CALL TO ORDER:
Following the Pledge of Allegiance, Mayor Glasser called the meeting to order at 6:30 PM and
welcomed Quintero Davis. City Clerk Bartle called the roll.

1 APPROVAL OF MINUTES
1A. Approve minutes of the Special Called Meeting of the City Commission held on
October 18, 2021.
Mayor Glasser asked if there were any corrections or changes needed. There were no
corrections to the minutes. Mayor Glasser stated the minutes stand.
2 COURTESY OF FLOOR TO VISITORS
2A. COJ Environmental Protection - 2021 Environmental Award Presentation by
Mark Gabrynowicz
Mayor Glasser introduced Mark Gabrynowicz, Chair of the Environmental Stewardship
Committee (ESC). Mr. Gabrynowicz gave an overview and Mayor Glasser thanked him
for submitting the nomination to the Jacksonville Environmental Protection Board.
PUBLIC COMMENT
Mayor Glasser explained the process for public comments and opened the Courtesy of the Floor
to Visitors. City Clerk Bartle called each speaker to the podium.

Kenya Stouffer shared information about the organization she works for, Surfear Negra.
Quientero Davis thanked the Commission for their work.
3 CITY MANAGER REPORTS
3A. Report on American Rescue Plan Act (ARPA) Funds
CM Corbin called on Finance Director (FD) Melissa Burns to speak on this item. FD
Burns presented the information included in the agenda packet and answered questions
from the Commission.
3B. Accept the 90-Day Calendar (March - May 2022)
CM Corbin reported on recent additions to the calendar.
There was CONSENSUS to accept the 90-Day Calendar.
3C. 18th and 19th Street Parking
CM Corbin presented a slide show (which is attached hereto and made part of this
Official Record as Attachment A) as he provided updates and explained several options
for paid parking. He requested direction from the Commission.
Commissioner Waters spoke in favor of using middle of the road kiosks and hiring an
employee for enforcement. He suggested having police drive by the area a few nights a
week to address loitering and changing the sign to no parking from dawn to dusk. He
reported he has solutions and will discuss them with CM Corbin and Chief Gualillo.
Commissioner Kelly confirmed that the issue is public nuisance.
CM Corbin answered questions from the Commission.
Commissioner Kelly spoke against using lifeguards as a resource for this.
Mayor Glasser spoke in favor of using the same fee structure as Town Center.
Commissioner Bole noted he does not want to lose money on this and hopes the solution
fits the problem. He requested that the cost of kiosks and enforcement be provided.
Commissioner Kelly spoke in support of using a booth and a person to collect the
money.
Commissioner Waters explained the need for enforcement, detouring bad behavior, and
respecting the area being visited.

Commissioner Norris spoke in favor of using a kiosk and having serious talks about
creating a parking department. She advised about other areas of the City having parking
issues and was not in favor of changing the parking hours.
Mayor Glasser spoke in favor of using kiosks, putting someone out there between now
and the time the kiosks arrive, and adding a parking attendant position. She noted she
was not in favor of a booth.
Mayor Glasser confirmed there was consensus for the kiosk option.
Commissioner Bole reminded the Commission about their previous decision for a pilot
program.
CM Corbin explained his plan to come back with more details about enforcement,
timing, and fee structure.
Police Chief Victor Gualillo reported on citation data and past enforcement efforts and
answered questions about enforcement, staffing options, and consequences for unpaid
tickets.
Commissioner Norris reiterated the need for a parking department, noted other duties
for the off-season, and requested that a cost for a parking department be provided and
addressed.

3D. Pay Scale Analysis and Recommendations
CM Corbin explained the need for a pay scale adjustment, noting Atlantic Beach is not
competitive with its neighboring communities. He reported having data that he plans to
email to the Commission and meet with each of them separately.
Mayor Glasser requested an update on police accreditation. CM Corbin advised he will
have someone report on it at the next meeting.
4 REPORTS AND/OR REQUESTS FROM CITY COMMISSIONERS
4A. Proclamation of the City of Atlantic Beach in Recognition of The Dutton Island
Five (Mayor Glasser)
Mayor Glasser advised that the proclamation will be presented during an event being
held at Dutton Island on March 11, 2022 and invited the Commission to attend. She
showed an art piece that was donated by local artist, Jeanne Gabrynowicz.

