1. CALL TO ORDER AND ROLL CALL
The meeting was called to order at 6:00 p.m. by Chair Hansen.
2. APPROVAL OF MINUTES
A. Approve minutes of the September 20, 2022 regular meeting of the Community
Development Board.
3. OLD BUSINESS
There was no old business.
4. NEW BUSINESS
A. 1985 Mayport Road ZVAR22-0017 (Florida Turf Company, Inc.)
Request for a variance to exceed the required 10 foot buffer strip for a dumpster and
screening fence located between a commercial property and residential property at
1985 Mayport Road.
STAFF REPORT: Director Askew presented the information as explained in the staff
report. She also provided a PowerPoint presentation.
APPLICANT REPORT: The applicant was not present.
BOARD DISCUSSION: Ms. Simmons asked what the applicant's options would be if
the Board denied the request. Director Askew said the dumpster would have to be moved
10 feet from the fence. She said that if the applicant doesn't move the dumpster then they
will be back in front of the Special Magistrate. Ms. Golombek asked if they could park
in the 10 foot buffer. Director Askew said they cannot park in that area. Ms. Lanier
asked if the applicant moved the dumpster to the side that abuts a commercial property
would they have to have a 10 foot buffer. Director Askew said they would not because
that would be a compatible use. Chair Hansen said that since the applicant wasn't present
the Board could take a vote or defer the request until the applicant is there. Ms. Durden

said that the Board can go ahead and vote or defer. Director Askew told the Board that
on July 7th the Special Magistrate ordered a stay until September 1 st and the applicant
was given 30 days to comply with the ordinance after the approval of the fence permit.
She said the fence permit was not approved and the dumpster was not moved, that is why
they applied for a variance. Mr. Haynie asked if the Board denies the variance then the
applicant can appeal to the City Commission. Ms. Durden said that was correct. Ms.
Lanier was not in favor of deferring the request.
MOTION: To DENY ZVAR22-0017 due to it not meeting any of the grounds for approval.
