AN ORDINANCE PROVIDING THAT NO BUILDING PER1MIT SHALL BE ISSUED FOR
THE CONSTRUCTION OF ANY BUILDING OR STRUCTURE, OUTSIDE THE AREA
SERVED BY THE ATLANTIC BEACH SANITARY SEWER SYSTEM, IN WHICH
SANITARY FACILITIES OR PLUMBING IS REQUIRED, UNTIL A PERMIT FOR THE
CONSTRUCTION OF A SANITARY DISPOSAL SYSTEM SHALL HAVE FIRST BEEN
OBTAINED: ESTABLISHING THE METHOD OF OBTAINING SUCH PERMIT: AND
PROVIDING A PENALTY FOR THE VIOLATION THEREOF.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA.
Section 1. No building permit for the construction of any
building or structure, outside the area served by the Atlantic
Beach Sanitary Sewer System, in which sanitary facilities will be
installed or required, shall be issued until a sewage disposal
system is first obtained.
Section 2. Any person desiring to construct in the City of
Atlantic Beach a sewage disposal system, shall make application to
the Building Official of the City for a permit to construct such
system. There shall be submitted a plot plan and such other
information as may be required by the Building Official. Said
application shall be accompanied by an application to the Duval
County Health Department for a permit for the construction of said
system on the form provided by said Department.
Section 3. Upon receipt of the application as herein above
provided for, the Building Official shall cause to be made a
perculation test as prescribed by said Health Department, the results
of this test, the application of the Health Department and recom-
mendation of the Building Official, shall be forwarded to said
Health Department, and applicant shall be notified of this action
and advised to contact the Duval County Health Department to obtain
permit to construct sewage disposal system.
Section 4. Upon presentation of Duval County Health Department
Septic Tank Permit the Building Official may then issue a building
permit.
Section 5. Every disposal system shall be constructed in
accordance with the requirements set out on the Septic Tank Permit
and such installation shall not be covered with earth until inspected
by the Building Official.
Section 6. Notwithstanding the issuance of any permit for the
construction of any disposal system and the approval of the Con-
struction thereof by said Building Official, the owner and the con-
tracter who shall have constructed the same for the owner, shall at
all times be and remain responsible to the City for the proper
functioning of said system, and the owner shall nevertheless at all
times maintain the said system in accordance with the requirements
of the Sanitary Ordinance of the City of Atlantic Beach, and
Chapter 5 of the Florida State Sanitary Code.
Section 7 . Every applicant for a permit for the construction
of a sewage disposal system shall pay to the City, upon the filing
of his application, a fee of $5.00.
Section 8. Any person who shall violate any provision of this
Ordinance, shall upon conviction thereof be punished by fine in a
sum not to exceed $100.00, or by imprisonment for a period not to
exceed 30 days, or both such fine and imprisonment.
