Ordinance No. 58-91-15 v ORDINANCE NO. 58-91-15 AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER 2 , ARTICLE VI, DIVISION 3, Section 2-262 TO CLARIFY THE DEFINITIONS OF FIREFIGHTER, AND POLICE OFFICER SO AS TO PROVIDE FOR CERTIFICATION AS SET FORTH IN SECTIONS 633 . 35 AND 943 . 14, FLORIDA STATUTES; SECTION 2- 270 (5) TO CLARIFY THE DEFINITION OF ACTUARY TO REQUIRE THAT THE ACTUARY BE AN ENROLLED ACTUARY; AND SECTION 2-272 TO CLARIFY THE DEFINITION OF CREDITED SERVICE TO DELETE REFERENCE TO THE AWARD OF A FULL YEAR OF CREDITED SERVICE FOR RENDERING AT LEAST TEN-TWELFTHS OF A YEAR OF SERVICE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA. Section 1 Chapter 2 , Article VI, Division 3 is hereby amended to make changes in Section 2-262 , 2-270 (5) and 2-272 and said Sections shall read as follows: CHAPTER 2 Administration Article VI Division 3 . Retirement System. Section 2-262 . Definitions * * * "Firefighter" shall mean a city employee employed in the fire department who is a certified fire fighter in accordance with the provisions Section 633 . 35, Florida Statutes, and who holds the rank of firefighter or higher, including probationary firefighter. The term firefighter shall not include any civilian city employee employed in the fire department, any person employed as a firefighter for an emergency, or any person privately employed as a firefighter. "Police Officer" shall mean a city employee employed by the police department who is certified or required to be certified as a law enforcement officer in compliance with Section 943 . 14 , Florida Statutes, and who holds the rank of patrol officer or higher, including probationary patrol officer. The term police officer shall not include any civilian city employee employed in the police department, any person employed as a police officer for an emergency, or any person privately employed as a police officer. Section 2-270 . Officers and employed services. * * * (5) "Actuary: " The board shall appoint an actuary who shall be the technical advisor to the board regarding the operation of the retirement system on an actuarial basis, and who shall perform such services as are required in connection therewith. The term actuary as used in this division shall mean a member of the American Academy of Actuaries, or a person who has demonstrated an educational background necessary for the practice of actuarial Science, and ha3 at 1 ast five (5) year3 of relevant actuarial experience. an "enrolled actuary" who is enrolled under Subtitle C of Title III of the Employee Retirement Income Security Act of 1974 and who is a member of the Society of Actuaries of the American Academy of Actuaries. A partnership or corporation may be appointed actuary if the duties of the actuary are performed by or under the direct supervision of an enrolled actuary and the enrolled actuary signs and is responsible for all final documents submitted by the partnership or corporation. a person who meets Section 2-272 . Credited Service. * * * Service rendered by a member of the retirement system shall be credited to the member' s individual credited service account in accordance with Rules the Board of Trustees shall from time to time prescribe and in accordance with the applicable provisions of Chapters 175 and 185 , Florida Statutes. In no case shall more than one (1) year of credited service be credited on account of all service rendered by a member in any one period of twelve (12) consecutive calendar months. Service shall be credited to the nearest one- twelfth of a year. Service shall be credited for the total number of years, and fractional parts of years, of service of the member. to - - - . - - _ - - - - . The-Board of Trustce3 may credit a member with a full year of credited service if the member has rendered at least ten twelfths of a year of 3crvice during any period of twelve (12) Section 2 .
