLE, CREATING A SINGLE CONSOLIDATED GOVERN-
MENT IN DUVAL COUNTY: PROVIDING THAT ARTICLE 2 OF SAID
CHARTER BE AMENDED TO PROVIDE FOR FIVE SEPARATE URBAN
SERVICES DISTRICTS TO BE COMPOSED OF THE FORMER CORPORATE
LIMITS OF THE FORMER MUNICIPALITIES OF THE CONSOLIDATED
GOVERNMENT: PROVIDING THAT A NEW ARTICLE 2A BE ADDED TO
SAID CHARTER TO PROVIDE SPECIAL PROVISIONS RELATING TO
THE SECOND, THIRD, FOURTH AND FIFTH URBAN SERVICES
DISTRICTS : PRESCRIBING FOR CONTINUATION OF THE BOARDS,
BODIES AND OFFICERS OF SUCH DISTRICTS , AND THEIR POWERS
AND DUTIES : PROVIDING NAMES FOR SUCH DISTRICTS : PROVID-
ING FOR CERTAIN EXCEPTIONS AND AMENDMENTS TO THE PROVISIONS
OF ARTICLES 5, 15, 16, 17, 18, 19, 20, 21 AND 22, PERTAIN-
ING TO SAID SECOND, THIRD, FOURTH AND FIFTH URBAN SERVICES
DISTRICTS : PROVIDING FOR A REFERENDUM BY SPECIAL ELECTION
FOR APPROVAL OF THIS ACT IN THE MUNICIPALITIES OF JACKSON-
VILLE BEACH, ATLANTIC BEACH, NEPTUNE BEACH AND THE TOWN
OF BALDWIN, BY A MAJORITY OF THE AGGREGATE TOTAL OF ALL
THOSE QUALIFIED ELECTORS VOTING IN ALL SUCH MUNICIPALITIES :
PROVIDING AN EFFECTIVE DATE. "
SECTION II . The City Clerk is hereby authorized and directed to
give notice of said election by publication thereof once each week
for 3 weeks, 3 publications being sufficient, commencing not later
than 15 days prior to said election in Jacksonville Journal a news-
paper published in the City of Jacksonville and having general circulatio
in the city of Atlantic Beach, which said notice shall be in substanti-
ally the following form:

ATLANTIC BEACH, FLORIDA ON AUGUST 8, 1967, ON THE QUESTION
OF APPROVAL OR DISAPPROVAL OF AN ACT AMENDING HOUSE BILL
3029, LAWS OF FLORIDA, SPECIAL ACTS OF 1967 :
"NOTICE IS HEREBY GIVEN THAT A SPECIAL REFERENDUM ELECTION
WILL BE HELD ON AUGUST 8, 1967 AT THE CITY HALL OF THE
CITY OF ATLANTIC BEACH, FLORIDA, FROM 7 :00 o'clock of the
FORENOON TO 7 :00 O'CLOCK OF THE AFTERNOON FOR THE APPROVAL
OR DISAPPROVAL OF AN ACT AMENDING HOUSE BILL 3029, LAWS OF
FLORIDA, SPECIAL ACTS OF 1967, BY THE QUALIFIED ELECTORS OF SAID
CITY: .
THE SPECIFIC QUESTION TO BE VOTED UPON IS :
"SHALL THE CITIES OF JACKSONVILLE BEACH, ATLANTIC BEACH,
NEPTUNE BEACH AND THE TOWN OF BALDWIN BECOME THE SECOND,
THIRD, FOURTH AND FIFTH URBAN SERVICES DISTRICTS AND RETAIN
THE SAME LOCAL GOVERNMENTAL STRUCTURE, BOARDS, BODIES,
OFFICERS AND LAWS OF THEIR RESPECTIVE FORMER MUNICIPALITIES
UNDER THE CONSOLIDATED GOVERNMENT OF THE CITY OF JACKSONVILLE
PURSUANT TO SECTION 9, ARTICLE VIII OF THE CONSTRUCTION OF
THE STATE OF FLORIDA IN THE EVENT SUCH CONSOLIDATED GOVERN-
MENT IS RATIFIED AND ESTABLISHED? "
COPY OF SAID SPECIAL ACTS IS NOW ON FILE FOR PUBLIC INSPEC-
TION IN THE OFFICE OF THE CITY CLERK AT THE CITY HALL OF
SAID CITY.
ALL QUALIFIED ELECTORS OF THE CITY OF ATLANTIC BEACH,
FLORIDA SHALL BE ENTITLEn TO VOTE AT SAID ELECTION.
SECTION III . COPY OF SAID Act amending House Bill 3029, Laws of
Florida, Special Acts of 1967, shall be available for public inspec-
tion on all days except Saturday and Sunday at the office of the
City Clerk in the City Hall during the hours of 9:00 A.M. and 5 :00
P. M. from the effective date of this Ordinance to and including
said August 8, 1967.

SECTION IV. The question to appear on the ballot in said City
for such referendum shall be as follows :
"SHALL THE CITIES OF JACKSONVILLE BEACH, ATLANTIC BEACH,
NEPTUNE BEACH AND THE TOWN OF BALDWIN BECOME THE SECOND,
THIRD, FOURTH AND FIFTH URBAN SERVICES DISTRICTS AND RETAIN
THE SAME LOCAL GOVERNMENTAL STRUCTURE, BOARDS, BODIES,
OFFICERS AND LAWS OF THEIR RESPECTIVE FORMER MUNICIPALITIES
UNDER THE CONSOLIDATED GOVERNMENT OF THE CITY OF JACKSONVILLE
PURSUANT TO SECTION 9, ARTICLE VIII OF THE CONSTITUTION OF
THE STATE OF FLORIDA IN THE EVENT SUCH CONSOLIDATED GOVERN-
MENT IS RATIFIED AND ESTABLISHED?
YES. NO. " .
SECTION V. The City Clerk shall have prepared and furnished all
necessary ballots and supplies and shall make all other prepara-
tions for said election. All expenses of said election shall be
paid out of the general fund of said City.
SECTION VI. The City Commission, at least six days before the date
of said election, shall appoint four inspectors and one clerk of
election, to hold said election. If any inspector or the Clerk
of Election so appointed shall fail to attend at the proper polling
place at the time for opening the polls on the day of the election,
the Inspector present shall fill the vacancy, or vacancies; and if
all the Inspectors be absent then those persons present qualified
to vote at said election shall fill the vacancies.
The Inspectors and Clerk of Election shall make out and sign
duplicate returns of said election and shall deliver one copy
thereof to the Mayor Commissioner of said City and the other to the
City Clerk, both of whom shall transmit such returns to the City
Commission at its next meeting thereafter. The City Commission
shall meet at the City Hall of said City at 8 :00 O'clock P.M. on
said August 8, 1967, or as soon thereafter as said returns of the
Inspectors and Clerk of Election shall have been delivered to said
Mayor Commissioner and City Clerk, and shall then and there canvass
and declare from said returns of the Inspectors and Clerk of Election
the results of said election.

The city Commissioners shall cause said results of said election
to be duly recorded in the minutes of said meeting and shall cause
the same to be duly certified to the Canvassing Board of Duval
County, Florida within two days after said election. Said elec-
tion shall in all other respects be conducted as nearly as may
be in compliance with the laws regulating the holding, return,
certifying and canvassing of general City elections.
SECTION VII . This Ordinance shall take effect immediately upon
being posted in full following final passage.