• Encouraged everyone to watch the events in Europe very carefully.
Commissioner Kelly
• Asked if it is necessary to amend the voting districts based on the most recent
results. CA Durden advised that the Planning Department completed an
assessment and determined that each of our districts are still within the
parameters, so no changes to the boundaries are necessary.
• Commended the Recreation Department for improved communications.
Commissioner Norris
• Thanked FD Burns for her report on American Rescue Plan Funds.
• Requested an update on the Public Works Building including plans to make it a
more sustainable structure. She asked if a green roof is included. CM Corbin
explained that a green roof has not been talked about yet; noted the problems
with having open bays; and indicated he will try to get a report back soon.
• Requested information on the project at Donner Road and how it will meet the
Complete Streets policy. CM Corbin explained that the plans were sent to
Heather and Uyen and we are waiting for their comments.
Commissioner Waters
• Spoke about wanting parking spots for golf carts counted the same as cars for
beach re-nourishment. CM Corbin agreed to check on it.
Mayor Glasser
• Requested a Resolution to support Ukraine.
• Requested a Resolution recognizing the Fletcher High School Girls Soccer Team
for winning a State team title.
• Provided an update on smoke-free zones legislation.
• Reported the topics being discussed at the March 9th Mayor's Council on Health
and Well-Being meeting.

A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA
ESTABLISHING THE CITY'S 2022 PRIORITIES; AND PROVIDING AN
EFFECTIVE DATE.
Mayor Glasser read the Resolution by title.
CM Corbin and DCM Hogancamp provided an overview.
Mayor Glasser suggested making an amendment, under Livability, to also solidify our
support for public safety and local businesses. She also suggested that the Commission
start talking about the inequities of the Interlocal Agreement. Commissioner Kelly
suggested bringing this up with the last bullet point of the priorities. Commissioner
Norris agreed with the need to discuss the Interlocal Agreement, but expressed concerns
about the proper way to do it. Discussion ensued and Mayor Glasser asked the
Commission to consider making a motion with amendments based on her suggestions.
(There was no motion to amend made.)

Commissioner Bole volunteered to help write the Ukraine proclamation.
Commissioner Kelly announced the Canine Carnivale event scheduled for May 21, 2022.
CM Corbin reported his interest in serving on the Jacksonville Beach's Public Art Committee,
unless the Commission has any reservations about him doing so.
Mayor Glasser shared comments on traffic calming and reminded the Commission about her
request for more uniform speed limits.

TO THE PENDING APPEAL STYLED THOMAS BOURDON V. CITY OF
ATLANTIC BEACH, CASE NO. 2022-AP-000003, TO BEGIN IMMEDIATELY.
City Attorney Durden stated her request for a Private Attorney/Client me eting in accordance
with Section 286.011(8), Florida Statutes, pertaining to the pending appeal styled Thomas
Bourdon v. City of Atlantic Beach, Case No. 2022-AP-000003, to begin immediately.
2. MAYOR ANNOUNCES THE CLOSED CLIENT/ATTORNEY MEETING WILL BE
HELD IN THE NORTH CONFERENCE ROOM OF CITY HALL, ESTIMATED
LENGTH OF THE CLOSED CLIENT/ATTORNEY MEETING AND SPECIFIC
NAMES OF PERSONS ATTENDING THE MEETING.
Mayor Glasser stated the following:
"In accordance with Section 286.011(8) of the Florida Statutes, I am announcing that the Special
Private Attorney/Client meeting, commonly referred to as a “shade” meeting, in the case of
Thomas Bourdon v. City of Atlantic Beach, will be held in the North Conference Room here at
City Hall, beginning now.
The estimated length of time for the meeting will be between 30 and 60 minutes.
The people in attendance at the shade meeting will be Commission Members Brittany Norris,
Candace Kelly, Bruce Bole, Commissioner Waters and myself, Ellen Glasser along with Shane
Corbin, City Manager; Brenna Durden, City Attorney; and Elise Cashman, the court reporter."

and asked for a motion regarding the proposed settlement offer from Mr. Bourdon.

request Brenna Durden to advise Mr. Bourdon's legal counsel that no further offers to settle will
be entertained.

