SUBMITTED BY: Sonya Doerr,A1CP Community Development Director DATE: May 19,2003 BACKGROUND: The owners of the Dagley salvage yard have requested permission to install six-foot high security gates across unopened portions of the Tulip Street and West Sixth Street right-of ways and also a six-foot high fence extending east and west from the gates along portions of West Sixth Street. - These sections of Tulip Street and West Sixth Street do not provide access for any adjacent property owner, and Tulip Street extends from West Sixth Street towards the marsh areas of the Intracoastal Waterway. Tulip Street is a dirt road that is generally passable for trucks and other vehicles all the way to the marsh, and illegal dumping during overnight hours has been a continuing problem along this section of Tulip Street. City staff has been working with the owners of the salvage yard in conjunction with FDEP to require removal of all solid waste and junked vehicles, which had been placed on City right-of-ways adjacent to the salvage yard, as well as other materials not expressly permitted to be stored on the property. The property owners have now cleared most all debris and junked vehicles, which had over the years,spilled from the Dagley property on to the Tulip Street right-of-way. It is staff's opinion that the requested gate and fence will serve as a deterrent to illegal dumping in the future. Staff recommends approval of the gate and the fence subject to the property owner's acknowledgement that the City maintains all rights of access and use associated with Tulip Street and West Sixth Street,and that if required,the gates must be removed upon notice from the City. RECOMMENDATION: Staff recommends approval of the requested six-foot gates and fence subject to a condition, which shall be noted on the Fence Permit, advising the property owner that if necessary for any reason, the gates crossing public right-of-ways shall be immediately removed upon written request from the City. On March 12, 2003 a joint inspection of the Dagley Salvage Yard was conducted in conjunction with a Florida DEP follow-up inspection. This inspection revealed that you are conducting an automotive repair business independent from that of the salvage yard, and that you are operating with an invalid business license. Any business that operates independently from the salvage yard would have to receive a Use- By-Exception and be licensed through the City of Atlantic Beach. Until such time that you have received a Use-By-Exception and have become properly licensed to operate a business in the City of Atlantic Beach, you will curtail all business activities that are independent of the salvage yard. Should you continue to operate a business independent of the salvage yard without the proper licensing, both you and the property owner can be held responsible. The properties have been surveyed and the Daglely's are clearing lots to allow room for the cars that are illegally stored on City Right of Ways and on residential lots.They've had several hundred cars removed for scrap,but still have a long way to go. The trailers on the hill have been crushed and removed and Donald claims all the recreational boats are scheduled to be crushed and removed. They intend to clear all the roads and right of ways and are even talking about giving up one of the Special Purpose lots for the grandson to build a house on. Spoke with Donald Dagley, his intention is to be at Tuesdays Commission meeting, he's bringing his lawyer. He doesn't have anything other then the fence request,but says he feels better having his lawyer there. Otherwise everything is still moving right along. Property Location and Ownership The Dagley Salvage Yard properties are located on the north and south side of West 6th Street,where West 6th street meets the marsh adjacent to the intracoastal waterway. The Dagley Salvage Yard property was once owned by Raymond Dagley Sr. but upon his death, the property was split up and divided amongst his children and family friends. The property to the north of 6th street is currently owned by his son Donald Dagley.The property to the south of 6th street is owned by numerous people including his son Raymond Dagley,Jr.and his daughter Dianne Flores (sister of Donald and Raymond Dagley). The properties to the south of 6th Street are salvage yards and the property to the North is a salvage yard and an auto repair shop. A more thorough breakdown of the property ownership for each parcel (obtained from the Duval County property appraisers) is attached to this document. A. Violations of National Pollutant Discharge Elimination System Auto salvage yards fall under permitted Sectors of the NPDES Stormwater Program.A majority of the Dagley Salvage Yards activities are located outside and are affected by stormwater that can discharge into surface waters. Therefore,a Multi-Sector Generic Permit (MSGP) is required along with maintaining ongoing permit/monitoring requirements.The City of Atlantic Beach is requesting that the FDEP make a determination whether the Dagley Salvage Yards have satisfied the NPDES permit and associated requirements, including developing a Stormwater