SOP STANDARD OPERATING PROCEDURES44 joy_ 5,CITY OF ATLANTIC BEACH 101 800 SEMINOLE ROAD j ATLANTIC BEACH, FL 32233 904) 247-5800 BUILDING DEPARTMENT STANDARD OPERATING PROCEDURES POLICY TITLE: Issuing Certificates of Occupancy and Certificates of Completion EFFECTIVE DATE: 7/20/22 FROM: Building Code Administrator Dan Arlington A Certificate of Occupancy(C.O.) is issued, per FBC-B, Section 111, for all construction where new occupiable space is created, including horizontal and vertical additions to existing structures. A Certificate of Completion (C.C.) is issued, per FBC-B, Section 111.5, for work on a system or structure that is complete and released for use, but does not create new occupiable space. C.C. for a shell building does not authorize the shell building to be occupied before the C.O. is issued. PROCEDURES: 1. Final trade and building inspections must be approved before C.C. or C.O. inspections can be scheduled. a. Depending on the project, C.C. and C.O. inspections will include other departments and agencies, in addition to the Building Department. 2. A Final, As-built Topographical Survey, per COAB 24-68. (See Bulletin 2-18) 3. A Termite Certificate of Compliance from a licensed pest control company, per FBC-R 318.1, with the following language: The building has received a complete treatment for the prevention of subterranean termites. Treatment is in accordance with rules and laws established by the Florida Department of Agriculture and Consumer Services." 4. A Building Air-Leakage Test (Blower-Door Test)from an approved third party agency, per FBC-EC, Section R402.4. The test must show an air leakage rate not exceeding 7 air changes per hour. Exceptions:The test is not required for additions, remodeling, or commercial buildings. 1 5. For projects requiring on-site stormwater storage, a Declaration of Restrictive Covenant must be provided, per COAB 24-68. There are three forms of the Declaration, depending on the type of ownership of the property. 1. Owners are individuals or married. 2. Owner is an LLC. 3. Owner is a corporation. Provide the appropriate Declaration Form to the current Property Owner. This may be the builder. The Declaration Form must be completed by the owner(s), signed in front of two witnesses, notarized, recorded by the Duval County Clerk of Court, and returned to the Building Department with the three required Exhibits: A, B, and C (also recorded). Exhibit A = Legal description (copy of deed or print-out of Property Appraiser's web page). Exhibit B = Approved site plan, showing stormwater storage and drainage details (from Permit package). Exhibit C = Final topo survey, showing as-built stormwater storage and drainage details. Total of four documents recorded. Each Exhibit should be labeled. The Declaration documents must be available to all departments and agencies with enough time to review and approve the documents and conduct final inspections with the documents in hand. Close permit and issue C.C. or C.O. All final documents must be submitted and approved. All departments and agencies must have approved all Final and C.C. or C.O. inspections. Issuing the C.C. / C.O. may be the next business day after the last inspection is approved. Issuing the C.C. / C.O. may be no more than two business days after the receipt of a request for a C.C. / C.O., the Private Provider Certificate of Compliance, and all other government approvals required by law, per F.S. 553.791(13). 2