Prior to 2013,City Employees had the opportunity twice a year to cash-in their
leave balances down to 120 hours.The maximum leave balance was 960,so it was
a coveted bene?t for employees.This program was eliminated along with many
other employee bene?ts at the time.The current maximum leave balance for
employees is 680.Due to staf?ng shortages,many employees are unable to take
leave and therefore,lose accrued leave time.
Some type of leave cash-in was a priority for both unions this year and was a
priority expressed by many during the bene?ts survey recently completed by
Human Resources.
The terms negotiated by the unions were to allow employees to cash-in up to 50
hours of accrued personal leave on September 1 of each year,as long as they
maintain a balance of 80 hours of leave after the cash-in.For budgeting purposes,
employees will be required to submit a request for leave cash-in by July 1 of each
yea1.
The City bene?ts from this policy by paying employees for leave at their current
rate of pay,rather than the larger salary they would be making upon termination.
Human Resources will draft a Policy for the Employee Handbook and a request
form for this purpose.
The potential budget impact has been calculated at $138,454.

A RESOLUTION OF THE CITY OF ATLANTIC BEACH,FLORIDA,

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF ATLANTIC
BEACH,FLORIDA,RESCINDING PREVIOUS LEGISLATION REGARDING
THE CULTURAL ARTS AND RECREATION ADVISORY COMMITTEE,
EXCEPT FOR SECTIONS PERTAINING TO THE TEEN COUNCIL;
RENAMING SAID COMMITTEE TO THE ARTS,RECREATION AND
CULTURE COMMITTEE;PROVIDING FOR PURPOSE,MEMBERSHIP,AND
RESPONSIBILITIES OF SAID COMMITTEE;PROVIDING FOR CONFLICTS;
AND PROVIDING FOR AN EFFECTIVE DATE.
Purpose.
The purpose of the Arts,Recreation,and Culture Committee (ARCC),previously named
the Cultural Arts and RecreationAdvisory Committee (CARAC),is to propose,plan,promote and
review artistic,recreational,and cultural grants,programs,exhibits,events,and projects for the
citizens of Atlantic Beach.The Committee is advisory and exists for the purpose of making
recommendationsto the City Commission regarding the most efficient and effective ways to spend
limited tax dollars for the maximum bene?t of the community.The Committee shall propose
and/or support a diverse variety of activities related to arts,sports and leisure,culture,education,
history,and enrichment,and social engagement to bene?t citizens in all areas of Atlantic Beach.
Membership.
There shall be a total of seven (7)Committee members with one (1)alternate appointed
by the City Commission.Members mustbe residents of Atlantic Beach.The term of of?ce shall
be for three (3)years and members may serve a maximum of three (3)consecutive terms.All
terms shall expire on December 31;however,members whose terms expire shall continue to serve
until replacement appointments are effective.Members of this Committee may hold a public
of?ce or other appointed position in the City,provided the powers and authority of this Committee
remain advisory only.Any vacancy during the unexpired term of a member shall be ?lled for the

Duties and Responsibilities.
(a)The Committee advises the City Commission on questions of general policy for
City venues related to:art,sports and leisure,culture,education,and history programs;programs
related to the City’s grant program;matters of communication,equity,and accessibility;and,
special projects as requested by staff or the City Commission.
(b)Working collectively,the Committee shall work with staff on any needs,
assessments,and/or program reviews within its mission;and,when appropriate,bring matters of
public interest to the department and/or City administration.Recommendationsare made via
of?cial action of the Committee during publicly noticed meetings and should be forwarded to the
City Commission by City staff or the Committee Chair for review.
(c)The Committee performs a key role in the City’s annual cultural arts and recreation
grant program by:recommending grant program guidelines to the City Commission;reviewing
grant applications;and providing a recommendationof grant awards to the City Commission
based on the needs of the community and community centers.
Commission Liaison.
The Mayor shall designate one City Commission member to serve as liaison to ARCC.
City Staff Liaison.
(d)Staff will be assigned by the City Manager to provide technical and administrative