Pollution Prevention Plan.The City of Atlantic Beach has also received multiple complaints from neighboring property owners who have observed polluting discharges into the intracoastal waterway directly adjacent to the Salvage Yard properties.We have attached relevant photographs provided by neighboring property owners that appear to substantiate these complaints.The City of Atlantic Beach is also requesting an investigation whether these discharges meet any thresholds to trigger enforcement. B. Violation of Solid Waste Regulations The Dagley Salvage Yards are currently grandfathered in as an "old dump" and therefore are not subject to numerous regulations imposed on solid waste facilities, in addition to various other pollution controls. However, the City of Atlantic Beach has received numerous complaints from the neighboring property owners that the owners/operators of the Dagley Salvage Yards are allowing new waste (non- salvageable/non-recyclable) to be deposited on the properties. Complaints have also been received that the owners/operators of the Dagley Salvage Yards are digging/excavating into old waste piles on the property.The City of Atlantic Beach is requesting an investigation by FDEP to determine whether the Dagley Salvage Yards are accepting new waste and/or excavating/digging into old waste piles on the property. C. Violations of Clean Water Act's Regulations for The Discharge of Dredge &Fill Materials The City of Atlantic Beach is concerned that the Dagley Salvage Yards may have discharged fill into the intracoastal waterway.The attached photographs show mounds that have been erected on the boundary of the Salvage Yard property and the intracoastal waterway. If this is the case,this would constitute unpermitted filling of wetlands. The City of Atlantic Beach is requesting that the FDEP investigate whether the Dagley Salvage Yards are violating the CWA's regulations requiring permitting for the filling of wetlands. D. Violations of RCRA The FDEP has an agreement with EPA that mandates the assessment of penalties for violations of the Resource Conservation and Recovery Act (RCRA). We are requesting that the FDEP make a determination whether the Dagley Salvage Yards handle enough hazardous waste to qualify as Generators.The City of Atlantic Beach is concerned that the salvage yards have not obtained required permits and/or have not followed the record keeping requirements relating to their hazardous waste generation. Specifically,we are requesting that the Dagley's used oil practices be investigated to determine compliance with 40 CFR Chapter 279. E.Violations of Storage Tank Requirements The City of Atlantic Beach is requesting that the FDEP investigate whether the Dagley Salvage Yards have storage tanks that would require registration. If these these storage tanks are present at the Dagley Salvage Yards, the City of Atlantic Beach is additionally requesting investigation whether these storage tanks are violating any relevant regulations. The City of Atlantic Beach would appreciate the Department of Environmental Protection's timely and thorough investigation of the concerns raised above. Dagley Info In 1986 the City of Atlantic Beach created the Special Purpose zoning district(SP)in order to formally grandfather in several lots that had been used as a junkyard for some time. The junkyard had been under the ownership of Raymond Dagley,who initially purchased land in 1952. After his acquisition of the property and subsequent usage as a junkyard,the City's zoning code was changed in 1959 to prohibit new junkyard operations. However, since Mr. Dagley's junkyard was in operation prior to the zoning code changes, he was allowed to continue operations of his business as a legal non-conforming use. According to minutes from a City Commission workshop held September 29, 1986,there was some ambiguity as to which lots Mr. Dagley operated as a junkyard prior to the 1959 zoning change. Mr. Dagley's junkyard operation had expanded over time and he had also acquired several parcels over the years. Without formally recognizing which lots were legally non-conforming,there was a threat that the junkyard could continue to expand. This was the genesis of the creation of Special Purpose Zoning District. When the Special Purpose District(SP)was created by Ordinance 90-86-103,the City specifically stated which lots could remain as a salvage yard/junkyard. The provisions of Ordinance 90-86-103 were put into the City's Land Development Regulations. Section 24-113 (c)of the Land Development Regulations states"The site area for this existing salvage yard shall not exceed that covered by the blocks or portions thereof limited in location to the following lots of record identified as Section H,to wit: all of Blocks 111, 112, 113, 117, 118, 119, 140, 141, and 142". Mr. Dagley owned three other lots that were not included in the Special Purpose District. Block 110 was intended to be a buffer zone between the junkyard and nearby residential areas. Minutes of the October 27, 1986 City Commission meeting say that"Block 110 would be retained by Mr. Dagley and used as a buffer". In the October 13, 1986 Commission