CLOSING, VACATING, AND ABANDONING THOSE CERTAIN
STREETS KNOWN AS CIRCLE STREET AND PALM AVENUE
BETWEEN THE PLAZA AND SEMINOLE ROAD (ALSO KNOWN
AS SALTAIR BOULEVARD) , AND THE SOUTHERLY 150
FEET OF CYPRESS STREET, ATLANTIC BEACH, FLORIDA.
WHEREAS, the City Commission of the City of Atlantic
Beach, Florida, sitting in regular public session has deter-
mined that the following portions of Circle Street, Palm Avenue,
and Cypress Street within the bounds of the City of Atlantic
Beach, Florida, are of no benefit to the City of Atlantic Beach,
Florida for any public purpose present or future, and
WHEREAS, the closing, vacating, and abandoning of said
streets, on the conditions set forth in this Ordinance, is
in the best interest of the City of Atlantic Beach, Florida,
WHEREAS, the City of Atlantic Beach owns all of the
property abutting Circle Street and Palm Avenue on the North
and East, and
WHEREAS, all other property owners abutting said streets
have consented to the closing, vacating, and abandoning of same .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS:
Section 1.
The portions of the streets to be closed, vacated
and abandoned are more particularly described as
that piece, section, or tract of land lying and
being in the City of Atlantic Beach, County of
Duval, State of Florida, to-wit:
Circle Street and Palm Avenue between the Plaza
and Saltair Boulevard (now Seminole Road) as shown
on the Plat of Section No. 2, Saltair, as recorded
in Plat Book 10, Page 15, public records of Duval
County, Florida, and the Southerly 150 feet of
Cypress Street, abutting Lots 577 , 578 and 579
as shown on the Plat of Section No. 1, Saltair,
as recorded in Plat Book 10, Page 8, public re-
cords of Duval County, Florida.

Section 2.
That said streets as described above are hereby
closed, vacated, and abandoned subject to the
condition that Higley Publishing Corp. convey
to the City of Atlantic Beach the following des-
cribed property:
A parcel of land, in Government Lot 6, Section 17 ,
Township 2 South, Range 29 East, City of Atlantic
Beach, Duval County, Florida, being also a portion
of Tract "A" , Saltair Acres No. 2, according to
plat recorded in the public records of said county,
in Plat Book 34, Page 64, said parcel being more
particularly described as follows :
For point of beginning, commence at the extreme
Northeasterly corner of said Tract "A" , located
at the point of intersection of the Southerly right-
of-way line of THE PLAZA (an 80-foot right-of-way) ,
with the Westerly right-of-way line of Circle Street
(a 50-foot right-of-way) as said rights-of-way are
shown on the plat of Section 2, Saltair, as re-
corded in the Public Records of said county, in Plat
Book 10, Page 15, and run South 6°19 ' East, along
said Westerly right-of-way line, a distance of 231.44
feet to an angle point; continue thence along said
Westerly right-of-way line South 22°32 ' West a distance
of 134.71 feet to a point; run thence North
6°19' West, a distance of 349.43 feet to a point in
said Southerly right-of-way line of THE PLAZA; run
thence North 83°41' East, along said Southerly right-
of-way line, a distance of 65 .00 feet to the point of
beginning. The land thus described contains 18,878
square feet, more or less.
Together with any and all interest of Higley Pub-
lishing Corp. in and to a portion of the Westerly
one-half of Circle Street described as follows:
For a point of beginning, commence at the intersection
of the center line of Circle Street (a 50-foot right-
of-way) with the Southerly right-of-way line of the
Plaza (an 80-foot right-of-way) , as said streets are
shown on the Plat of Section No. 2, Saltair, as re-

corded in the public records of Duval County, Florida,
Plat Book 10, Page 15 and run South 6°19' East,
along the center line of Circle Street, a dis-
tance of 237 .87 feet to an angle point; continue
thence along the center line of Circle Street
South 22°32 ' West 186 .52 feet to a point; run
thence North 6°19 ' West a distance of 51 .81 feet
to the Westerly right-of-way line of Circle Street;
run thence North 22°32 ' East along the Westerly
right-of-way line of Circle Street a distance of
134.71 feet to an angle point; run thence North
6°19' West a distance of 231.44 feet to a point
in the Southerly right-of-way line of the Plaza;
run thence North 83°41 ' East along the Southerly
right-of-way of the Plaza 25 feet to the point of
beginning.
Section 3.
This Ordinance shall take effect immediately upon
its final passage.