RESOLUTION OF THE CITY OF ATLANTIC BEACH,FIDRIDA
RESCINDING ALL PREVIOUS LEGISLATION REGARDING THE
RECREATION ADVISORY BOARD AND THE CULTURAL ARTS BOARD;
EFFECTIVE DATE.
WHEREAS,on January 22,1990,the City Commission adopted
Resolution 90-2 creating the Recreation Advisory Board,which
resolution was subsequently amended by Resolution 91-35 (reduced
the number of members),and by Resolution 94-5 (increased the
number of members),and
WHEREAS,on March 14,1994,the City Commission adopted
Resolution 94-10 creating the Arts and Entertainment Advisory
Board,which resolution was subsequently amended by Resolution 94-
13 (increased the number of members),Resolution 95-15 (changed
named to cultural Arts Board),Resolution 96-21 (reduced the number
of members and changed length of terms of service),and Resolution
01-08 (changed length of terms of service and limited time any
.person could service as chairman),and
WHEREAS,the City Commission deems it to be in the best
interests of the citizens of Atlantic Beach if the Recreation
Advisory Board and the Cultural Arts Board are combined into one
committee to be known as the Cultural Arts and Recreation
Committee.
NOW THEREFORE,be it resolved by the City Commission of the
City of.Atlantic Beach as follows:
SECTION 1.All previous legislation providing for the creation
and conduct of the Recreation Advisory Board and the Cultural Arts
Board is hereby rescinded.
SECTION 2.Creation:There is hereby created and established
THE CULTURAL ARTS AND RECREATION ADVISORY COMMITTEE.
SECTION 3.Purpose:The purpose of the Cultural Arts andRecreation.Advisory Committee is to propose,plan,promote andreviewartistic,recreational and cultural programs,exhibits andprojectsforthecitizensofAtlanticBeach.The Committee isadvisoryandexistsforthepurposeofmakingrecommendationstotheCityCommissionregardingthemostefficientandeffectivewaystospendlimitedtaxdollarsforthemaximumbenefitofthecommunity.The Committee shall propose a diverse variety ofprogramstobenefitcitizensinallareasofAtlanticBeachandmay Agenda Item #3.E.22 Aug 2022Page 47 of 107

SECTION 4.Membership:There will be a total of nine (9)
members appointed by the Mayor and Commission.Members must be
residents of Axlantic Beach.The terms of membership will be for
two years with a maximum of two consecutive terms.The initial
appointments will be for staggered terms so that five members will
serve full two year terms and the remaining four members will serve
one-year terms.Members will be automatically removed from the
Committee if they miss three consecutive meetings unless their
absence is excused by the Chairman.A member can choose to resign
from the Committee at any time by giving written notice to the City
Clerk.One member of the Committee shall either be a member of the
Atlantic Beach Teen Council or an adult advisor to same.
SECTION 5.Duties and Responsibilities
(a)Develop plans,promote and support programs and
projects to bring the benefits of art and recreation to the
citizens of Atlantic Beach
(b)Create and utilize a committee structure to make
effective use of the scarce and valuable time of Committee members.
(c)Recommend an ongoing calendar of special events for
the City of Atlantic Beach.
(d)Submit a recommended annual budget for support of
arts and recreation through events or projects for consideration of
the City Commission.
(e)Evaluate and advise the City on the effectiveness of
programs and projects that are ongoing or completed to help plan
for future events.
(f)Evaluate and.make recommendations to the City on
special assignments or requests made by the City Commission or City
Manager.
(g)Help plan or evaluate plans for new recreation
facilities if requested by the Mayor and Commission or City Manger.

SECTION 7.City Staff Liaison
(a)Staff will be assigned by the City Manger to

a provision for an alternate member and add a provision requiring that a Teen Council
member or an adult advisor be a member of the Committee,so that the revised Section

who are thirteen (13)through nineteen (19)years of age and members shall serve
without compensation.Membership on this Councilwillnot be limitedto a certain
number and will be comprised of teenagers wishing to participate.Membership
on the Councilshall reflect a diversity of different geographic areas of Atlantic
Beach as well as race and gender.Teenagers who do not reside in Atlantic Beach
are welcome to attend events but shall not be officialTeen Council members or
officers.

