WHEREAS, Grantors are the owners of certain real property located at 1918 Sherry Drive North, Atlantic Beach, Florida 32233, and WHEREAS, it is necessary for Grantee to have a temporary easement over, across and under the lands owned by Grantors for minor regarding to assist drainage in the area, and WHEREAS, Grantors have agreed in consideration of the sum of Ten Dollars ($10.00) and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowl- edged, to grant to Grantee and all other persons claiming by, through or under Grantors, their predecessors in title, or their heirs, assigns or legal representatives by virtue of any deeds of conveyances describing land known as Lot 11, Selva Marina, Unit 10-C, Plat Book 37, page 40, current public records of Duval County, Florida, a temporary easement or right-of--way over, across and under the property described herein, for the purposes and the manner expressed herein. NOW, THIS INDENTURE V~SETH: That, pursuant to this agreement and in consideration of Ten Dollars ($10.00) and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Grantors hereby grant unto Grantee, its heirs and assigns, and to all others likely situated as described above, and their heirs and assigns, the following temporary easement: A ten (10) foot wide temporary construction easement over and upon the following described lands: East 10 feet of Lot 11, Selva Marina, Unit 10-C, Plat Book 37, page 40, of the current public records of Duval County, Florida. said parcel being shown on the attached map. This temporary construction easement shall terminate when Grantee has completed the regrading described herein, or December 14, 2001, whichever is sooner. This easement is given upon the strict condition that Grantee shall restore that portion of the surface of the properties described above disturbed during any regrading.
