Ordinance No. 68-69-1 v 1!!: CITY OF, , . ;; AgaafiiO4; Beadies-Temicla Ordinance No. 68-69-1 AN ORDINANCE REGULATING SWIMMING POOLS IN THE CITY OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA. BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA: SECTION I. FENCING, ZONING AND ENCLOSURE REQUIREMENTS : (a) Family pools shall be provided with a fence enclosure at least four feet (4 ' ) high with the necessary gates and locks so that the pool will be accessible only upon the owner ' s invitation. (b) The water surface area of a family pool combined with the total area of all other accessory buildings or accessory structures on the lot shall conform with accessory building requirements in City zoning regulations . (c) Pool walls shall be a distance from property lines and building foundations of not less than the depth of excava- tion below natural grade, but in no case shall any pool, retaining wall, berm or other part of a pool be nearer than three feet (3 ' ) from a property line. (d) Where an enclosure or roof is provided over a pool, it shall comply with the building code and accessory building requirements of the City zoning regulations. SECTION II. PLUMBING PERMIT REQUIRED: All plumbing connected with a swimming pool shall conform to City plumbing regulations and shall require a plumbing permit. SECTION III. WATER SUPPLY: Water supply to swimming pools shall be only by means of a fixed gap supply with no direct connection between the pool and any source of water supply. SECTION IV. DISPOSAL OF WASTE WATER: An approved method of disposing of backwash water and for emptying the pool shall be provided as follows: CITY OF. . . 711f • DeacI -Teo4w4 Ordinance No. 68-69-1 Page 42 (a) Where a City storm sewer is available, waste water shall be disposed of to an approved storm sewer connection. If such storm sewer connection is not available, a connec- tion shall be made to the City Sanitary Sewer if approved by the building inspector. On all connections to storm or sanitary sewers, an approved type catch basin shall be pro- vided on the owner ' s property to intercept sand or diatomaceous earth or other matter. (b) Where sewer connections are not available, other means of disposal, such as lawn sprinkling or open ditch discharge, may be approved by the building inspector. When open ditch drainage is provided, it shall be the pool owner' s responsi- bility to provide new means of disposal whenever the ditch is closed by the City. SECTION V. This Ordinance shall become effective immediately upon its final passage. * * * * Passed by the City Commission on first reading on March 10, 1969.
