Ordinance No. 55-97-30 v ORDINANCE NO. 55-97-30 AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, FLORIDA, AMENDING CHAPTER 16, SOLID WASTE AND RECYCLING, SEC. 16- 8, FEES FOR COLLECTION, TO PROVIDE ADDITIONAL FEES REQUIRED BY THE INTERLOCAL AGREEMENT WITH THE CITY OF JACKSONVILLE DATED SEPTEMBER 28, 1995, FOR COMMERCIAL ACCOUNTS AND RESIDENCE B OR C APARTMENTS WITH FOUR OR MORE APARTMENT UNITS, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, an Interlocal Agreement between the City of Atlantic Beach and the City of Jacksonville was signed on September 28, 1995, and WHEREAS, said Interlocal Agreement requires that commercial accounts and apartment complexes with four or more apartment units pay tipping fees for landfill use, and WHEREAS, it is necessary to amend the Code of Ordinances of Atlantic Beach, Florida, to reflect these requirements of said Interlocal Agreement, now therefore BE IT ENACTED BY THE CITY COMMISSION ON BEHALF OF THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA: SECTION 1. The Code of Ordinances of the City of Atlantic Beach, Florida, is hereby amended by adding a new section to be numbered Sec. 16-8(3), which section shall read as follows: "(3) Tipping fees for landfill use: effective with FY 94/95, tipping fees for landfill use shall be charged to all new commercial accounts and new apart- ment complexes with four or more apartment units. The term "new" shall include new owners of existing commercial accounts and existing apartment complexes with four or more apartment units." SECTION 2. This Ordinance shall take effect immediately upon its final passage and adoption. PASSED by the City Commission on first reading this 1/a day of 4 , 1997.
