ORDINANCE NO. 65=97-24
AN ORDINANCE OF '1'H1E CITY OF ATLANTIC BEACH, FLORIDA,
CLOSING,VACATING AND ABANDONING CERTAIN PORTIONS OF
AHERN STREET EAST OF OCEAN BOULEVARD, AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City of Atlantic Beach has deeded to Oceanfront Associates, Inc.,
certain portions of Ahern Street as described in the attached Corporate Warranty Deed; and
WHEREAS, it is necessary for title insurance purposes for the City of Atlantic Beach
to close, vacate and abandon those portions of Ahern Street. Therefore,
BE IT ORDAINED by the City Commission of the City of Atlantic Beach, Florida:
SECTION 1. The City does hereby close, vacate and abandon all right, title and
interest to those portions of Ahern Street, east of Ocean Boulevard, as more particularly
described in the attached Corporate Warranty Deed.
SECTION 2. Title to said portions of Ahern Street having previously been conveyed
to Oceanfront Associates, Inc., by virtue of the attached Corporate Warranty Deed, it is the
intent of the City that title to said portions revert to Oceanfront Associates, Inc., by virtue
of this ordinance.
SECTION 3. This Ordinance shall take effect immediately upon its final passage and
adoption.

(exp. 6/10/97) , Grantor, and OCEANFRONT ASSOCIATES, INC. , a
Florida corporation, whose address is: 1 Ocean Boulevard,
Atlantic Beach, Florida 32233 , Grantee,
WITNESSETH: that Grantor, for and in consideration of the sum
of TEN AND NO/100 DOLLARS ($10. 00) , in hand paid by Grantee, the
receipt whereof is hereby acknowledged, has granted, bargained and
sold to Grantee, its heirs, successors and assigns forever, the
following described lands, situate, lying and being in the County
of Duval, State of Florida, to-wit:

of-way) with the East right-of-way line of Ocean
Boulevard (a 60 foot right-of-way) ; thence North
83 "24'50" East, along the South right-of-way line of
Ahern Street, a distance of 262 . 90 feet to the point of
beginning; thence continue North 83 ' 24'50" East along the
South right-of-way line of aforesaid Ahern Street, a
distance of 67. 14 feet; thence North 04 '42'12" West, a
distance of 10.15 feet; thence South 83 °24'50" West, a
distance of 50.55 feet; thence South 52 '28 '26" West, a
distance of 19 . 73 feet to the point of beginning.

distance of 132 . 22 feet; thence North 05 '54' 10" West, a
distance of 13 . 00 feet to the point of beginning.
SUBJECT to covenants, restrictions and easements of
record, if any, and ad valorem property taxes subsequent
to the year 1996.

Grantor hereby fully warrants the title to said land and will
defend same against the lawful claims of all persons whomsoever.