meeting there was also discussion about the City deeding its portion of Tulip Street north of 6th Street to Mr. Dagley in exchange for the eastern 50 feet of blocks 139 and 143. Due to issues with power lines running through the area,this idea was scrapped. Blocks 139 and 143 were then excluded from the Special Purpose District,and like block 110 intended to be used as a buffer area for residential properties to the east. Satellite imagery from the City of Jacksonville's GIS map system,Google Maps,and Bing Maps show that Blocks 110 and 139 are clearly being used for junkyard type operations,not residential uses as required by both the City's Land Development Regulations and Comprehensive Plan. The City of Jacksonville's GIS aerials from 2004 show that this illegal use has been occurring for some time. These uses are in direct violation of the City's Zoning Code, Comprehensive Plan,and Ordinance 90-86-103 and should be cited by Code Enforcement accordingly. I represent the Dagley family in this matter. By way of background, the Dagley family has operated a salvage junkyard in the City of Atlantic Beach for quite sometime. In 1986, a SP special use district was established for their property pursuant to Ordinance 00-86-100. Triis special use district is reflected today as Section 24-113. During the passage of that Ordinance, an agreement was made between the City of Atlantic Beach and the Dagleys, as to the use of certain streets. It was agreed upon and the parties have used the property that way since 1986. Specifically, the City of Atlantic Beach and the Dagleys agreed that the City would close Begonia Street from West 6th Street, South and Tulip Street from West 6th Street, North. In exchange, the Dagley's agreed to restrict the use of their operation to that property. There has become an interest in formalizing this agreement after recent right of way issues and zoning issues which the zoning department can address. The bottom line is to request formal recognition of the 1986 agreement that no right of way would be operated on Begonia Street to the South and Tulip Street to the North. In March 1985 a complaint was received regarding junk cars at three locations in Section H, including property south of Sixth Street, and at the westerly end of Sixth Street. 2. November 14, 1985, Mr. Dagley was brought before the Code Enforcement Board because of junk cars on lots 5 and 6, Block 162, Section H-the matter was continued to the Code Enforcement Board meeting of January 9, 1996. 3. On January 9, 1986, the Code Enforcement Board determined that Mr. Dagley's property was used in conjunction with his business prior to the zoning ordinance of 1959, of which he was being charged with violating. It was determined that he was not in violation of the ordinance and that his business was"grandfathered in." 4. March 24, 1986, the Mayor was authorized to appoint a committee to discuss the Dagley case with Mr. Dagley's attorney. 5. April 14, 1986, the Mayor reported to the City Commission that the committee recommendations had been forwarded to the Advisory Planning Board. (The committee recommended a"pulling-in" of Mr. Dagley's operations, and that he be given a Use-by-Exception to operate in a specific area near the marsh where most of his property was located. They recommended a swap of some of his lots for some of the city's right-of-way on Begonia Street to further consolidate his operation). 6. April 15, 1986, the Advisory Planning board voted to create a Special use District for a junk yard, consisting of blocks 111, 117, 118, 119, 139, 140, 141, 142, and 143. The board recommended that Mr. Dagley deed block 110 to the City in exchange for closing Begonia Street from West 6`h Street to the marsh; that Mr. Dagley remove all cars from lots 5 and 6, block 162, and restrict all future activity to property then owned by Mr. Dagley. (There is no evidence to indicate that block 110 was ever deeded to the city, or that the city ever abandoned or closed the portion of West 6th Street referred to above.) 7. May 20, 1986, a public hearing was held at the meeting of the Advisory Planning Board. The board identified the blocks to be included in the Special Use District and approved a motion indicating that if any lot or parcel within the Special Use District ceased to be used for Mr. Dagley's business, that parcel would not again be a part of the Special Use District. 8. November 10, 1986, the City Commission adopted Ordinance No. 90-86-103, establishing a Special Use District for salvage/junk yards consisting of Lots 111, 112, 113, 117, 118, 119, 140, 141, and 142, Section H. 9. November 18, 1986, Mr. Dagley's attorney(Alan Jensen) sent a letter to the city setting forth the actions which would be taken by Mr. Dagley: (a) Remove all junk vehicles from Lots 5 and 6, Block 162, and cease using those lots for his business (b) Remove all junk items from blocks 110, 139 and 143, and cease using those blocks for his business (c) Construct approximately 200 feet of privacy fence on the south side of West 6th Street with approximately 100 feet going east from Begonia Street and approximately 100 feet going west of Begonia Street -2-
