AN ORDINANCE PROVIDING FOR THE IMPOSITION AND
COLLECTION OF SEWER SERVICE CHARGES, FOR THE
USE AND AVAILABILITY OF SERVICE AND FACILITIES
AFFORDED BY THE SEWER SYSTEM OF THE CITY OF
ATLANTIC BEACH; REQUIRING CONNECTIONS WITH
SAID SEWER SYSTEM; AND PROVIDING FOR THE ENFORCE-
MENT OF THE COLLECTION OF SUCH CHARGES.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, That
Section I. The following schedule of monthly sewer service
charges for sewer service provided or made available by the sewer
system of the City is hereby determined to be just and equitable
and is hereby adopted and established.
1. Residential Rates:
(a) Single Family Residence; $2.50 per month.
(b) Duplex Residence (2 family) ; $4. 50 per month.
410 (c) Multiple Family; $2. 50 for 1st unit per month;
$2.00 per unit per month for next three units;
$1. 50 per unit per month for all units over
four.
2. Commercial Rates:
(a) Retail Stores and Offices; $2.00 per month
for first toilet installation and $1.00 per
month for each additional toilet installation.
(b) Bars; $5.00 per month
(c) Drug Stores; $2.00 per month for first toilet
installation and $1.00 per month for each
additional toilet installation, plus $1.00 per
month for fountain sink.
(d) Restaurants (Including Bar) :
40 seats or less $ 5.00 per month
40 to 80 seats 10.00 per month
80 to 120 seats 12. 50 per month
Over 120 seats 25.00 per month

(e) Filling Stations; $4.00 per month
(f) Hotel; $.25 per month for each bedroom plus
the above rate for Restaurant and Bar.
(g) Motels; (Including operators residence) ;
$2.50 for first living unit, $.50 for each
rental unit with kitchen; $.25 for each
bedroom, each per month.
(h) Mobile Home Park; $2. 50 for first trailer
space, $1. 50 for each additional trailer
space, each per month.
(i) Churches; $2.50 per month.
(j ) Elementary School; $25.00 per month.
(k) In buildings or structures with more than
one type of occupancy, the above rates shall
be combined to obtain the proper monthly
charge.
3. OTHER USERS. Such provisions and appropriate sewer
charges shall be made for any user not covered by
the schedule of rates by contract entered into
between the City and such user and approved by the
City Commission without amendment of this Ordinance.
Section II. OUTSIDE CITY SEWER SERVICE: No sewer connec-
tion shall be made to any lot or tract beyond the City Limits with-
out approval of the City Commission and such approval will not be
given unless City water service is also supplied to said lot or
tract. The annual sewer service charge shall be the sum of the
following:
1. The applicable rate or combination of rates in accord-
ance with Section I above, and
2. The City tax millage rate for the previous year
applied to twice the gross tax assessment valuation shown by the
Duval County tax roll for the previous year for the lot or tract
of land and improvement with no deductions for homestead or other
exemptions. This charge shall become due and payable on January 1,
and shall be billed with the regular water and sewer service bills
rendered at that time. All charges shall become delinquent 30 days

after billing date and a 10% penalty shall be collected on all
shbw_delinquent bills. Sewer and water service shall not be provided
while any sewer charge is delinquent.
Section III. COMPULSORY CONNECTION REQUIRED. The owner of any
building or structure now or hereafter located on a lot or plot abut-
ting an existing sewer line, or a new line constructed in the future
as part of the sewer system, shall be and is hereby required to connect
the said building or structure to said sewer system within 180 days
from the date that said sewer system, or that portion thereof avail-
able to serve the premises in question, is completed and goes into
operation; and the owner, tenant, occupant or user of any such build-
ing or structure, or unit thereof, as the case may be, shall there-
after refrain from using and cease to use, any other method for the
disposal of sewage, or sewage waste. Such connection shall be made in
accordance with the plumbing code of the City, after permit has been
obtained from the plumbing inspector. No tap or connection shall be
raade to the City sewer system without permission and under the super-
vision of the plumbing inspector. The City reserves the right, how-
ever,, not to permit connections of any industrial property where the
sewege would contain waste matter that could not be adequately
treated at a reasonable cost.
Section IV. BILL= AND COLLECTION 0? SEWER CHARGES.. Sev:er
.service charges for the use of the facilities of the sewer system
shall be billed and collected by the City as an added and designated
separate item upon the water service bill for the respective quarter
or billing period in accordance with the rates established herein, or
et such rates that may be changed from time to time, and such sewer
service charges shall be due and payable on the first day of each
billing period, which is the time water service charges are due and
e axle to the City. The user of water service shall be required to
tlse sewage service charges at the same time the water service
charges are made and is not persitted to pay the water service charges
without the payment of the sewage service charge. In the event that
any sewage service charges remain unpaid 30 days after the due date
thereof, the water service or sewer service, or both, to the build-
ing or structure or units thereof effected, shall be discontinued and
said services to such building, or structure, or units thereof shall
not be restored unti'_ such time ae all sewage service charges due
shall have been paid.
Section V. REINSTATE:"GENT Cir RGE. A service charge of $2.00
shall be made each time water service is restored and a reasonable
charge each time sewer service is restored after having been discon-
tinued fcr non-payment of sewage service chergs.
Section VI. NO FREE SEWER SERVICE TO BE RENDERED. There shall
be no free service renelered by the sewer system except it will not
be necessary for units of the City Government to pay for such service.

Section VII. ABSENCE OF OCCUPANT FROM PREMISES. The City
Manager shall on request discontinue sewage service to any user of
said sewer system during any period of absence of such user or to the
occupant of the premises served provided the water service is also
discontinued, and restore such service to such user upon such terms
and conditions and upon the payment of such charges for discontinu-
ance and restoration and during such period of no service as he
shall determine and which shall be approved by the City Commission.
Section VIII. RULES AND REGULATIONS. Pursuant to the pro-
visions of this Ordinance, the City Commission may by resolution
from time to time, prescribe rules and regulations not inconsistant
herewith concerning billing, collection, and inforcement of collec-
tion of sewage service charges, and rules concerning connections of
buildings and structures to the sewage system including the imposi-
tions of reasonable charges in making such connections.
Section IX. Any person violating any of the provisions of
this Ordinance shall be punished by fine not exceeding $50.00 or
by imprisonment not exceeding 30 days, either one or both in the
discretion of the Court trying the defendant.
Section X. If any part of this Ordinance shall be declared
void or unconstitutional by Court of competent jurisdiction such
shall not effect the remainder of this Ordinance.
Section XI. EFFECTIVE DATE. This Ordinance shall take
effect immediately upon its passage.