leastone Advisormust be in attendance at all meetings.The primary AdultAdvisor

A RESOLUTION OF THE CITY OF ATLANTIC BEACH,FLORIDA,
AUTHORIZING THE PUBLIC WORKS DEPT.TO PURCHASE A 2023
INTERNATIONAL MV607 SBA CLAM TRUCK WITH A PETERSEN TL3
GRAPPLE LOADER;AUTHORIZING THE CITY MANAGER TO APPROVE THE
PURCHASE ORDER IN ACCORDANCE WITH AND AS NECESSARY TO
EFFECTUATE THE PROVISIONS OF THIS RESOLUTION;AND PROVIDING AN
EFFECTIVE DATE
WHEREAS,the Public Works Dept.is intending to purchase a new 2023 International MV607 SBA
Clam Truck with a Petersen TL3 Grapple Loader under the Florida Sheriff's Association Contract #BID FSA20-
VEH18 in the amount of$l85,585.00 from Cumberland International Trucks,Inc.;and
WHEREAS,this truck will be used as the City’s primary Clam Truck upon its arrival (estimated to be
one year from the date of Purchase Order).The current Clam Truck,a 2007 Sterling LT9500 with a PacMac
Grapple Loader (26,634 miles)will currently be kept in the City’s ?eet.Staff will evaluate upon the new truck’s
arrival whether or not to keep this truck as a backup or sell at that time;and
WHEREAS,this type of truck bene?ts the City in many ways.It helps keep our City right-of-ways clear
of debris on a routine basis,allowing the Public Works Dept.to efficiently pick up large excess piles of
trash/furniture/misc.created from residents moving,evictions and illegal dumps,etc.and excess piles of yard
debris created from storms,clean up events and illegal dumps.This equipment enables staff to transport larger
amounts of debris in a timely manner from City right—of-waysto the City yard for disposal,thus keeping our right-
of—waysclear and allowing for the free ?ow of stormwater during rain events;and
WHEREAS,there is currently $150,000.00 budgeted in the Sanitation Account 420-4201-534-6401 for
a Clam Truck.The balance to purchase ‘the International MV607 Clam Truck with a Petersen TL3 Grapple
Loader,$35,585.00,will come from the FY2 1-22 Streets Department budget.The total of$185,585.00 will come
from the FY21-22 budget.
NOW THEREFORE,be it resolved by the City Commission ofthe City ofAtlantic Beach as follows:
SECTION 1.The City Commission hereby approves Resolution No.22-50 authorizing the Public Works
Dept.to purchase a 2023 International MV607 SBA Clam Truck with a Petersen TL3 Grapple Loader in the
amount of$185,585.00 from Cumberland International Trucks,Inc.;
SECTION 2.The City Commission hereby authorizes the City Manager to approve a Purchase Order to
Cumberland InternationalTrucks,Inc.in the amount of$185,585.00;
SECTION 3.This Resolution shall take effect immediately upon its passage and adoption.

A RESOLUTION OF THE CITY OF ATLANTIC BEACH,FLORIDA,
AUTHORIZING THE CITY TO ENTER INTO THE 2023 JUSTICE
ASSISTANCE GRANT PROGRAM
WHEREAS,Justice Assistance Grant Countywide (JAGC)have been established by the
Federal Government and are administered by the State of Florida,The Florida Department of Law
Enforcement (FDLE),Of?ce of Criminal Justice Grants;and
WHEREAS,allocation of JAGC funds provided to each County in Florida must be
approved by at least ?fty-one percent of the local law enforcement agencies in that county;and
WHEREAS,the Atlantic Beach Police Department has agreed the other local law
enforcement entities to accept the funding levels for the 2023 fiscal year;and
WHEREAS,the Atlantic Beach Police Department will use these funds for services or
equipment that will enhance the capability of the agency;and
WHEREAS,the submission of a JAGC application requires CEO and CLO certi?cation
and the application and management of the grant process must be completed by an authorized city
representative and miscellaneous grant amendments must be authorized by a city of?cial;
NOWTHEREFORE,be it resolved by the City Commission of the City of Atlantic Beach
as follows:
SECTION 1.The City Commission hereby authorizes;the Mayor to execute the 2023
JAGC contract agreement with the State of Florida and for the Chief Legal Of?cer for the city to
execute any necessary certi?cations required during the grant cycle and for staff and the Atlantic
Beach Police Department to apply for and manage the grant process and the City Manager to have
authority to approve the purchase of products or services identi?ed in the grant contracts.
SECTION 2.This Resolution shall take effect immediately upon its passage and adoption.

