AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE
CITY OF ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER
2, ARTICLE VI, SECTION 2-271 TO PROVIDE FOR MEMBERSHIP
IN THE RETIREMENT SYSTEM FOR ELECTED OFFICIALS;
PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED by the City Commission of the City of Atlantic
Beach, Florida:
Chapter 2, Article VI, Division 3, Section 2-271 is hereby amended
to read as follows:
CHAPTER 2
ADMINISTRATION
ARTICLE VI - EMPLOYEE BENEFITS
Division 3. Retirement system
Section 2-271 . Membership
(a) All persons who are city employees, and all persons who become
city employees, shall be members of the retirement system,
except as provided in subsection (b) of this section. Elected
officials of the city of Atlantic Beach may elect to become
members of the city retirement system as provided herein or,
at their option, may participate in a program of deferred
compensation as authorized by the City Commission.
(b) The membership of the retirement system shall not include:
(1) Any city employee who is employed in a position normally
requiring less than one thousand (1,000) hours of work per
annum (This does not include elected officials who, by their
application, have become members of the system) ;
(2) Any city employee who is compensated on a fee basis;
(3) Any person participating in another program of deferred
compensation as approved by the City Commission.
(c) Any member who ceases to be a city employee shall thereupon
cease to be a member, except as provided in section 2-278.
(d) The board of trustees shall decide all questions concerning
the membership status of any person.
Section 2. This ordinance shall take effect upon its adoption.
