Ordinance No. 58-95-20 v ORDINANCE NO. 58-95-20 AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, FLORIDA, AMENDING CHAPTER 2, ADMINISTRATION, ARTICLE VI, EMPLOYEE BENEFITS, DIVISION 3, RETIREMENT SYSTEM, SEC. 2-279 (a) , DISABILITY RETIREMENT, BY ESTABLISHING A MINIMUM BENEFIT FOR POLICE OFFICERS AND FIREFIGHTERS DISABLED IN THE LINE OF DUTY, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED by the City Commission of the City of Atlantic Beach, Florida: SECTION 1. Sec. 2-279 (a) of the Code of Ordinances of the City of Atlantic Beach, Florida, is hereby amended to read as follows: " (a) A member having five (5) or more continuous years of credited service and having contributed to the retirement system for five (5) years or more may retire from the service of the city under the plan if, prior to his normal retirement date, he becomes totally and perma- nently disabled as defined in subsection (b) by reason of any cause other than a cause set out in subsection (c) on or after the effective date of the plan. Such retirement shall herein be referred to as "disability retirement. " The provisions for disability other than line-of-duty disability shall not apply to a member who has reached early or normal retirement age. The five (5) years of credited service shall not apply to police officers and firefighters disabled (as defined herein) in the line of duty. The minimum benefit for any police officer or fire- fighter disabled in the line of duty shall be forty-two percent (42%) of final average salary, regardless of years of credited service. " Section 2 . This Ordinance shall take effect immediately upon its final passage and adoption. PASSED by the City Commission on first reading this 22nd day of May , 1995 .
