AN ORDINANCE VACATING THAT PORTION OF CARNATION STREET
LYING BETWEEN LEVY ROAD AND WEST 14th STREET, AND PRO-
VIDING AN EFFECTIVE DATE.
WHEREAS, after due investigation and consideration it has been
determined that it is in the best interests of the City that the portion
of Carnation Street hereinafter described be vacated, and
WHEREAS, the portion of Carnation Street vacated herein is pre-
sently not open , is covered with dense natural wooded growth, is not sub-
ject to public use , and is adjacent to properties owned by Frebert Devel-
opment Corporation and Henry D . Rogers as joint tenants, and
WHEREAS, the said Frebert Development Corporation and Henry D.
Rogers desire to develop their property for residential purposes and to
include therein the vacated portion of Carnation Street, now therefore
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA:
Section 1. The street known as Carnation Street, between Levy Road and
West 14th Street, is no longer needed for public use, and the same is
hereby vacated.
Section 2 . The vacating of the portion of Carnation Street described
herein is made upon the express condition that within thirty (30) days
after final passage of this ordinance, Frebert Development Corporation
and Henry D. Rogers shall pay or cause to be paid to the City of Atlantic
Beach, as compensation for the benefits which will accrue to them as
owners of the property abutting that portion of Carnation Street hereby
vacated , the sum of $ 100.00 , which sum in the judgment of the City
is equal to such benefits.
Section 3. This ordinance shall become effective from and after it ' s
passage subject to the conditions of Section 2 . above, provided further
that Frebert Development Corporation and Henry D. Rogers shall , within
thirty ( 30 ) days after final passage of this ordinance, record a certi-
fied copy of the ordinance in the official records of Duval County, Florida.