WHEREAS,the City Commission desires to expand the City’s current trespass ordinance
to include additional City owned property;and
WHEREAS,the City Commission ?nds that the presence of individualswhoviolate state
statutes,the City’s Code of Ordinances,or the City’s park rules and regulations,creates a threat to
the public safety and welfare;and
WHEREAS,the City Commission deems this Ordinance necessary to promote public
safety and public welfare.
NOW,THEREFORE,BE IT ENACTED BY THE CITY COMMISSION ON
BEHALF OF THE PEOPLE OF THE CITY OF ATLANTIC BEACH,FLORIDA:
SECTION 1.Repeal and Replace.Section 5-33,Enforcement of park rules and regulations,isherebyrepealedinitsentiretyandrenamedandreplacedasshowninExhibitA,Trespassproceduresonpublicproperty,attached hereto and incorporated herein by reference.New Section5-33 as shown in Exhibit A,Trespass procedures on public property,is hereby adopted as fullyrevisedSection5-33 to the City’s Code of Ordinances.01784563-2 Agenda Item #9.A.22 Aug 2022Page 96 of 107
SECTION 2.Con?ict.-All ordinances,resolutions,of?cial determinations,or parts thereof

SECTION 3.Codi?cation and Scrivener’s Errors.The publisher of the City of Atlantic Beach’s
Code of Ordinances,the Municipal Code Corporation,is hereby directed to incorporate Exhibit A
attached hereto,Section 5-33 —Trespass procedures on public property,into the City’s Code of
Ordinances.Sections of Chapter 5 may be renumbered or re-lettered and scrivener’s errors,
formatting and typographical errors and other minor,inadvertent graphical errors in Chapter 5
which do not affect the intent may be authorized by the City Manager and City Attorney without
the need of public hearing,by ?ling a corrected or re-codi?ed copy of same with the City Clerk.
SECTION 4.Applicability.The provisions of Section 5-33,Trespass procedures on public
property,set forth in Exhibit A hereto,shall apply to all applications,decisions or controversies
pending before the City of Atlantic Beach upon the effective date hereof or ?led or initiated
thereafter.
SECTION 5.Severability.If any section,sentence,clause,or other provision of this Ordinance,
or any provision of Exhibit A attached hereto,Section 5-33,Trespass procedures on public
property,shall be held to be invalid or unconstitutional by a court of competent jurisdiction,such
portion shall be deemed a separate,distinct and independent provision,and such holding of
invalidity or unconstitutionality shall not be construed as to render invalid or unconstitutional the
remaining sections,sentences,clauses,or provisions of this Ordinance,or of Exhibit A,which
shall remain in full force and effect.
SECTION 6.Effective Date.This ordinance shall take effect upon ?nal reading and approval.

Sec.5-33.Trespass procedures on public property.
(a)

Trespass for violation ofState Statutes.If a person is arrested based upon probable cause to
believe that the person has committed any of the offenses enumerated in the Florida Statutes
within any City facility,building or outdoor area that is open to the general public,including
without limitation,municipal parks and beaches,an officer of the Atlantic Beach Police
Department will exclude that person from all City property identi?ed herein for a period of
up to one year.Upon arrest,every person excluded from City property pursuant to this
subsection must be provided a notice of trespass after warning,in accordance with subsection
(c)below.
Trespass for violation ofpark rules and Atlantic Beach ’s Code ofOrdinances.If a person is
cited for violation of park rules or the City of Atlantic Beach’s Code of Ordinances,an of?cer
of the Atlantic Beach Police Department may exclude for a period of up to one year as
provided below that person from the particular City property where the offense occurred as
set forth below.Every person excluded from City property pursuant to this subsection must
be provided a notice of trespass after warning in accordance with this subsection (b).
(1)First violation (warning only).First time violations will result in the violator being
warned of the violation by an of?cer of the Atlantic Beach Police Department and other
certain city employees designated by the Chief of Police.If the violator is a juvenile,
then the police officer will obtain parental/guardian information and contact the
juvenile's parent/guardian and inform the parent/guardian of the warning.All warnings
will be documented on an ABPD notice of warning form,a copy of which will be
provided to the violator and will be retained by the Police Department.
Second violation within one year fromthe date ofthe first violation.If the violator is a
juvenile,then a police of?cer will notify the juvenile's parent/guardian and complete a
notice of trespass after warning form excluding the juvenile from the City property for
thirty (30)days and make available a copy for the juvenile’s parent.
(2)
If the violator is an adult,then a notice of a trespass after warning will be issued to the
violator excluding that person from the City property for thirty (30)days.
Third and subsequent violations,including but not limited to a violation ofa thirty (3 0)
day exclusion period issued pursuant to subsection (2)above,within one year fromthe
date ofthe second offense.If the violator is a juvenile,the police of?cer will contact the
juvenile's parent/guardian and complete a notice of trespass after warning form for one

