THIS INDENTURE, made this U `"- day of ~ ~~E-~.-c,~
1965, by and between Community Presbyterian Church, a non-profit
corporation under the laws of the State of Florida, party of
the first part, and the City of Atlantic Beach, a municipal
corporation under the laws of the State of Florida, party of
the second part,
WHEREAS, by an indenture dated February 6, 1959,
recorded in Volume 712 at Page 119, of the public records of
Duval County, Florida, Community Presbyterian Church granted
to the City of Atlantic Beach a perpetual and exclusive right
of way for public road and street purposes over and upon
Lot 727 and a portion of Lot 736, all in Section 3, Saltair,
according to the plat recorded in Plat Book 10, at Page 16,
of the public records of Duval County, Florida, and

WHEREAS, by an indenture dated ~'",, 1965,
Community Presbyterian Church granted to the City of Atlantic
Beach a perpetual and exclusive right of way for public road
and street purposes over and upon the westernmost 50 feet of
Lot 736 and all of Lot 725, located in Section 3, Saltair,
according to the plat recorded in Plat Book 10, Page 16, of
the public records of Duval County, Florida, said right of
way to be in lieu of and in substitution of the right of way
granted under said indenture dated February 6, 1959, and
WHEREAS, the parties hereto mutually desire that the
said indenture of February 6, 1959, be cancelled 'and terminated,
NOW THEREFORE, in consideration of the sum of One
Dollar ($1.00), the receipt of which is hereby acknowledged,

and in further consideration of the grant of the right of way
under said indenture dated ,~~~=~ _ti.~~.- ~~~ 1965, the parties
hereto hereby agree that said indenture of February 6, 1959, be
and the same is hereby cancelled and terminated.
IN WITNESS WHEREOF, the party of the first part has
caused these presents to be executed by its duly authorized
Trustees, and the party of the second part by its Mayor and
attested by its City Clerk the day and year first above
written.
