AN ORDINANCE VACATING AND ABANDONING
(SUBJECT TO RESERVATION OF SEWER AND
DRAINAGE EASEMENTS) , ALL THAT PART OF
THE STREET IN THE CITY OF ATLANTIC
BEACH, FLORIDA, SHOWN AND DESIGNATED
PARK AVENUE (DAVID STREET) ON THE PLAT
OF SECTION 3 , SALTAIR, RECORDED IN PLAT
BOOK 10, PAGE 16, OF THE PUBLIC RECORDS
OF DUVAL COUNTY, FLORIDA, WHICH LIES
WESTERLY OF THE PROLONGATION NORTHERLY
OF THE WEST LINE OF THE LOT DESIGNATED
AS LOT 737 ON SAID PLAT, AND EASTERLY
OF THE PROLONGATION NORTHERLY OF THE
EAST LINE OF THE LOT DESIGNATED AS LOT 725
ON SAID PLAT.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH,
FLORIDA:
SECTION 1. All that part of the street in the City
of Atlantic Beach, Florida, now known as David Street, but
shown and designated as Park Avenue on the plat of Section 3,
Saltair, recorded in Plat Book 10, Page 16 of the public
records of Duval County, Florida, which lies westerly of the
prolongation northerly of the West line of the Lot designated
737 on said plat, and easterly of the prolongation northerly
of the east line of the lot designated as Lot 725 on said plat,
be and the same is hereby vacated and abandoned; provided,
however, that the City of Atlantic Beach expressly reserves a
sewer easement in the above described portion of David Street
for all existing sewer lines therein and for any and all addi-
tional sewer lines which the City of Atlantic Beach may install
in said portion; and does also expressly reserve a drainage
easement covering the existing open drainage ditch on said
portion and for any and all additional drainage facilities of
any kind which the City of Atlantic Beach may install in said
portion; and does hereby further reserve in said portion the
right to maintain the existing sewer lines and the existing
facilities and any and all of such lines and facilities which
may be installed in the future therein.

SECTION 2. This ordinance shall become effective
immediately upon its passage on final reading.
