ORDINANCE NO. 65-02-30
AN ORDINANCE OF THE CITY OF ATLANZ~C BEACH, FLORIDA,
CLOSING, VACATING AND ABANDONING A CERTAIN A PORTION OF
CYPRESS STREET, AND PROVIDING AN EFFECTIVE DATE.
WHEI[tEAS, the City of Atlantic Beach has obtained an easement for installation and
maintenance of a water line ,from Cypress .Street to Nautical Boulevazd South across certain real
property owned by John and Susan Cane, and
WI~~EREAS, the Canes are providing valuable consideration to the City of Atlantic Beach
by executing a Grant of Easement for said waterline, and
WHIItEAS, that portion of Cypress Street which fronts the Cane's property is at the
westerly end of Cypress Street and is of no practical or other use to the City, and
WHEREAS, it is in the best interests of the citizens of Atlantic Beach, and a valid public
purpose, that a certain portion of Cypress Street be closed. Therefore,
BE IT ENACTED BY THE CITY COMIVIISSION ON BEIiALF OF THE PEOPLE
OF THE CITY OF ATLANTIC BEACH, FLORIDA:
SECTION L The City does hereby close, vacate, and abandon all right, title and interest
to that portion of Cypress Street as described in the legal description attached as Exhibit A hereto,
and as shown on the map attached as Exhibit B hereto.
SECTION 2. Title to said portions of Cypress Street shall revert to the adjoining property
owners as provided by law.
SECTION 3. This Ordinance shall take effect immediately upon its final .passage and
adoption.

Commence at the intersection of the northerly right of way line of Cypress Street (a 50 foot right of
way as now established) with the westerly right of way line of Belvedere Street (a 50 foot right of
way as now established); thence north 67'28"00° west, along said northerly right of way line of
