AN ORDINANCE VACATING THAT PORTION OF THAT
CERTAIN STREET KNOWN AS WEST PLAZA LYING
BETWEEN MAYPORT ROAD (A-1-A) AND ORCHID
STREET, AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, after due investigation and consideration it has been deter-
mined that it is in the best interests of the City that the portion of West
Plaza hereinafter described be vacated, and
WHEREAS, the portion of West Plaza vacated herein is presently not
open, is covered with dense natural wooded growth, is not subject to public
use, and is adjacent to properties owned by John V. and Lillian J. Piombo,
and
WHEREAS, the said John V. and Lillian J. Piombo desire to develop
their property for residential purposes and to include therein the vacated
portion of West Plaza,
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC
BEACH, FLORIDA:
Section 1. The street known as West Plaza, between Mayport Road (A-1-A)
and Orchid Street, is no longer needed for public use, and the same is hereby
vacated.
Section 2. The vacating of the portion of West Plaza described herein
is made upon the express condition that within thirty (30) days after final
passage of this ordinance, John V. and Lillian J. Piombo shall pay or cause to
be paid to the City of Atlantic Beach, as compensation for the benefits which
will accrue to them as owners of the property abutting that portion of West
Plaza hereby vacated, the sum of $10.00, which sum in the judgment of the
City is equal to such benefits.
Section 3. This ordinance shall become effective from and after its
passage subject to the conditions of Section 2. above, provided further that
John V. and Lillian J. Piombo shall, within thirty (30) days after final passage
of this ordinance, record a certified copy of the ordinance in the official
records of Duval County, Florida.
