Ordinance No. 57-86-12 v jr)jab QT ORDINANCE NO. 57-86-12 • AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER 15 TO CREATE ARTICLE III, PROVIDING RULES AND REGULATIONS FOR THE USE OF BURGLARY AND ROBBERY ALARM SYSTEMS AND PROVIDING PEN- ALTIES FOR FALSE ALARMS; PROVIDING AN EFFECTIVE DATE BE IT ORDAINED by the City Commission of the City of Atlantic Beach, Florida: Section 1. Chapter 15 of the Code of Ordinances of the City of Atlantic Beach, Florida, is hereby amended to create Article III, which said article shall read as follows: CHAPTER 15 POLICE ARTICLE III BURGLARY AND ROBBERY ALARM SYSTEMS Section 15-22. Deactivation of Alarm System 4110 (a) Commercial Premises: It shall be unlawful to maintain on any commercial premises an alarm or audible alarm unless there is posted at the main entrance to the premises a prominent, conspicuous notice of the telephone numbers of at least two (2) persons who can be reached at all times, or a prominent, conspicuous notice of an alarm company's central office or representative that can be notified at all times and who are authorized to enter the premises and deactivate the alarm system, or who can contact a person who can deactivate the system if the alarm company has no means of access to the premises. If any such person or representative shall fail to appear to turn off any such alarm within thirty (30) minutes after being notified by the police department to do so, then the owner or manager of the premises shall be guilty of an offense against the City. (b) Residential Premises: The posting of notices on residential premises shall not be required. (c) Special Requirements: Any alarm system that is located in such close proximity to any residence that its continuous sounding causes a disturbance to the neighborhood shall have a fifteen (15) minute cut-off switch installed at the written request of the police department. Failure to install such cut-off switch after notification shall constitute a violation of this article. Section 15-23. False Alarms: Required Reports and Correction Action; Fines and Penalties. Responsibilities for false alarms under this article shall be borne by the person or persons occupying or controlling the premises. For each response by the police department to any false alarm, the person owning or maintaining such alarm system shall submit such reports as are set forth herein or be guilty of an offense against the City as follows: (1) For any six (6) responses by the police department during any twelve (12) month period to a premises where a false alarm has occurred, no offense shall be deemed to exist, but the person having or maintaining such burglary or robbery alarm shall, within ten (10) working days after notice to do so, make a written report to the police chief or his designee on forms prescribed by him, setting forth the cause of such false alarm, the corrective action taken, whether such alarm system has been inspected by an authorized service man, and such other information as the police chief may reasonably require to determine the cause of such false alarm and corrective action necessary. (2) Each and every response to a premise during any twelve (12) month period where there have already occurred six (6) responses during that same time period shall be deemed to constitute an offense against the City. Section 15-24. Unlawful activation of alarm systems: It shall be unlawful for any person to activate any alarm system or audible alarm except in the event of an actual attempted burglary or robbery. Section 15-25. General Penalty: Any act or omission which is stated in this article to be unlawful shall be punishable as defined in Chapter 1, Section 1-11 of the Code of Ordinances of the City of Atlantic Beach, Florida. Section 2.