Authority to regulate park activities.The City Manager,with assistance of the Director of
Parks and Recreation Department and the Chief of Police,is authorized to adopt rules and
regulations related to activities in the City’s parks and beaches,to include but not limited to
hours of operation and terms and conditions of use.
The Police Department is authorized to:
(1)Direct any individual to leave any city park or beach or any specific area of any city
park,and to complete a trespass after warning notice prohibiting an individual from
returning to a city park or beach or any speci?c area of a city park based on the
individual’s violationof posted park rules or violations of criminal codes and/or statutes
as set forth in this Section.
Close down a city park or any portion of a city park due to violations of park rules,
violations of criminal codes and/or statutes,or due to public safety concerns.
(2)
This subsection shall not be construed to limit the authority of a police of?cer to issue a
notice of trespass to any person for any lawful reason for any City property,including
without limitation rights—of-way,when closed to general vehicular or pedestrian use,as
necessary or appropriate in the sole discretion of the City police officer.
(3)
This section shall not be construed to limit the authority of of?cers of the Atlantic Beach
Police Department to arrest or cite individuals for violations of any section of the City’s Code
of Ordinances or the Florida Statutes.
Any person found on or within any City property identi?ed in subsection (a),in violation of
a notice of trespass after warning issued in accordance with this section may be arrested for
trespassing,except as otherwise provided in this section.
The City Manager may,upon request,authorize an individual who has received a trespass
after warning to enter the property or premises to exercise his or her First Amendment rights
alternative location to exercise such rights or to conduct

An appeal of the trespass warning or the trespass after warning must be ?led,in writing
to the City Clerk,within ?fteen days of the issuance of the warning,and shall include
the appellant's name,address and phone number,if any.No fee shall be charged for
?ling the appeal.
Appeals shall be heard by a special magistrate with whom the City contracts to provide
this service.
Within seven days following the ?ling of the appeal,the special magistrate shall
schedule a hearing.Notice of the hearing shall be provided to the appellant in one of two
ways:
a.By providing the appellant a copy of the notice of hearing in person at the time he
or she ?les the appeal.This shall be the preferred method of notice.When it is not
possible to provide notice in this manner,the appellant shall be informed that notice
of the hearing will be provided in accordance with paragraph (b)below.
b.By leaving or posting the notice at the front desk of City Hall.
The special magistrate shall hold the hearing as soon as possible.In no event shall the
hearing be held later than 60 days from the ?ling of the appeal.
Copies of documents in the City's control which are intended to be used at the hearing,
and which directly relate to the issuance of the subject warning to the appellant,shall be
made available upon request to the appellant at no cost.
The appellant shall have the right to attend with an attorney,the right to testify,and to
call witnesses and present evidence.The appellant shall have the right to bring a court
reporter,at his or her own expense.
The special magistrate shall consider the testimony,reports or other documentary
evidence,and any other evidence presented at the hearing.Formal rules of evidence shall
not apply,but fundamental due process shall govern the proceedings.
The City shall bear the burden of proof by clear and convincing evidence that the subject
warning was properly issued pursuant to the criteria of this section.
If the appellant fails to attend a scheduled hearing,the special magistrate shall review
the evidence presented and determine if the subject warning was properly issued
pursuant to the criteria of this section.
(10)Within ten days of the hearing,the special magistrate shall issue a written decision on
the appeal which shall be mailed to the appellant at the address provided.

SECTION 4.Applicability.The provisions of Section 5-33,Trespass procedures onpublic
property,set forth in Exhibit A hereto,shall apply to all applications,decisions or
pending before the City of Atlantic Beach upon the effective date hereof or ?led orinitiate

SECTION 5.Severability.If any section,sentence,clause,or other provision ofthis Or

or any provision of Exhibit A attached hereto,Section 5-33,Trespass procedures onpublic
property,shall be held to be invalid or unconstitutional by a court of cornpetentjurisdiction,such
portion shall be deemed a separate,distinct and independent provision,and such hol
