ORDINANCE TO AMEND AND ADD TO ORDINANCE NO:45-58-1
(CHAPTER 10, CODE OF THE CITY OF ATLANTIC BEACH)
ENTITLED "LICENSES" , BY AMENDING CERTAIN SECTIONS
THEREIN TO CHANGE AND EFFECT A NEW LICENSE YEAR,
AND BY ADDING THERETO PROVISIONS TO PROVIDE FOR
LICENSING FOR THE PARTIAL YEAR OF JULY 1, 1972
THROUGH SEPTEMBER 30, 1972, AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in the recent three months a Florida Court of Compe-
tent Jurisdiction had ruled adversely as to the constitutionality
of a sister city' s Occupational License Ordinance, and
WHEREAS, the Florida Legislature during the waning hours of its
recent legislative session, enacted general legislation effecting
all municipal Occupational License Ordinances; (House Bill 4465,
amending Chapter 205, Florida Statutes) , which said act is self-
repealing on September 30, 1973, and
WHEREAS, said legislative act provides for a one-time license
year of October 1, 1972 through September 30, 1973, and
WHEREAS, the City of Atlantic Beach, Florida, has in the past
enjoyed a License Year of July 1, through June 30;
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLAN-
TIC BEACH, FLORIDA:
Section 1. Ordinance No: 45-58-1 is hereby amended to provide
that the Occupational License Tax Year shall be for the full
year October 1, 1972 through September 30, 1973 .
Section 2. The City Clerk, City of Atlantic Beach, shall
provide the issuance of a partial year license tax period for
the months of July, August and September 1972. The schedule of
the Occupational License Fees shall be one-quarter (1/4) of the
amounts set forth in Section 10.05, Code of the City of Atlantic
Beach, Florida, for the partial year license tax, and the full
schedule fee for the full license tax year. Said schedule of
Occupational License Fees is hereby re-adopted.
Section 3. Ordinance and parts of ordinances in conflict
herewith are hereby repealed.
Section 4. This Ordinance shall take effect immediately upon
its final passage.
