"AN ORDINANCE PROVIDING FOR• THE CLOSING OF THE BEACH WITHIN
41, THE CITY OF ATLANTIC BEACH BY PROHIBITING THE USE OR OCCUPANCY
THEREOF AND PROHIBITING BATHING IN THE ATLANTIC OCEAN WHEN IN
THE OPINION OF THE DIRECTOR OF PUBLIC SAFETY SUCH USE OR
OCCUPANCY OF SAID BEACH OR OCEAN IS DANGEROUS TO LIFE OR LIMB
OR IMPERILS THE PEACE OR GOOD ORDER OF THE CITY. "
BE IT ORDAINED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, DUVAL
COUNTY, FLORIDA, THAT,
SECTION 1. During such times as in the opinion of the Director of
Public Safety, or in his absence the City Manager, swimming or
bathing in the Atlantic Ocean or use of the Beach between the bulk-
head and the waters of the Atlantic Ocean, within the corporate
limits of Atlantic Beach, Florida, is deemed dangerous and hazardous
to the safety, life and health of persons using said ocean or beach,
or any condition shall exist or be threatened in the opinion of the
Director of Public Safety that will imperil the peace and good order
of the City, the Director of Public Safety be and the same is hereby
authorized to close said ocean and/or beach or any part thereof and
prohibit all swimming or bathing in said ocean and/or use of said
beach in any manner, and require all persons thereon forthwith to
remove themselves therefrom, or any part thereof, until the ocean,
likbeach or dangerous areas are considered safe again for use.
SECTION 2. It shall be unlawful for any one to knowingly use, or
refuse, when ordered to remove themselves from, any area which has
been closed by the Director of Public Safety.
SECTION 3 . Any person violating any of the provisions of this
ordinance shall, upon conviction be fined not more than $100.00 or
imprisioned for not more than 30 days or both such fine and imprison-
ment.
SECTION 4. This Ordinance shall become effective immediately upon
its final passage.
