AGREEMENT FOR CORRECTING GRANT OF EASEMENT
THIS AGREEMENT made by and between SALTAIR DEVELOPMENT COMPANY, a
Florida corporation having its principal place of business at 321 Atlantic
Boulevard, Atlantic Beach, Florida and CITY OF ATLANTIC BEACH, a municipal
corporation organized and existing under the laws of Florida, of which the
post office address is Atlantic Beach, Florida,
WITNESSETH:
WHEREAS, Saltair Development Company did on the 15th day of May, A.D.
1964, make, execute and deliver to the City of Atlantic Beach a Grant of
Easement granting unto the City of Atlantic Beach a perpetual easement for
public utility purposes on, along, across and under the following described
lands situate, lying and being in the County of Duval in the State of Florida,
to wit:
Lots 762, 763, 764, 765 and 766, SALTAIR, Section 1, according
to a plat thereof recorded in Plat Book l0, page 8, current
public recards of Duval County, Florida;
WHEREAS, the aforesaid described Grant of Easement has been recorded
in Volume 2191, page 113, Official Records, Duval County, Florida;
WHEREAS, the aforesaid Grant of Easement is indefinite and uncertain
with respect to the exact location of the easement intended to be granted on,
along, across and under the hereinabove described lots; and,
WHEREAS, it is the desire and intention of the Saltair Development
Company and the City of Atlantic Beach to limit and confine said perpetual
easement for public utility purposes to the North five feet of the hereinabove
described lots and being the location of the sanitary sewer line heretofore
constructed by the City of Atlantic Beach with the consent of Saltair Develop-
ment Company.
NOW, THEREFORE, in consideration of the premises Saltair Development
Company does hereby grant unto the City of Atlantic Beach a perpetual ease-
ment far public utility purposes on, along, across and under the following
described lands situate, lying and being in the County of Duval, State of
Florida, to wit:
The North five feet of Lots 762, 763, 764, 765 and 766,
SALTAIR, Section 1, according to a plat thereof recorded
in Plat Book 10, page 8, current public records of Duval
County, Florida;
wherein any and all water lines, sewer lines or other underground utilities
are required to be laid below the surface of the ground.
AND the City of Atlantic Beach does hereby remise, release and quit-
claim unto Saltair Development Company all the right, title, interest, claim
and demand which it might have or claim under and by virtue of said Grant
of Easement recorded in Volume 2191, page 113, Official Records, Duval County,
Florida, in and to the hereinbefore described lots, excepting the easement
hereinabove granted affecting the North five feet thereof.
IN WITNESS WHEREOF Saltair Development Company has caused these
presents to be executed and its corporate seal to be affixed by the proper
officers thereunto duly authorized, and the City of Atlantic Beach has caused
these presents to be executed and its corporate seal affixed by its Ma or
Commissioner and the City Clerk, duly authorized by Resolution No. 6 ~~,~,,,
