AN ORDINANCE OF THE CITY OF ATLANTIC BEACH
AMENDING CHAPTER 2, ARTICLE II, BY ADDING SEC.
2-21 TO ESTABLISH THE PROCEDURES TO BE USED TO
FILL A COMMISSION SEAT WHICH IS BEING VACATED
BY A COMMISSIONER SUBMITTING A LETTER OF
RESIGNATION TO RUN FOR ANOTHER OFFICE, AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the City Commission of the City of Atlantic
Beach, Florida, as follows:
SECTION 1. The Code of Ordinances of the City of Atlantic
Beach, Florida, is hereby amended by adding a new section to be
numbered Sec. 2-21, which section shall read as follows:
"Sec. 2-21. Resignation From Office; Election Procedures
(1) A City Commissioner seeking to run for another
elected office shall submit a letter of resignation at
least thirty (30) days prior to the first day of
qualifying for the office he intends to seek. The
resignation must be effective no later than the earlier
of the following dates:
(a) The date the Commissioner would take his
new office, if elected; or
(b) The date the Commissioner's successor is
required to take office.
(2) The Commission seat shall be placed on the
ballot at the next election after the filing of the
letter of resignation. The candidate winning the
Commission seat shall take office on the effective date
of the assuming of offices following the election and
shall serve the remaining unexpired term of the resigning
Commissioner.
(3) This section shall not preclude the City
Commission from electing an eligible person to serve in
the interim as provided for in Section 12 of the City
Charter."
SECTION 2: The provisions adopted herein shall prevail over
any existing sections of the Atlantic Beach Code to the extent said
existing sections are contrary or inconsistent herewith.
SECTION 3: This Ordinance shall take effect immediately upon
its final passage and adoption.
PASSED by the City Commission on first reading this 8th day of
March, 1993.
PASSED by the City Commission on second and final reading this
22nd day of March, 1993. N
