It appears that there has been some confusion about the extent of the property lines at
810 Hibiscus Street. The City owns a portion of the area perceived as the front yard and
some property behind the white fence at 810 Hibiscus. The details of the City ownership
are shown with the attached special warranty deed with survey. Also included, is a print
out of the City owned parcel from the property appraiser website. However, note the that
the property lines are skewed on the website in relation to the buildings. This due to the
aerial photos being flown at an angle.
A portion of the property perceived as the front yard is City property therefore; utilities and
utilities repairs are a permissible in this area.
If you feel that this is in error, you are welcome to have your property re -surveyed.

SPECIAL WARRANTY DEED
THIS DEED made this 1st day of October, 1988 by Dean Russell,
General Contractor, A Proprietorship, Grantor, to CITY OF ATLANTIC
BEACH, FLORIDA, a Florida municipal corporation. Grantee, 716
Ocean Boulevard, Atlantic Beach, Florida 32233.

Grantor owns that certain real property located in the County
of Duval, State of Florida, more particularly described as follows:
Being a parcel of land 251 wide and 401.25 long and _
described as follows:
Being the east 25' of the south 35' of lot 5 together
with the north 51.25 of the east 25' of lot 6 Block
154, all in the plat of ATLANTIC' BEACH, SECTION "H", as
recorded in plat Book 18, page 34, of the current public
of Duval County, Florida.
Grantor, in consideration of One Dollar paid by Grantee, grants
and conveys to Grantee all of the above described property together
with all of the. estate and right of grantor in such property.
Grantor convenants as follows:
1. That the premises are free from all encumbrances made by
Grantor; and
2. That Grantor will warrant and defend the property hereby
conveyed against lawful claims and demands of all persons. claiming
by, through or under it, but against none other.
3. The property described above is deeded to the City of
Atlantic Beach for the sole purpose.of utilizing said property
as a piblic right -of --way for roads, public utilities, walkways,
drainage facilities and other related minicipal improvements.
4. In the event that the property is not used solely and
perpetually for the above stated municipal purposes, that the
land and any structures thereon shall revert to Grantor, its
successors or assigns, and Grantee, its successors or assigns
shall forfeit all rights thereto.
5. City of Atlantic Beach will not maintain or provide any
maintenance on the proposed right of way.
